    • Thank you. We like to see also the exchange between you and the mechanic/garage telling about the gearbox. Also, send an email to the garage whose mechanic called you:   Get this email to them as soon as possible. Hopefully it will draw a response which will confirm what they say – but even if it doesn't draw response – as long as there is no denial then it is fine. Even if there is a denial, it won't be too important but it would certainly be nice to get a paper trail which supports what you say. Please send this off and come back here and confirm that you've done it

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have had dealings with HFO for the last few years after a Morgan Stanley debt was passed on to them. I went through all the channels of CCA etc, they threatening a charging order on our house etc and it seemed things were cut and dried for them and after lots of harrassment and bullying from them we pay £20 per month to them. We have never missed a payment since 2008. The other day I got a call from then saying that I need to up my payments as £20 is a 'drop in the ocean' and I had to pay more.... f%%ck off I told them...right then we will pursue a charging order on your property....I laughed and hung up......

 

Today I have received a notice of assignment telling me I have to pay £7626 in 14 days, and the interest rate was racking it up further by 12%

 

I rang them and told them we paid £20 per month and that was it, he told me a payment arrangement had never been agreed and I had paid what i wanted. He said I was happy to spend the money on my credit card til my hearts content and now I had to face up to it and pay the outstanding balance.

 

I told them they were nothing more than bullys as they intimidated and harrassed people (we had it first hand). I said we would vigourously challenge any action they took....He said they were not bullys and I should not put the company into disrepute and then he hung up....what should I do now please as I really do not want another battle with these people...they are a nightmare but I will do what it takes to sort them out.

First thing first, remember the golden rule,

 

DO NOT SPEAK TO THEM OVER THE PHONE

 

As you have found out, they employ........well, things? Things that can't think, and all of their letters are printed by a computer which can't think, and the letters were concocted by other people who can't think either! You will seriously get more response and sense out of a rolled up carpet, at least it has some use? Unlike this shower!

 

If they ring again, just laugh and hang up, and keep doing it, or if they are extremely puerile and persist pop the handset in a drawer for a few minutes and go off and do something far more interesting like watching paint dry.

 

They are simply willy waving, feeling the pinch and funds are running dry hence the use of uneducated unqualified threat monkey's. Join the HFO fan club.

Tracy, what was the outcome of your CCA request? what paperwork did you receive? As it is a Morgan Stanley card I assume it is early 2000?

Can you scan and post the letter they have sent you with personal details removed?

 

I repeat the words of BB - never ever speak to them on the phone unless you can record the call. They will threaten you with anything they can think of and it is normally only threats without substance.

Hi there

Check you have in writing an agreement that 20 GBP a month was OK and also check the original amount and conditions you agree to pay.

 

If these clowns want to change the rules during "the game" then you can legitimatly say "We'll let a COURT decide if payments need to be increased". From what I read on this Forum a Court would probably in most cases actually REDUCE payments.

 

Interest over the original CCA CANNOT be added by any of these disgusting low life debt buying vermin -- a debt of around 4,000 GBP believe it or not is actually *bought* by these companies for around -- don't die of horror here -- 67 PENCE yes 67 PENCE -- although this is averaged out since they buy a PARCEL of debts rather than individual ones. What I've done here is to take the MEAN of the TOTAL cost of the "portfolio" they've bought against the number of debts in it.

 

Not necessarily 100% scientifically accurate but it just shows you the "profits" these squalid businesses think they can make.

 

Check the CCA for interest charges allowable and if necessary SAR either the OC or HFO.

I feel their greed is about to be their undoing. Again. Wasn’t a £17k+++ loss last week enough for you, Uncle Alasdair? What do you think, Bart123?

 

When were you first contacted about this? 2008, as mentioned, or earlier? Who claimed to own the account then? Did you get a notice of assignment then? Dig out all your old paperwork. This is going to be fun. There’ll be (metaphorical, of course) blood on the streets on Wimbledon by the time we finish with these subnormal morons.

 

You made an offer of £20, they have accepted. I believe a contract has been formed. They won’t get that past a judge.

 

They cannot apply for a CO as they have no CCJ in place. It is bluster, and you should complain asap to the OFT. This is misleading and threatening.

Hi everyone. Thanks for your replies. I will scan the letter and upload it asap. It was 2008 that a payment plan was agreed of £20 per month but Im horrified to find I cannot find any paperwork but this deffo was agreed. I have never missed a payment since.

 

Right back in 2008 i followed advice from here and requested CCA from morgan stanley etc. I believe everything was in order on their part. I got advice from this forum at the time.

So the payment plan was started.

 

Today I have received another letter saying they are reviewing my account and they are preparing an in depth dossier on our financial situation. If I fail to get in touch then the dossier shall be forwarded to their solicitors with orders to sue us.

They state a credit search shows we have an active mortgage so they will initiated legal action to secure a charge against our home. It states that as I have made payments in the past it is unlikely that we will be able to raise a credible defence to take legal action. It says the could also enforce a court appointed bailiff to seize our assetts which will be sold at auction. They have also enclosed a picture of our house along with it valuation etc that states this was obtained from the land registry.

 

I am worried and wonder if they can do this ....and what would be my next course of action against these parasited.

Hi broken arrow. No CCJ. It was passed to their solictiors Turnbull Rutherford back in Sept 2008. They threatend a charging order then. The debt has now gone from £4379 to £7626.

Yes thats what I thought. Would they be able to go for a CCJ even though I have been making payments. Also they have sent me a Remeinder - Notice of Assignment.....does that mean anything. I havent heard a thing from these people for over 2 years and now they are back like a bad smell.

That's too small to read. Could you convert it to a pdf and upload it using the go advance button (next to quick reply). They have broken a number of collection rules in their letters, but we will deal with them later.

When you received the results from the CCA request did you post the agreement up on the forum for the CAGGERS to look at? And did you ever send a SAR request to the OC?

The letters are the normal tosh they send, I am afraid and full of untruths. I cannot believe they are using pictures of houses again, I thought that they had stopped that. Not only are they threatening and frightening you, they are abusing your personal data and you MUST make an urgent complaint to OFT details are below.You can send everything via there email link and mark for the attention of James Waldron. Make it clear you have been making payments to this **** and highlight the distress it is causing you.

Oh Im sorry but I really cant remember. I have the copy of the CCA sent from Morgan Stanley here. I had thought I had done all I can but I have had many other battles to fight and its now been 4 years as I stated the ball rollidng back in 2007.

I also do not have an original NOA just a reminder
