i wonder if anyone could give me advice. i have a business next to a university car park which for two years was free to park. they then made it permit holder pay and display. when this was introduced i paid for tickets but recieved a CIVIL PENALTY NOTICE. i spoke to person in charge of estates to enquire about a permit as i give all staff and students 10% discount and also supply the university but was refused. there is a real lack of parking spaces in the area due to students leaving there cars but i need my car for work so i would leave it in the car park which would often be empty but still recieve tickets, sometimes two in one day. anyway i have amassed £1400in fines and having ignored all threatening letters etc i am now being taken to the small claims court. do you think i should pay or go to court. i would greatly appreciate any advice. thanks:confused:

this is not a fine its a [problem] invoice

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This will be more difficult to defend than the standard private invoices.

 

By continually parking there it will weaken your case as opposed to a one off ticket.

 

First thing is to get pics of all signs and post up the paperwork on the tickets sans personal details.

Applying for a permit wont have helped either your only defence really is that the charges are punitive rather than a reallistic claim.

it is not a [problem] invoice ive actually got a summons for court!

 

 

I realise that, now you need to build a defence that is weakened by the fact you knew it was "wrong" to park there.

 

So looking for illegalities in the tickets received would be my first step, eg use of the word penalty etc.

 

You will need to attempt to discredit the parking company at every turn, whilst they will show you continued to park there time and time again despite knowing the "consequences".
