    • I did call the police both in the UK and in my country but both of them said no way to get the money back now. I tried my best not panic but it indeed influenced my life in many ways, the only thing I could do is start therapies. It happened around February- March, so I started to do this shoplifting thing to cover my rent and everything from the end of March, it’s been a month now… today it my first time to get caught. I know it’s very very bad, I seriously didn’t want to do this at all. But luckily I just saw an message from HR, they asked me to have an online interview next week. I’ll stop this behaviour and wish my messed up life back to normal soon 
    • did you contact your bank about the fraud? contact the police , action fraud anyone in authority? have you done anything about it? when did it happen? dx

    • Thank you, I was been told that it’s a serious crime if I shoplifted above £200, (this time £500, I gave the thing back+ last time probably also around £500 which I didn’t give back).. and I admitted to them that I sold those things at very low price to pay for food and stuff.   That’s why I was worried..as it wasn’t my first time.. I also did it in John Lewis in the city I live, but when they asked me I said I didn’t steal things from it as I don’t wanna get caught in my city. But I don’t know when they upload my pics in the system will they recognise me and think of me a professional shoplifter than against me… so what happened about the fraud was that what there was a phone call told me that my visa has problems etc due to I helped bad people do money laundering etc. I said I didn’t then they tried to ‘control’ me and many things happened to make me believe what they said… as soon as I gave them the bank details I lost all the money in it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Vt amount is about £150 now, rang the Crawley branch (to see if they were still around) yesterday, so will be handing the letter over with a cheque to bring me up to the magic number as well as faxing and send a copy to HO, then they can't say they haven't received it!!!

Hi, finally paid the magic amount to VT the car, does anyone have the best address and fax number for Welcome a email address would be handy as well.

I want to send the letter recorded (of course), fax over, email and drop a copy into the local branch so they cannot say they have not received it.

Hi, just to let you all now that the car was collected last month. Welcome have rung a couple of times asking for the £200 shortfall but after I told them to check their records they have seen that I had paid the £200 and they get off the phone pretty sharpish.

Hi, still having a little problem with Welcome. They have rung 4 times now wanting £205 but as soon as I tell them about the missing deposit of £200 they see that this hasn't been taken off and they say they will look into it and close they account. I have now had a final statement which still says that I owe £205.

As this amount is wrong and they are chasing a debt that doesn't exist what will be the best course of action?

Yet another phone call - this time from the 'High Risk Department' (ohh i'm scared). After letting him have he say threatening hell and dam fire I calmly explained what has happened and asked if Welcome normally go against the FOS adjudications? Which he didn't like and asked me to prove this to him and nothing was on his screen, again he didn't like it when I said he should get a better screen.

 

So I have copied all the letters from the FOS and Welcome agreeing to the adjudication and highlighted the important parts in nice colours for him (I hope he likes it) with a nice covering letter explaining that they were now harassing me and had breached quite a few OFT guide lines regarding Debt Collections and that I would also like copies of all the transcripts since the car was sent back . I have also sent copies to Welcome Compliance, FOS and the OFT for good measure.

 

We will see what me makes of that.

I have had the final response from Welcome -

 

They agree that they should of taken off the £200 deposit but they are saying that I owe them £5.65 which must be paid straight away.

 

With this in mind I had paid £100 over what the FOS said I had to pay to VT the car. I also have a letter from Welcome Finance agreeing to the FOS adjudication

 

This is getting silly and I won't pay this on principle and I am going to write them one letter and put in an invoice for my time and postage and see what they come back with.

Please confirm receipt of this request by telephone/fax to me/us on (your telephone number or fax number).

They may try and charge you a collection fee which I have been advised that is against the consumer credit act.

 

Just make sure that you letters are sent recorded as Welcome have a habit of mislaying letters.

 

The car must have an MOT, not sure about the tax, I left mine on as it had less than a month left. It has to be road worthy and all the tyres must have tread on them.

Hi,

 

I had a couple of cars through Welcome around 2008 and 2010.

In the end I did VT the last one.

 

At the moment I think I got rid of all the paperwork, am I too late now to see if there was any extra insurances included?

 

If I can't find any details how would I prove who I am to them as moved house since my last dealings with them.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
