    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf
    • Just to update this. I did apply to strikeout and they did not attend the hearing. I won by defualt and the hearing lasted 5 minutes (court only allocated 15). The judge simply explained that the only matter he was really considering is if the Defendant could have any oral evidence to defend the claim. However he said he had decided that based on their defence, and their misunderstanding of law, and their non attendence he did not think they had any reasonsable chance so he awarded me SJ + Costs on the claim form + the strikeout fee. Luckily when I sent the defendant the order I woke up the next day to a wire trasnfer for the full sum of the judgement

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Also, you are welcome to come to me for help, but if it entails dealing with WINE my only advice would be to get a proper computer. :p

Will be building an I7 based rig next possibly , AMD X4 965 @3.7ghz 8Gb Ram GTX460 3Tb of HDD dual boot Pardus Linux and Win 7 X64, at the moment WINE is useful for running MS apps without leaving Linux, but Wine at 12.5% vol is better:-)

I'm actually quite embarrassed to admit it but the only Wine I have ever tasted that I liked came from a can!

(it was american i think)

 

I'm a brandy drinker when I drink, which isn't often

(alcohol played a huge part in the fine I recieved back in 1999/2000)

Nice rig mate, btw: the tone of previous message was altered by the absense of a cheeky smiley.

 

Although I don't recommend installing OS's onto >1TB HDD the performance of them is always superseded by their smaller counterparts.

Infact with a rig like that I would probably stump up the money and have a go at SSD.

Pardus and Win 7 are on separate 500 Gb SATA 3 HDDs with 2 1 Tb drives for storage, I was thinking of SSDs for the OS but are abit too pricey at the minute, the money would be better spent on an X6 BE CPU for me.

 

ploddertom you are making me thirsty, a nice Chablis would nice around now, as for Westons Vintage nectar....

Perhaps you should of given more information with regards to your problem, you failed to mention in your first post that you had a medical condition, this would have got you a few more people advising on what you could of done regarding your matter.

TT had not given you wrong advice at all, just because the CAB gave you an alternative route to take and unlike us here we cannot call the bailiffs on your behalf. Why did you not go to them in the first place.

I've seen far too many nice systems stifled by people installing the OS on terabyte harddrives along with hundreds of gig's of data, it's becoming quite a trending topic in some places.

 

 

One of the better options I know of to running WINE is getting an old laptop just to run the windows app's from.

This is obviously only economically practical if you just need to run basic app's that don't need too much muscle behind them.

I would advise anyone who reads this to get *proper* advice before acting on anything posted on this forum. Im sure they don't mean any malice, but ignorance can be worse sometimes.

 

Comments such as this are not at all helpful. If you read back on MANY posts you will see that regular posters her on the bailiff section will often ask for FURTHER information so that they can provide an adequate response.

 

Your initial post indictated that you had a fine that you knew about but that the immediate problem was your concern that the bailiff could remove your parents goods from the home. Despite it being the weekend, I responded to provide a rough draft of a Statutory Declaration.

 

If you had of ALSO made us aware that you had "vulnerability" issues, then I would have told you that your circumstances would appear to be classed as "vulnerable" according to the National Standards of Enforcement Agents. From experience, if proof is provided to Marston Group (as an example) this would enable them to return the Distress Warrant back to the court.

 

It may seem strange but a lot of people will "claim" to have a "vulnerability" issue and that is why bailiff companies will ask for some sort of proof and from experience, this should be sufficient to enable them to return the Warrant back to the Court.

 

A further point is that; if bailiff companies enforcing any debt merely returned Liability Orders or Distress Warrants back to thir client they would be criticised.

What you have to understand Mr_6, is that we are not here 24/7 and cannot always give you an answer or point you in the right direction straight away. Some of us are more knowledgeable than other and what they dont know some one else will. Most of us are not legally trained but what we do have in common is that we have all been shafted one way or another with regards to bailiffs.

In this part of the forum we deal in mainly bailiff matters not court matters, although some of us do know correct procedures etc because they have gone through it themselves. The information that is given to you is advice that you can either take or ignore.

Instead of coming back in here slating the people who have given you advise, why dont you tell us what 'proper' advice you were given so others can see it has been given correctly. As much as I admire CAB they do often get it wrong themselves. Also people can learn from what advise you have been given.

Did you happen to read my first post quoted above.

As for leaving posts thats not entirely true, the OP sees the advice given then often or not will converse with others in a private mail, to my knowledge this is always backed up by another poster in here who knows that field of questioning. No one is tied to this forum and if wrong advise is given some one more knowledgeable will come in and correct it. That is often stated in the thread.

A lot of things said in here are often said in jest and it is not meant to offend, unlike you have been calling people Nazi's which I find very offensive and uncalled for.

The OP is what many people rely on in here to answer your questions and if that is missing information then you may receive an answer that may be incorrect. People kindly come in here and help and most often are working and cannot spend a heap of time going through all of the thread and rely on the poster to give full and correct information.

No point in arguing with the situation, you have made your point, hopefully you have learned from it.

the one thing i would suggest is just trying to keep on good terms on here. I love to argue and hate to be proved wrong, or disagreed with, however on here im happy to because the advice i hae been given is in valuable. Whilst i hope that i dont ever need to use these forums again once my ongoing case is finished with, no doubt i will in the near future and there is no other site like this.

 

Granted the CAB are a very good source of help and info, but they have no where near the collective knowledge you can gain on here, 24/7... If you had a problem at 9am on a sunday, this forum may help where the cab doesnt.

 

I just feel that even "wrong" advice on here should be welcomed, after all everyone is trying to help. Had you paid for the wrong advice you would have grounds to complain, but you came on here to try and get free advice which you had.

 

And personally i would be stunned if the bailiffs leave it at that, i imagine they will still want a stat dec saying nothing in that house is yours.

 

Anyway, as said previously i do hope you get this sorted, because everyone on here as a common goal which is to try and stop the bailiff and their illegal practices.

1. Drunk and Disorderly

2. A mention of riding on the pavement.

 

I think you will find that in the eyes of the law that both of these offences would be considered as wrong. And the fact that the bailiffs are now involved would also suggest you have done something else wrong.

 

Maybe in your own little world your perfect, but i think the bigger picture shows your an arguementative person with a bad attitude. Granted you will come back with some witty response, but the fact that no one else on here has jumped to your defense must show that quite possibly this is another case of you being in the wrong

Except TT confirmed he/she could tell from my OP that I already knew about the debt. (which was the cusp of dx's flawed info)

 

Also, I never claimed I was in the right to do what I did back then. anyway; a drunk & disorderly and a riding on the pavement ticket in over 10yrs...

 

I would definitely not call that often, however I do accept I was wrong to do it, and it got proven.(even though i admitted it)

 

 

FYI: the original amount i was fined was much much more than the £1000 I owe now, I have paid bits (mostly in large chunks) over the years to reduce it to wher it is today.

 

Then my health failed me and I was unable to work.. then I found out I'm not sick enough in the DWP's eyes to get benefits for it.

I can't get jobseekers without looking for a job, but if I was fit to work I would have a job and wouldn't need jobseekers!!!

 

 

 

Also, as I admitted in the previous post that I am not wrong often; that implies that I am wrong sometimes, ergo, that excludes any possibility of me being perfect.

 

 

My attitude may appear "bad" to the people on the recieving end, however I prefer to call it being precise.

Not in the slightest questioning your motives or reasons behind not working, just surprised that someone with a knowledge of I.T like you seem to have couldnt find suitable work.

Thats's a very good point mate, and in all honesty I woudl if i could, but it's so up and down for me at the minute that I couldn't even guarantee one whole day.

 

I've been looking into something that I could do myself from home but have not had any luck as of yet.

IT is a funny old game, and often, knowledge and ability is way ahead of paper qualifications, which cannot keep pace with developments add the governments acceptance of the EU imposing the employment of IT pros from Inja (the way the Major pronounced it on Fawlty Towers) and there is a shortage of jobs in the sector.

This will be my last post on this particular thread.

 

Everyone here on CAG is providing advice for FREE. In my case, [EDIT]. Therefore whatever free time any of us can give to anserwing queries is a bonus.

 

In the normal course of events, it would be ideal to read the ENTIRE thread BEFORE posting a response but frankly, in my case and many others on here as well, that would take up so much precious time. It is for this precise reason that I do not respond to threads that run to more than 2 or, at most...3 pages.

 

Thankfully, your problems has now been resolved, and there are many other people posting here on CAG who would like to be in the same position. This thread should now finish.
