    • Laura, I was surprised that the Director said that you hadn't appealed twice. I thought that the letter you posted on 24th June was the second appeal and that was to the IAS. And they did say that there was no further appeal possible. Could you please explain how many times you appealed. I am going to read your WS now. PS  Yes I meant to say that the keeper did not have a licence therefore it was wrong of them to assume he was the driver and the keeper. Thanks for picking that up.
    • In answer to your questions yes even though it wasn't called that, it was the NTK. Had it been a windscreen ticket you would not have received the NTK until 28 days had elapsed. In earlier times if the warden was present then a windscreen ticket would have been issued. It nows seems that the DVLA and the Courts don't see a problem  with not issuing a ticket when a warden is on site. A period of parking must mean that ther e has to be a start time and a finish time in order for it to be considered a period. A single time does not constitute a period. I am not sure what you mean by saying it could be taken either way.  All they have mentioned is  the incident time which is insufficient. There are times on the photos about one minute apart which do not qualify as the parking period because they are not on the PCN itself. The reason I asked if the were any more photos is that you should be allowed 5 minutes Consideration period for you to read the signs and decide whether you want to accept them and you do that by staying longer than 5 minutes. if  more  do not have photos of your staying there for more than 5 minutes they are stuffed. You cannot say that you left within the 5 minute period if you didn't , but you can ask them, should it get to Court , to provide strict proof that you stayed longer than the statutory time. If they can't do that, case over.
    • I recently bought some trainers from Sports Direct and was unhappy with them and their extortionate delivery and return postage charges. I tweeted about being unhappy, and received a reply from someone claiming to be from Sports Direct asking me to send my order number and email address by pm, so a claim could be raised. Which I (stupidly) did. The account used Sports Direct's name and branding, and a blue tick.  The following day I received a call from "Sports Direct Customer Service", and with a Kenyan number. They asked for details of the issue, and then sent me an email with a request to install an app called Remitly. They provided me with a password to access the app then I saw that it had been setup for me to transfer £100, and I was asked to enter my credit card number so they could "refund" me. I told them I was uncomfortable with this (to say the least), and was just told to ring them back when I did feel comfortable doing it. Ain't never gonna happen.  I just checked my X account, and the account that sent the message asking for my details is gone. I feel like a complete idiot falling for what was a clear scam. But at least I realised before any real damage was done. if you make a complaint about a company on social media, and you get a reply from someone claiming to be from that company and asking for personal details, tread very carefully.   
    • The good news is that their PCN does not comply with the Protection of Freedoms Act 2012  Schedule 4.. First under Section 9 (2)The notice must— (a)specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates; (b)inform the keeper that the driver is required to pay parking charges in respect of the specified period of parking and that the parking charges have not been paid in full; The PCN does not specify the parking period. AS you rightly say the ANPR times do not include driving to the parking space and then from there back to the exit. And once you include getting children in and out of cars especially if seat belts are involved the time spent parked can be a fair bit less than the ANPR times but still probably nowhere near the time you spent. But that doesn't matter -it's the fact that they failed to comply. Also they failed to ask the keeper to pay the charge.  Their failure means that they cannot now transfer the charge from the diver to the keeper . Only the driver is now liable. As long as UKPA do not know who was driving it will be difficult for them to win in Court as the Courts do not accept that the driver and the keeper are the same person. Particularly as anyone can drive any car if they have the correct insurance. It might be able to get more reasons to contest the PCN if you could get some photos of the signs. both at the entrance and inside the car park. the photos need to be legible and if there are signs that say different things from others that would also be a help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right. i phoned them yet again this morning and the advisor said there was a note on my claim saying all checks had been done and its now ready to be finalised not too sure what this means as im all puffed out over this, she then said my paper work will be with me 'soon' but couldnt state a time. I wondering what will be in my paper work lol. xxxx

becky that sounds promising - i think there is just a new checking system and it will just take about 6-8 weeks to be done for all of us i havent been waiting that long only around 3 and half so i probs have a while longer to wait x

just to put your mind at ease - if there was an 'investigation' you do actually get a letter stating this - i did receive one - then worried for weeks and weeks trying to think what i could have done wrong - never ever recevied anything else and that was 2 years ago so either they are still investigating it or couldn't be bothered :-)

Well checked my bank and it is the same amount as always - not even slightly different so my claim obviously is taking a while to "process"!

 

......oh and the post has come and nothing in it! Although my heart skipped a beat when I saw a brown A5 envelope lol - bloody DWP!

Well, STILL nothing for me. This is now my 11th week. No point in ringing anymore because I either get a rude person on the phone or get told nothing. NIGHTMARE!!!!!

well i havent heard anything either but i got my tax credits today and its £5.07 more than what i normally get!! WTF!!!! what does that mean???? none of my details on my renewal where any differnt to the provisional award i got a couple of months go and its gone up??? omg im even more worried now. :-(

Claire surely that's gotta be good news?!?!?!?! I would say that it means your renewal has been dealt with and you are now getting an extra £5.07 per week!!!! If i was in your shoes I'd have been happy. You've now made me panic even more lol - why's mine taking even longer??????????????????? :jaw:

100%!!!! That's what's happened each year with me - you'll get your paperwork in about 10 days.

 

You've made me panic though now as mine was exactly the same this week so why has mine not been sorted?!?!?!?!?!?!?!?!?!?!?!?!?!?!?!? I go on holiday next Weds so am hoping it's sorted before then as i'll be having withdrawal symptoms of not being able to check the post lol x

Yes I'm still in the same boat. Still nothing at all. This waiting is so unnerving. I'm glad Claire is sorted, means there's hope out there for us yet. But I think I'm the longest on here without any paperwork through yet. Never again will I post my renewal I will always phone!!!! Keep me updated

I sent mine off on 05/07 and I think Claire sent hers in the week after - hers she said was straightforward. I did have a couple of changes towards the back of last year but they were notified straight away. The waiting an constant checking is bloody killing me. I daren't ring them but my husband called 2 wks ago and was told my renewal had been received and it was being "processed" - my worry is, why on earth is it taking so long?!?!?! Normally it's 48 hours. I am guessing it hasn't been dealt with as my payments haven't changed by even a penny.

 

God could do without this stress!!!!!!!!!! Arghhhhh!

Well, I have an update. Normally I get my payments every Thursday but I checked my account today and they have deposited almost £15.00 into my account!!!! I just don't understand this, it gets stranger and stranger. Won't have the time to try constantly to get through on the phone to them today to ask why, will just have to wait until tomorrow and see if my normal weekly amount goes in. Anyone have any thoughts??? Has this happened to anyone else??

Had that for the past few years a random amount being put in my account. That will just mean that last year you were underpaid by £15.00 - your amount on thursday may be slightly more that normal and that will be your regular amount.

 

Now I really am the last one standing lol!

Do you really think so??? I've never had this happen before. Hope you are right. I hope you will get sorted very soon as well. Don't forget mine has been ongoing for over 11 weeks now so you might be a few weeks behind me. Anyway I'll keep you updated and you do the same. Good luck xx

I have claimed tax credits for nearly 7 years and in previous years if you have an underpayment they pay it separately after renewal and then my weekly payments have altered slightly (a couple of £'s either way); your paperwork will probably follow within 7-10 days.

 

I just find it really unnerving that it is taking soooo long when it hasn't done before. My payment on Monday was exactly the same as it has been for the last few months so either I am exactly right or it hasn't been dealt with?!?!? The waiting is absolutely killing me!

 

Post hasn't been yet today but I religiously check my bank everyday and nothing has gone in (not that I am expecting an underpayment!).

 

I will keep the thread going as like me, people may find this thread searching for answers about their own tax credits delay! I know mine has only been since 07/07 but that's over a month - it has NEVER taken this long! Do you mind me asking did you have a few changes to your circumstances last year?!? As I am wondering whether this effects the renewal i.e. if you have had changes in the previous year they are dealt with differently hence the reason it is taking so much longer?

i still havent had any paperwork so like i say im not settling till i have my award notice in my hand, and why would they give me a extra £5.07p when my figures were the same as last year i just dont get it. Driving me nuts still,

 

i think your payment of £15 will be what they owe you from last year, update with your payment tomorow if its ok etc...

How they work out payment is anyones guess!!!!!! Well no post again today for me. God knows what am gonna do with my time u know when this gets sorted lol.

Don't mind you asking at all, I had no changes to my circumstances last year but I did get a letter out in February asking me to contact their "specialist compliance team" to confirm all my details, which I did and was asked some very personal questions which I answered truthfully. This could have had something to do with it. If I had to bet I would say that they have very big staff shortages (as do most government departments) and have a massive backlog to get through which is why it's taking so long. Could be just luck of the draw on whoever's desk it ends up on etc. Either way the manner in which most of the people here have been treated has been scandalous and disgusting. Even the staff who answer the phones end up being rude if you don't accept what their explantation for delays are. I have had answers such as "there are extra checks being carried out" or "it is with the team manager for processing" or "its a very busy time of year for us" or "it's currently with another department". Everytime I ring I get told something new. Like you, my renewal has never taken this long and I'm not counting my chickens until something has been sent to me in writing cofirming what my payments will be. Is is any wonder people dread ringing them to report changes!!!!!

I'm going for an interview this afternoon so if I get the job I am not looking forward to ringing them incase it halts the renewal!!!!!!!!!!!!!!

 

One of my friends has actually stopped claiming tax credits because of the system and the fact that even if you keep them updated you still end up with an overpayment!

Hi all I'm glad I found this thread. Just wanted to let you know that I too am waiting for renewal to be processed. The tax cred office received my renewal on 10th may!!! That's almost 14 weeks ago and I have been ringing every couple of days and all I get told is that it is still processing. I'm worried sick. I'm due to be paid tomorrow and literally have butterflies checking my account as like so many I rely on that money x

Hi zara - welcome to the "special club"!! Well my husband rang again today and they said it's still processing so still none the wiser!!!

 

It looks like claire and jw have been sorted although they are awaiting their paperwork.

 

Keep us informed! Did u have many changes last year or is yours straightforward? X

I didn't have many changes last year. I stopped using childcare last july/aug and my young daughter was awarded dla. I think the problem might be that on my renewal I have declared some benefits ( I started getting carers allowance from july 10). I didn't tell them I was getting it :( didn't know I had to tbh x
