    • I disagree with the charge and also the statements sent. Firstly I have not received any correspondence from DVLA especially a statutory notice dated 2/5/2024 or a notice 16/5/2024 voiding my licence if I had I would have responded within this timeframe. The only letter received was the single justice procedure notice dated the 29.5.2024 this was received on 4.6.2024. I also disagree with the statement that tax was dishonoured through invalid indemnity claim. I disagree that the licence be voided I purchased the vehicle in Jan 2024 from RDA car sales Pontefract with agreement to collect the car on the 28.1.2024. The garage taxed the vehicle on the 25.1.24 for eleven payments on direct debit  using my debit card on my behalf. £62.18 was the initial payment on 8.2.24  and £31 per month thereafter the second payment was 1.3.24.This would run from Jan 24 to Dec 24 and a total of £372.75, therefore the car was clearly taxed before  I took the car away After checking one of my vehicle apps  I could see the vehicle was showing as untaxed it later transpired that DVLA had cancelled my tax , without reason and I did not receive any correspondence from DVLA to state why it was cancelled or when. The original payment of £62.18 had gone through and verified by my bank Lloyds so this payment was not declined. I then set up the direct debit again straight away at my local post office branch on 15.2.2024 the first payment was £31 on 1.3.2024 and subsequent payments up to Feb 2025 with a total of £372.75 which was the same total as the original DD that was set up in Jan, Therefore I claimed the £62.18 back from my bank as an indemnity claim as this payment was from the original cancelled tax from DVLA and had been cancelled . I have checked my bank account at Lloyds and every payment since Jan 24  up to date has been taken with none rejected as follows: 8.2.24 - £62.15 1.3.24 - £31.09 2.4.24 - £31.06 1.5.24 - £31.06 3.6.23-£31.06 I have paper copies of the original DD set up conformation plus a breakdown of payments per month , and a paper copy of the second DD setup with breakdown of payments plus a receipt from the post office.I can also provide bank statements showing each payment to DVLA I also ask that my licence be reinstated due to the above

    • I've completed a draft copy to defend and will post up here for review.  Looking over the dates and payments this all stemmed from DVLA cancelling in Feb , whereby I set up a new DD in Feb hence the overlap, why they cancelled when I paid originally in Jan I have no idea. Anyway now stuck with pending court action and a suspended licence . I am also firing off a letter to DVLa recorded disputing the licence revoke

I know all my DVLA details are good. I recently (last year) renewed my license, and my car's V5 is current with the correct details; the same is valid for my partner. I'll continue to ignore the love letters 😂 and won't let it bother either me or my partner.  I'll revisit this post if/when I get a letter of claim.  F**k ém.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ive got a claim with Southend CC, I havent gheard about a case management hearing but wouldnt be surprised to get notice of one though.

Thanks Karnevil, I will let everybody know how I get on, I have got my bundle together so hopefully the judge and Abbey will know I am serious :)

 

The court bundle is also going to be sent off this week for Barclays :) although I did try and phone Alex Martin to see if he would settle, but apparently he has left and a Antony Lombardy is now in charge, so I am going to phone him tomorrow.

Yeah, I started this claim way back in March and Southend court has apparently been getting case after case, I had mine put in 'Boxwork' for ages so I spoke to the clerk who said they would be having a mass hearing which I guess is Wednesday. Why it's only an allocation hearing puzzles me, unless the judge is waiting to see if Abbey bother to turn up for that?

Well it looks like we will find out on Wednesday ;) they obviously must have quite a few cases??? My original case was with Colchester and it has got transferred to Southend but another case of mine (Barclays) is being heard (in full) in Colchester?? and hasn't been transferred to Southend which I find very odd??

I am not sure whether Abbey can actually request that??? perhaps one of the mods can clarify, I personally think that Southend CC have just had an influx of cases ;) If we get court dates I am going to send off my bundle to the courts and Abbey ASAP ;)

Just reading a post regards allocation hearings it seems that you have to give a summary of your case and any points you wish the defence to clarify along with any information or witnesses you may wish to call, whether this will be done en mass or individually I don't know it seems a waste of time doing it individually as we all have the same or simillar points. Should be interesting!! See you there.:D

Just checked my Email got a suprise comm from Abbey as follows;

Abbey have now taken back the handling of your claim from DLA Piper, and we note that your matter is scheduled for case management conference on Wednesday. I would therefore be grateful if you would call me at your earliest convenience to discuss proceedings.

Has anyone else had a similar experience, if so what can I expect. If they agree to a full settlement out of court what do I need to get in order that they do not go back on their agreement?? Full payment by BACS before end of trading Tuesday??

Also if DLA Piper haven't requested permission of the court to withdraw their legal representation they could be in the doo doo.

 

So on the strengh of that alone you are in a good position to demand full settlement as it's doubtfull they'll want to attend court only to face the wrath of the judge

Hi Tiggs,

Rang the Abbey and yes they agreed to settle in full and have sent a letter to me and the court confirming this (Haven't received it yet) sent me a copy via Email. Apparently lost my telephone numbers in the transition from DLA to Abbey. Asked me to ring court postponing the Case Management Hearing until I receive cleared funds then write withdrawing the action.

Hope you received the same, seems they don't want a day trip to Southend after all !!

Don't do ANYTHING until you have received cleared funds & let them write to the court saying they intend to settle.

 

There a bank for gawds sake how easy is it to TT the money to an account of your choosing.

 

I have noticed on other threads banks have promised to pay members but they are still waiting

Thanks Karnevil, strange I am really looking forward to the hearing, it will be interesting to experience it, and after the BBC programe last night I have even more fuel to my fire. Also something that occurred to me this morning about the "new defence that the banks are now using - the term "service charge" rather than "penalty charge" which might help future claims, but I will post up about this later.

 

Right I am off to pick out a nice smart outfit to go to the court in ;) hey a girl has to dress for the occasion!!! lol

Thanks, I have printed off the "going to court" leaflet and I am going to read it, although this is only a case hearing I am going to be well prepared ;)

 

Giving myself loads of time to get there, (2 hours) (should only take about 45 mins) so I will park up, and go and have a coffee and then get myself to the court so I am about 30 mins early :)

well well well.... that was certainly interesting.

 

Got to the court at 9.30, got myself seated in the waiting area and had a look at the other cases being heard, there was 5 case management hearings against the banks, 2 Abbey 2 Barclays and one other (I think it was the Halifax)

 

I was the only one sitting in the waiting area at this point, and then it slowly started to fill up. One man asked me if I was from the Abbey :o I said "no but I am claiming agains the Abbey" it seems that his case was an insolvency brought by Abbey :(

 

I was called at about 10.30 to see Judge Dudley, and there was only two other people waiting for their hearings, as I entered the room I noticed that there was only him and me in the room, no sign of Abbey :rolleyes:

 

He said hello and asked me to take a seat. He said that he had received a letter (by fax) from the Abbey dated 11th December stating that they were doing to settle my claim in full and that they are not intending to defend the claim (he did say “no surprise there” :eek: ) I said that I had not received that letter but that when I left this morning it was before the post had been delivered and perhaps it was waiting for me on my return. He said he would adjourn the case for one month, and that I was to write and let him know when Abbey had PAID the money into my account, he said he wanted to make sure they paid within the month, he would not be satisfied with their intention to pay. I thanked him for his help and time and left the room.

 

From what he said to me he wasn’t very happy that obviously Abbey had left it to the last minute to let him and me know that they had settled. He was utterly charming and helpful and I would strongly urge anybody who is worried about meeting a judge not to be, I could tell that this Judge was definately on our side.

 

I am happy that they have said that they are going to settle, pleased I went to the Court to see what it was all about and to meet the Judge (I could have kissed him when he told me that they weren’t going to defend – but I didn’t think kissing a judge would be very appropriate!!! :D ) but also quite disappointed that I wont be the one that perhaps will take these claims any further now.

 

When I got home there was no letter from the Abbey.:-D

Hi Jax, I am sure they will settle or tell the courts that they have settled before then. Don't worry about going to Court everybody was really nice. I am 100% sure out of the 5 cases I was the only one who turned up so I am sure that they have said they would settle the other ones, the Judge did say to me that he had received a lot of faxes from the banks saying they are settling the claims ;)
