    • Hi dx, the only secured debt we have is the mortgage on our property and that is a joint mortgage.  all payments are up to date with a clean credit file albeit with a of debt so no missed payments etc sorry what is f&fs? If I am made redundant I am not wasting it on paying all this unsecured debt down and leaving my family broke. This is the dilemma I am currently in. i am not sure I can mentally keep living the way I am I am weighing up how to deal with it without leading to needless ccj threats etc… not sure what direction I am to go in. Hi uncle, okay but 3-6 years of a bank owning my debt means our files are destroyed for longer than 10 years based on that ? Not sure this works out for us that way? Unless I am misunderstanding you
    • How are you funding the privately run supported living housing in the new city ?  Why are you moving? Have you served in armed forces previously? If you are registered with the existing Council as disabled or have other needs they assist with, then depending on the reasons for needing to move, your current Council may help with costs of moving. But you would have to submit an application to them. So you are best to speak to your current council about the help you are seeking.  It is not about a Council being responsible as I don't think there are specific laws saying a Council has to help with costs of transportation. And in regard to Housing costs in new city, as this is going to be private, I don't think the Council will pay under Housing Benefits. You might have to claim Universal Credit, but UC might not cover the full cost as Housing is limited to Local Housing Allowance. Citizens Advice are generally worth contacting about complex Housing issues.

I’ve not seen any threads with this situation before?  they know from my letter I’m not working atm and  have no assets etc

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Benefits rules are complex, and although I do try to inform and support people, I may get it wrong because the rules apply to individual claimants and their particular circumstances.

I am one of the few thousands this report also talks about in that:

 

I went straight onto I.B and bypassed any medical because my condition deemed it i.e SAH STROKE.

 

I will shortly have to transfer to ESA by October at the latest and to be honest it is scarring the hell out of me.

 

Maybe I should of just died on that operating table and be done with it because that's how all this is making me feel.

 

At least then I will not be another scrounging statistic.

Thanks for your kind words, I have no intention of ending it because I'm the son of a Royal Marine so have been brought up to fight every obstacle that life throws at me.

 

But these draconian measures do pull people to the limit at a time when they need all the support they can get.

 

Indeed this great British Government is doing more harm that good and hey I'm in that queue to fight.

Yay PF, dont give up hope! If people think your a scrounger tell them to stfu as they know nothing!

 

A little bit about me:

 

When I was 7-8 years old, I used to help out at a local produce shop at the weekends and school holidays, till I was about 10 and then I started bording school.

 

When I was 16 I went to college and got kicked out (typical lol), but I then found a job.

 

After that job finished I worked at a fish and chip resturant in my town, after a couple of months i got sacked (if you wanna know just ask).

 

Then I worked for 6 months at a factory maing plastic stuff (I was still only 17 at this time) and I was working till gone 3am and other long shifts.

 

Then I worked at a take-away for about 18 months, then I worked in a supermarket for about 2 years, I quit that job coz of the stress and lack of promotion.

 

I started working at a local corner shop and 3 weeks into that I ended up with a stomach problem for about 2 years :s

 

after that I spent about 6 months looking for a job only to be smacked by a virus and more medical problems.... for 1 year.

 

6 month of job seeking I end up working at mcdonalds (yay me :s), then about 1 year in my back went....

 

In all that time I have paid taxes, NI, and other stuff.

 

So my question is now is, why wont the state look after me properly now?

 

Jeez I'm only 27 and every time I have had to be on benefits, when I was ill I got screwed over by ATOS and their medicals, but this time I'm gonna dig my heels in.

 

I'm due to start up a new ESA claim next week.

 

Wonder how things will go this time....

I'm so glad about the manner in which it was broadcast. Showed the truth of the matter, rather than dressing it up.

 

For anyone who is interested, I've found a news story of the man that Danny Alexander mentioned in his constituency that was an amputee, and they failed to note in the assessment that he only had one leg.

A lot of people in Scotland are not happy with Danny Alexander at the moment, for going against the grain but I sincerely hope he keeps his word in continuing to take forward the issues raised by ESA.

 

He was spokesman for disability up until 2007, (I'm sure it was for two years) so he has some parlimentary experience in this area.

 

On a nicer note, his wife gave birth to their second daughter on 23rd May! Named her Isla

Can't help out with a nit comb as they all jumped ship when i went bald:) but i can support what you good people are trying to do here and a fine job your doing so far, i'm pretty glad i am among likeminded people with similar problems without being casted out as a sponger,for that i thank you all.
