Hi all have my appeal tribunal today so any help will be very greatfully recieved. After my medical i recieved 12 points. I hurt my back in june 2009 have had physio,hydrotherapy to no avail. had a lower MRI wich was not conclusive so have finally seen consultant who ordered full spinal MRI and get these results on the 11/11/2010 so i dont know what they are going to do yet. really scared today so any help would be great xx

Hi, I had my appeal last week and got 18 points and support group, this was after scoring 0 points at the medical, all i can say is don't worry, mine lasted around 20 mins and the panel were` business like but not at all pushy, just answer the questions as best you can, mine seemed to be overwith in a flash, not as stressful as i expected and the panel tend to listen to your GP' or specialist's advice so is much fairer than the ATOS'sers.

i have to be there at 2.40pm :O i am more concerned that the hospital dont seem to know what is going on and i am no further forward than last year !! i have never had a back problem before and have always been fit healthy and worked full time so with the goverment cuts dont know what i will do if this goes pear shaped so glad yours went well and the tribunal were fair makes the nerves calm down a tad xx

Sometimes a positive result at the tribunal is not the final result; the DWP can still appeal against it.

 

I sincerely hope you win though; I have got mine (for IB) in 2 weeks time.

 

I expect to win it but, even if I do, I know I will be kicked off ESA sometime next year.

HOORAY!!!!! just as you said really helpful just the judge and a doc i was literally there for 5 minutes and he said i am giving you an extra 6 points taking you up to 18 you have won your appeal : ))))))))))))) thank you for your encouragement this morning it was despearately needed xxxxx

oh no !!!! god i hope not i do hope to get sorted at some point and go back to work but could do without all this nonsense in the meantime. I hope your outcome is positive will keep my fingers crossed for you. Why do you expect to be kicked off surely they cant do that unless you are a lot better, but saying that with all these cuts ect i guess you are probably right : (

Don't worry jacbrass you won't have the DWP appeal against your result, it's just me being negative.

 

This whole thing is ruining my life now. I look fit and well but mentally I am almost suicidal and my sciatica is bad.

 

Backache and depression equals 0 points in a WCA so I'll be signing on JSA and I can foresee losing my house with all the benefits penalties to come in the near future.

Oh my heart goes out to you xxx I know its hard but try to keep positive i hope you get the outcome you deserve and all that stress is taken away. It really is unfair that people who are genuinely ill have all this nonesense to deal with on top of everything else : ( please let me know how you get on.

it should say on the appeal papaerwork you were given. Support group means you don't have to go on any of their silly work related activeties (you get the time and peace you need) and slightly more money. I know it's not about the money but it should come in handy for christmas.

paperwork from tribunal yesterday just arrived!!! how efficient are they blimey !!still says nothing about support group ect Just says "Decision Notice - The appeal is allowed, the decision of the Secretary of State issued on 1/4/2010 is set aside,The appellant is entitled to ESA,The descriptors satisfied in Schedule 2 ESA regulations are:- In addition to the 12 points already awarded the Tribunal awards 3C-6 points making a total of 18 points, The descriptors satisfied in Schedule 3 ESA regulations are :-nil does that make any sense to anyone

Thats strange, mine says roughly the same as yours but at the end it says, "support group", perhaps Erica will advise what to do next?

Mine def says "support group". might be because of my specific mental health issues that i got the support group? dunno, be interested to find out though.

You're right, dj. Someone posted a link to a review of the system, I think it was. I forget all the acronyms, but the original aim was to assess people's health and then at the same time, their ability to do any work. Because of the backlogs that started building up, from memory, they decided to split the assessment process for a lot of people.

 

Hopefully Erika or someone else will remember all the letters that apply to the various assessments.
