TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I was wondering if anybody had any advice for me...

 

I recieved a letter from these people last week with my named and addressed to me, it was asking to confirm my address, i though as you do sod it and i'll ignore it which i did. Anyway yesterday i got another one which i have not yet opened but by holding it up to a light i could see it was from the same people stating that i owed £525 for a Barclaycard i am supposed to have had... I have no recolection of ever owning a barclaycard and no idea where they got my name and address from??

 

What do i do now?

 

Please help i am very worried

Well the first letter sounds like a fishing trip and you were correct to just ignore it.

 

What these companies do is buy an account, or have one passed to them by the creditor, they then send letters like this to everyone in the area with a similar name, it is completely unlawful and you should complain to Trading Standards/Consumer Direct, because as you state, this is not your debt and they are sending you demands for something which is not yours.

You say that as far as you recall you've never had a Barclaycard, well that being the case ignore Wescot as they're more than likely looking for someone with the same name as you

Keep the letters safe and see how things transpire over the next few days

Update us if/when other letters arrive and you'll get advice on how to see these idiots off if the need arises

Had these fools on the phone this morning at half eight.Asked me my name address etc so I told them you rang me so you tell me.She came up with the data protetction jargon then said she would put it in writing to which I replied fine and put the phone down.Cant wait to see what its for as I love sending these parasites letters back :lol: and if its for a debt thats yonks old I just ignore them until they get bored . Dont worry urself over any DCA they just try what they can xx

As others have said this really is nothing to worry or be concerned about. They may carry on sending you their threatograms at a regular pace, and, putting this into perspective this is just one pre-pubescent person pushing a button on a computer at regular intervals sending thousands of these types of letters daily. It will be an automated sequence of letters, making even stronger threats, but when 'the computer' realised you are not 'falling for it' it will spit out your alleged account and forget all about you (assuming computers can think)!! Well the ones at Wetcloth has more brains than most of their staff (allegedly). If just a few recipients pay them something they are 'winning'.

 

So, onward and upward and have a great weekend.

WETCLOTHS! You can have so much fun with these fools......whatever drivel they have got their 2 year olds to put into the computer to send you, well...if you were a child and handed it in for your homework, I guarantee you would get detention for a week!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Can you scan and post what they sent you up on here for us to have a look at - remove your personal details though first before posting them up.

 

I find it strange them sending you terms and conditions just like that out of the blue. Hell, even when you CCA them your lucky to get any terms and conditions out of them at all.

 

If you wish to contact barclaycard directly heres the person and details to contact (not sure of their position or department though). Probably best emailing her and keeping a record of the email instead of spending money trying to call her.

CCA is Consumer Credit Agreement, its the agreement that you sign when taking a out a loan or credit card, and it must contain all the terms and conditions within the same 4 corners of the page.

 

Says " Your Barclaycard included" Surely they have not issued you a credit card? EDITT: Sorry misread your post there, i take they just making reference to the credit card.

 

Cant see why they needed to sent you the booklet with terms and conditions in it.

Check your Credit reference file (CRF) and see if there has been a search by Sharklaycard to open a new account, that will tell you if you have been the victim of fraud..

A bit of an update, I have just aquired my CRF and it mentiones nothing about a Barclaycard at my address nor my previous two addresses, I emailed jackie.broom@barclaycard and didnt get a very good response 'where did you get my email address from' kinda thing.

 

What do you guys think now?

Simply inform her that where you got her email from is irrelevent. As your issue takes precendent and is of a much more serious concern of that of where you got her email from.

 

What did you send in your email to her?

 

You could also say, "i might ask you the say thing as to how the bank got my personal details and believe it has the right to process my data without my permission, in order to pursue me for a credit card debt when i have never had a barclaycard credit card"

 

P.s. in my opinion, her response isn't that of a proffessional response that i would expect from a bank.

I told the woman at Sharklaycard (lol) my name and postcode and told her that i'd never owned such a card and now some debt collection company had been in touch with me, she has since replyed giving me an address to put my issue in writing to them..

 

Should I? and if so any suggestions as to what to write, I was never very good at english at school..

I don't see why you should waste your time energy and money to correct some tin pot DCA, besides it is for them to prove that you owe the debt, not for you to prove you don't, allow them to tie themselves up in knots and confuse their tiny minds, before reporting them to everyone you can think off.
