I will default on 4 payday loans a week today so i have just emailed the following companies:

 

Payday UK

Payday Express

Pounds til payday

Quick Quid

 

I no its gonna be hard to get myself outta this mess but i hope the companies play a little fair!

Will keep this updated with any process made or any threats given x

a Couple of years ago, I paid quick quid and payday uk through a DMp, £20 per month. I have now finished those loans.

 

Last month I defaulted on

 

Wage day Advance £425

pounds2day £350

swift sterling £850

Lending Stream £450

Lending stream £260

 

Wda will not set up repayment plan -they are NASTY!. I paid £20 last month by standing order and I am going to continue to do so, even though they will not accept and keep ringing me, emaling me and texting asking for bank statements which I will NOT provide as I dont want them to have my bank details and there is no legal requirement.

 

Lending stream have not hassled me, just a text and one phone call where they were agrred to email me and set up a reapyment plan of £20 per month.

 

swift sterling are very relaxed and said my balance is now frozen, no more interest will be added- which I am very pleased about. They said it will be passed to a DCA, but I will just continue to pay them anyway and ignore DCA.

 

Pounds2day contacted me once by text then another company text me and asked me to contact them -which I didn't, about this loan.

 

I have set up a standing order for each payday loan of £20 per month, Swift sterling £50 a month. I am ignoring all phone calls and DCA ( none have come round -but I would still ignore) and I will continue to pay the PDL company direct until my debts are paid. Even if it gets passed to a DCA I will continue to pay my SO to the PDL company.

 

I think Quick quid will be a pain because on this forum people have said they only set up a repayment plan over three months and if you can't do that ,they won't accept , but just get their paying in details and keep paying them anyway even if they dont agree to repayment plan, just pay what you can afford, any payment is better than no payment- another stepping stone to being debt free. rememeber QQ accepted my payments of £20 on a DMP with CCCS so it is possible.

I know what you mean about getting behind with priority debts! I defaulted at the beginning of the year as my mortgage was in so much arrears. I will have the arrears paid off within the next 2 or 3 months (depending on overtime).

 

Pounds till payday will charge you £59 late payment charge and then they will pass on to Clarity DCA after about 3 months, who are extremely helpful, and you can do everything via their website, including paying off what you can afford monthly. (I offered £50 per month and they accepted straight away). So, probably best not to worry about PTP for the minute.

 

 

Payday Express will not play ball unfortunately, you will probably have to send a harrassment letter to them. Just make sure you keep sending them the emails with your offer and stick to it.

 

 

Wageday Advance accepted £50 per month from me as well and sent me their bank details. They also froze all interest/charges but charged me £36 to set it up.

 

Lending Stream have forgotten about me (wishful thinking!). Haven't heard a dicky bird in ages, but that has given me time and freed up some money to completely pay off another PDL (24/7 Moneybox).

 

Quick Quid initially would not accept a payment plan. Then they decided they would accept but would not give me their bank details and wanted my new bank details (not as green as I look so they didn't get them). Haven't heard from them in a while but reading the posts here on the forum they might pass on to Mucky Hall. We'll see!!

PTP

Contacted me via email this morning & wanted to talk to me so when they called i answered my phone. I was told they couldnt do anything til i had defaulted (so thats £59 added to the amount that i will not be paying) and that an account manager will contact me the day after default. The lady I spoke to seemed nice enough & also told me to make sure i cancelled the direct debit. I no that i should keep all communication in either email or letters but while they seem nice enough and not trying to scare me I will talk to them BUT when i feel they are trying to intimidate me I will send them an email saying why I no longer what them to contact me by phone & anything that is offered or said regarding the loan/interest/charges I will request it to be put in writing/email.

 

Payday UK

Replied to my email and said they will contact me when i default & just that it could go on my credit rating but my rating is crap anyway so no concerns there.

 

Quick Quid

No reply has of yet.

Will send the email again friday morning if still no reply.

 

Payday Express

They have replied to my email that they only accept plans under the following circumstances:

 

Severe Disability or illness

Imprisonment

Terminal illness or Mental illness

Deceased

Redundancy or Reduced hours (contractual hours reduced by company)

 

The loan is in my name but its my husband that has had overtime cut which is leaving us about £350 per month sort so i am having to use more of my wages to cover mortgage, bills etc

They also want bank statements which I am not giving because they would need a court to allow them that info.

I already feel like I have hit a brick wall :(

 

Any ideas & advice would be great x

I was exactly the same as you, decided enough was enough and defaulted last month, I had several payday loans also, this is my dealings so far:

 

QuickQuid - Accepted a 6 month repayment plan, I am still battling with them to give me their bank details, ill let it go to a DCA if they still refuse, I just email them my offer every day.

 

Payday UK - agreed to the first 3 months of my plan then they would put it up for review, I have been pushing them to agree to the full plan in writing incase they try add on any further charges later on.

 

Payday Express - had no luck with them, they also asked for the above, I refuse to give them bank statements etc. so if they will not play ball ill let it go to a DCA.

 

Wonga - agreed to my plan straight away and first payment is already on its way to them.

 

Txtloan - same as wonga :D

 

Capital Finance One - I had huge problems with them, managed to clear them off by selling junk I didnt need.

 

Minicredit - again horrible to deal with so I managed to clear them asap.

 

 

just keep going at it, I feel so much better already, the stress was really getting me down! stick to writing/emails and keep everything!! mortgage etc. comes first always! they will try the bully tactics on you but do not let them.

I have emailed QQ again & have emailed PTP to say i received the call back and that now i await a call from them on the 28th by an account manger.

Shall I email PDE to tell them that i will not be sending in my details until a court has ordered me to?

QQ have told me they do not give out their bank details to the public, but I will continue to send emails to them, it will eventually go to a DCA but they will then accept the repayment plan.

 

PTP although they are nice on the phone to you, never trust anyone from these companies, keep everything in writing or email, that way you have evidence if you need to use it against them, they are notorious for denying phone calls ever took place.

 

You can keep sending the email to Payday Express, they however won't accept a repayment plan unless they have bank statements etc (which they will use to raid your account) stick to your guns, they will not take you to court, it will go to a DCA first who you will then be able to negotiate a repayment plan with, I am in the same boat as you in regards to payday express and this is what I am going to do.

 

it seems daunting at first, I know thats how I felt but after some great advice from the people on here, I am on track to getting things sorted out, its a great feeling once you are back in control, keep at it!

I agree with cavyman, don't give them anything with your bank details on it. I am having the same problems with PDE but they will pass onto a DCA in the end. If they keep harrassing you for this info. tell them that they are not entitled to bank statements or detailed I/E unless sanctioned by a court and if they keep it up that you will report them to trading standards. Report Payday Express to the Office of Fair Trading and Trading Standards, they are out of order with their demands for information and their limited 'options'. They are not treating you fairly.

 

Keep everything in email even though people may seem nice on the phone, it is useful to have a trail should anything else happen.

 

Don't forget the alternative bank account route as well - just in case.

How do i complain to Office of Fair Trading and Trading Standards?

Tell PDE you will not provide them with any detailed information and offer them an amount you can afford. Keep any emails short and sweet, stating only the facts. They are NOT entitled to income and expenditure forms (I used to tell anyone that my income and expenditure is too variable to give an accurate picture whilst I am sorting out my finances...)

I have received one call & one email.

On the phone I got asked if someone could pay on my behalf & I replied that I shouldnt be asked to borrow from else where to pay them as its not helping with my debt (is there a act or summit I can qoute cos I want to email them regarding this) and the email just said it will be passed on to the collections team.

 

PDE

 

No emails but I did have 2 miss calls on my phone from them when I was at work so am sure they will ring back.

 

PTP

 

No calls just an email saying overdue account & that £59 default fee will be added.

 

QQ

 

No calls or emails up to yet.

 

I was expecting nothing but calls today but hey theres always tomorrow :)

PTP just called me and told me to ring the bank and cancel the DD (way ahead of you!). She then said they dont accept payment plans over three months and that after 8 weeks it would go to a DCA. She gave their bank details to make a token payment and informed me that an account manager would ring next week. I then got an email saying they confirm the arrangement to make the entrie payment by BT tomorrow! unbelievable!

Am not making any token payments at all to anyone of these companies until they agree in writing to stop charges & interest cos I might as well just throw the little money I have in the fire!

Am just waiting for the DCA then I will deal with them.

Alot of phone calls, texts & emails but I tend to only answer one call a day from them & keep sending the repayment offer every other day.

 

PDUK

Thank god for PDUK I have a plan set up for 3 months then they what review it. This company have been brill & given me there bank details. If the other 3 companies dont play ball the payments I have worked out for them will be going to PDUK so it will be paid within the 3 months.

 

So far so good & its not has hard as i thought it would be PLUS my mortgage was paid on time this month :)

Send the email to the OFT, it is against debt collecting guidelines to restrict what help they can give and when, and to continue to ask you to phone them is unnecessary, with emails you have PROOF you have contacted them and PROOF of what was said/agreed... with a phone call ZILCH.

 

Email them back stating

 

Phone conversations cannnot normally be made safely and securely and email is preferred. I can answer emails almost immediately any time anywhere I am.

 

Your email has now been forwarded to the Office of Fair Trading and Trading Standards as you clearly do not conform to the guidelines on debt collecting.

 

I am not going to a registered debt management company as many of these charge fees and I would rather deal with my few creditors myself.

 

My offer stands as xxx on xxx paid directly to your bank account using reference xxx or via Paypal. Both these ways provide clear evidence of my payment to you and the amount.

Thank you sillygirl I have just sent that email:)

 

Had a letter for PDE yesterday saying that because they have not received any communication by me that they assume that i require the loan to be deferred!

Dont they class the emails I have sent to them and the emails they have sent me has communication?

This is what I emailed to them this morning:

 

Dear Payday Express

 

I received a letter from you yesterday which is dated 27th April 2011. The letter goes on to say that because you have not received any communication by me that you assume that i require the loan to be deferred!

 

I informed you by email on the 20th April 2011 about my current financial difficulties and requested a repayment plan. Dont you class emails I have sent to you and emails that you have sent me has communication?

 

I do not wish to deferr my loan but would like to set up a repayment plan as soon as possible so I can start paying off the loan amount plus one months interest which in total is £500.

 

The repayment plan I can offered at the moment is xxxxxxx
