After my first post I have decided to go for the claim on my own. I have no paper work (from egg) and I am now a bit concerned that the PPI was added before 2001. If this is the case can i still make a claim? The reason for my claim is many fold, I had a condition at that time where i was taking Prozak, I was self employed and I was told I had to have PPI. Your help is gratefully recieved

Thanks px, i telephoned one of the claims comany's and they said that if the ppi was added before 2001 i would not have a claim.

I am a bit worried but going to go for it. Iam as close to the end of a rope as my tether. I think i paid about £4k and I am really struggling

Thanks dx, it seems that claiming from egg has been easier since their big fine sometime ago. I will write for the access request today, sadly I haven't got a cheque book, hopefully i can pay on my debit card?

Thanks, one or two last things, i have downloaded a letter template for the SAR. Should I ask for everything or should i only request the payments made for PPI? Is there a preffered letter template? there seems to be a few around.

see previous post in this thread line. I asked the same as I was told by one of the 25% comany's that I wouldn't have a claim if my ppi was added before 2004. 'dx' tells me there is no timescale.

Are we talking about a claim for mis-selling or a claim on the insurance ?

Just to confirm what dx stated - its six years from thedate you became aware of misselling.

 

If its a loan ppi, Egg pay out quite quickly (I only stated my self employment), if its a card then they tend to dig their heels in a bit more.

 

Even tho' they paid out on a loan account very quickly when I started a claim against an Eggy card they refused point blank.

 

I had to go to the FOS, who upheld my complaint and told egg to cough up, this is where you need to be aware of Egg tactics.

 

1) They only paid out premiums + 8% simple interest and stated that they cannot refund more than six years (my card opened 2001 & closed 2006 - they calculated back six years from March 2010).

 

2) After reminding them of the Limitations Act (as dx quoted) they very quickly refunded the balance of the premiums only & apologised stating they misunderstood the FOS directive.

 

3) Blatantly refusing to refund the contract compound interest (about £1,500) stating that I signed the FOS acceptance form for what they refunded, total rubbish! you have to sign the FOS acceptance form before the FOS instruct the bank/credit to cough up.

 

Where am I at the moment - Stalemate, complaint back with the FOS regarding interest - case handler cant believe EGG refuse to refund the interest, I have to supply FOS with all statements so they can doublr check my figures :? If necessary it WILL go to court.

To be honest I am in fanancial difficulty and although I want everything I am entitled to just the payments back for now would help 10 fold. I had aquick calc last night and believe its about £6.5k for payments without interest. As you know egg do not supply paper statements unless requested while the account is active. They expect you to use the internet. I need to get the SAR off today. How long do you think it could take without the bun fight regarding interest. Or is that like asking a china mans height?

They rejected my claim against an eggy card very quickly, I think it was within 10 days & stated it was their final response so I went straight to the FOS, from there it only took about three months - however as I stated earlier they point blank refuse to refund compound interest.

 

If they offer you anything you can always inform them that you accept it in 'Part Settlement', but wait for their cheque to clear before telling them that. ;)

Thanks. The template you attached is the one that I am using already. So just to confrm that i do not need to mention Mis Sold PPI at this stage? This template only states disproportionate penalties and charges and my need for the SAR is to calcualte my payment total in PPI
