    • Thank you for posting up the required details and well done for apparently not revealing the identity of the driver. I am assuming you are the keeper? The depth of ignorance of the parking companies is absolutely amazing. The Protection of Freedoms Act 2012 Schedule 4 is the law relating to private parking and allows those rogues to be able to transfer the charge from the driver [whose name they do not know] to the keeper after 28 days . This is dependent on them complying with the Act. So many of the don't and Alliance is no different. It would help if we could see what you appeal was and to post the back of the PCN as it is lacking so much of the wording necessary to make it compliant so that in your case only the driver is liable to pay the charge. And of course just entering the ANPR arrival times means that they have failed to specify the parking time which is a requirement..  Because the car park was so busy you had to drive around for quite a while before finally finding a place to park which is when the parking period may  actually begin. The poor dears at Alliance have not grasped that particular part of the legislation as yet. To be fair the Act has only been in place for 12 years so one must make allowances for their stupidity . We shouldn't really mock them- but it is fun. You weren't to know but the chances of winning an appeal against Alliance and the IPC is around 5%-and that is high for them. If they allow you to cancel they lose the chance of making money and they would have had a field day when you were there with so many people being caught overstaying because of the chaos in trying to find a parking space then trying to pay.  Your snotty letter could go something like this- Dear Cretins, Yes I mean you Alliance. After 12 years one would have thought that even you could produce a compliant PCN. Did you really think I would pay you a penny extra considering the time I wasted trying  to pay with  long queues at the parking machine, then trying to get a signal to call Just Park. On top of that you then had the cheek to ask for an additional £70 for what dubious unspecified pleasure? You must have made a killing that day charging all those motorists for overstaying because the queues to pay were do long and even walking to pay from the over flow parking fields takes time. And yes I did take photos of the non existent signs in the fields so please don't give me the usual rubbish about your signs being clearly visible. Oh yes that £70. Please tell me and the Court whether that charge included VAT and if it did, why am I being charged to pay your vat? I am sure the Judge would look carefully at that as well as the Inland Revenue. The truth is you had no reasonable cause to ask the DVLA for my data given the chaos at your car park and I believe that you therefore breached my GDPR...................... I expect others will give their views as well.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have to say 'I told you so' about the Wonga business model, 108% interest over a year is a downright disgrace.

 

It is such a pity this government hasn't clocked onto the fact that these predatory sub-prime lenders are as bad as the sub-prime mortgages which helped feed the financal meltdown - and is part of the reason we are in a double-dip recession.

They probably have clocked on to it sillygirl. But it wouldn't surprise me at all if a lot of senior politicians have their hands in the industry, or, like Cameron, the PDL owners were donating hundreds of thousands towards their election campaign.

I sometimes have a look around America to see what is going on over there with the legalloansharks.

And how even after caps had been placed on loans to the military the legalloansharks tried their best to find a way round it.

I knew the sharks had been such a bother to the military personnel in America that the Military Lending Act was set up.

They congregated round military bases like the predators they are.Saw their prey and went for it.

5 years ago this was set up.

Yes there are some mistakes in that article.Seems a bit thrown together.Never mind.

Its a bit quiet on major news in the fight against the legalloansharks at the moment.

But plans and strategies maybe being worked on as we speak.

I have read some interesting thoughts on the will legalloansharks police themselves here and there and will put a few on later.

Been busy with the rain stopping and managing to get to work without the use of the Ark.

There seems to be strange going ons with Stella Creasy the MP who fights the sharks tirelessly.

She is asking if anyone has any shark costumes.

I haven' got a shark costume but I could see about making one, I've got some grey material lurking around! Sounds interesting.

 

I am going to start complaining to the tv advertising people about the PDL adverts, in daytime TV on some channels it is portrayed as a 'normal' part of your weekly shop to visit Brighthouse et al, not something I approve of at all. There are things I need but I wouldn't get anything from them!!!

 

We got a load of stuff recycled again, I've got a 'dead' printer (printhead going), to recycle today, and probably some other bits... it is a good way of passing items on.

Football League's advertising deal with Wonga ends

Payday lender Wonga will no longer advertise on Football League club websites after its deal ended.

A spokesman for the league said it was not seeking to renew the deal and had signed a new contract with Capital One.

It comes before fans were due to vote on a motion calling for the lender's adverts to be pulled from club sites.

Wonga said it remained committed to its Blackpool and Hearts sponsorships and would continue to assess deals for next season.

The Football League have just announced they are ending their commercial relationship with Wonga! Thank you to everyone who has supported the Red Card for Wonga Campaign so far for contributing to this result!

However, we still want to encourage football clubs and the Football Association to go further in showing leadership on this issue. Payday lenders could and will still target grounds and offer sponsorship deals to clubs - and whilst this industry is not properly regulated in the UK this means they can still target fans and their families with loans at extortionate rates of interest that all to often cause financial problems for consumers.

Please help us show that just because the Government won't act against legal loan sharks, we can together take a stand. Ask your local football club to commit to rejecting all sponsorship or advertising approaches from these companies until they are properly regulated by a cap on the costs of credit. If you receive a response from your local football club in support of this position please do let us know.

 

 

Please also let the Football Association know you support our call for them to extend their current ban on alcohol and gambling adverts on merchandise for those aged under 18 to include high cost credit companies. You can do that by emailing David Bernstein, the Chair of the FA on [email protected] – please make sure you mark the subject header as “FAO: David Bernstein”. Below is a suggested text to use to highlight to Mr Bernstein your support for this campaign and request to the FA to help limit the presence of these companies in football.

Targeting communities struggling to cope during these difficult economic times, these companies charge extremely high rates of interest for loans in a UK credit market which has little regulation to protect consumers from the problems these cause. With one in three payday loans taken out to pay off another payday loan it is clear they can often lead to financial problems for those who use them. Whilst other countries have introduced legislation to cap the charges these firms can levy, the UK has no such limits.

 

Please support this campaign by joining me and other fans in calling on clubs not to take advertising or sponsorship from these companies until the UK introduces a cap on the costs of credit. This would give British consumers the same protection from these companies others around the world enjoy. Furthermore, I applaud the strong stand the FA has taken on alcohol and tobacco advertising on merchandise aimed at fans under the age of 18. I urge the FA to extend this ban to these companies too until they are properly regulated in the UK by a cap on the costs of credit.

I had a discussion about this yesterday with an adviser in the local Prospects (jobcentre offshoot to help people find alternative employment), he said that Wonga's business deal was absolute rubbish - it cropped up during a discussion on finding some start up funding and he said "Do not even think about payday loan companies". I told him I have long campaigned against it and he also added "The money shops and the likes of Brighthouse (we haven't got one as the local council turned down their application) should be closed down, they don't bring anything except misery and poverty to the High Street".

 

These payday loan companies shouldn't be trying to become 'mainstream lenders' until they drop their interest rates.

Very nasty indeed... this needs seriously taking down - I do not believe for one minute the comments at the end of the article about customers who are asking for money from them - they are seriously deluded, if they do not have enough money to the next payday then they are going to have even less for the following one - thereby the trap has been set and sprung.

 

There is also a lack of licence info on the page, not to mention the mention of the Social Fund - I am going to pass this info onto somebody in the DWP who can get this lot looked at from a senior level - total abuse of the system.

Good, I reported it to my DWP adviser as he can get higher people to look at that - might be part of the reason it has been taken down.

 

Calling themselves The Social Fund was a bit much, and their bit about not being the DWP was strange, especially as they then showed a lot of DWP phone numbers and seemingly gave 'advice' to people waiting for crisis loans.

Microlender Kiva begins making loans to L.A. small businesses

 

The nonprofit lender, which uses its website to get ordinary citizens to help support its loans, has started by funding 13 loans in the L.A. area.

Approved businesses will be charged between 0.3% and 2% a week for loans ranging from £3,000 to £10,000, for any term between one and 52 weeks.

In addition, customers will also have to pay an arrangement fee of 1-5% based on the size of the loan and make repayments on a weekly basis or face penalty fees of £10 for each missed payment.

So, for a business borrowing £10,000 for the maximum term of a year with an interest rate of 2% and associated fees at 5%, the total amount paid on interest and fees alone is £10,900! This means a business could end up paying back £20,900: more than twice what they originally borrowed, which just doesn’t really add up.

So why would any business choose to borrow money in this way?

I know many of you who advise on the payday loan forum are up for the fight,because i read your advice you give people.

It seems just when you think, maybe the legalloansharks are perhaps weakening you get a wake up call and realise

they are powerful organisations both here and in America where in some places i have been reading about their strength is growing.And seem to get the nod of approval from the government.Carry on old boy,ripping the money out of the public who then have less to spend in local shops,the heart of a community.

Then pick up your profits and jet out of town.Or offshore tax haven.

 

Back to the song to remind me of the subprimers and the battle many will face when the legalloansharks have finished with them.If a change of circumstances happen many will be in serious trouble.All it takes is a small change,sickness,redundancy anything.For many that advise on here this song may give you inspiration to carry on the fight against the sharks.

Alter the words slightly,it fits anywhere.

As it says "They are selling make believe and we don't buy that here.

Especially with people like Beecroft advising the government.

Anything that exposes the legalloansharks for the predatory lenders they are is worth publicising

So if anyone can help this journalist let them know your story.

Here is what they would like to know.

 

I am researching a story for the Sunday Times on payday loans/legal loan sharks, and we'd like to expose their often exploitative methods of loaning money. We are looking specifically for people who were affected by the Natwest/RBS/Ulster Bank 'glitch' that occurred at the beginning of the week which left many people unable to withdraw any cash at all, and forced some people into payday/wonga loans. If you are one of these people and can answer some of the following questions, then please get in touch.

-Were you recently affected by the Natwest/RBS/Ulster Bank 'glitch' and were unable to access any cash at all?

-Did you turn to a legal loan shark in order to access quick/emergency cash?

-Or, did you take out a payday loan in addition to existing payday loan?

-Have you struggled to make the repayments on a payday loan?

-Have you had an exceptionally bad legal loan shark experience?

It sounds as if the legal loan sharks are trying to curtail the save bianca campaign

Ok i must admit the tune is a oldy but the words altered slightly would be a nice catchy advert for the credit unions.

Probably they would not like the words i would use.

And i do try to be unbiassed as many know.

It is just that the legal loan sharks are robbing people blind.

Lord Leitch chair of Centre for the Modern Family said: “Young people in particular face a very different kind of working life from the one that their parents and grandparents experienced.

“Affordable housing and a comfortable retirement are just two aspects that can no longer be taken for granted and as a result young people now face an increasingly uncertain future.”

 

I find this research by a payday lender hard to believe.

One in 14 applicants for high-interest payday loans are professionals in well-paid jobs such as doctors, lawyers and accountants, a study has shown.

I'm delighted to announce the Leader of the Labour Party Ed Miliband and Tom Watson, Deputy Chair of the Labour Party, will be joining us as part of their Real Change to Win tour to see how Labour activists and the Movement for Change are working with local communities to tackle problems like this and support our work on this issue.

We will also be revealing our summer campaign pack and the tools we have developed to support action on the problems the high cost credit industry is causing for our country. With mortgage companies stating they won't lend to consumers who have used payday loans because of concerns they lead to unmanageable debt, companies directly targeting payday loans at people on benefits or their continued domination on our high streets, its time that we stood up to Britain's legal loan sharks.
