  1. Well done Tiggs Great to know that they are p***ing the courts off, it can only work in our favour. I think the same person who sends the Abbey statements & letters out has sent our settlement letters out cos I've still not received mine yet!! The BS they gave me as to why they can't transfer funds immediately was that the company that settles the claims is seperate from Abbey Maybe they are insured against this?
  2. Well I rang Abbey they offered full settlement asked me to ring court to postpone the Management hearing and write withdrawing the claim once I receive the money, which should be in a few days:D I'll let you know what happens next.
  3. Hi Tiggs, Rang the Abbey and yes they agreed to settle in full and have sent a letter to me and the court confirming this (Haven't received it yet) sent me a copy via Email. Apparently lost my telephone numbers in the transition from DLA to Abbey. Asked me to ring court postponing the Case Management Hearing until I receive cleared funds then write withdrawing the action. Hope you received the same, seems they don't want a day trip to Southend after all !! Good luck

Just checked my Email got a suprise comm from Abbey as follows; Abbey have now taken back the handling of your claim from DLA Piper, and we note that your matter is scheduled for case management conference on Wednesday. I would therefore be grateful if you would call me at your earliest convenience to discuss proceedings. James Arrandale Has anyone else had a similar experience, if so what can I expect. If they agree to a full settlement out of court what do I need to get in order that they do not go back on their agreement?? Full payment by BACS before end of trading Tuesday??

Just reading a post regards allocation hearings it seems that you have to give a summary of your case and any points you wish the defence to clarify along with any information or witnesses you may wish to call, whether this will be done en mass or individually I don't know it seems a waste of time doing it individually as we all have the same or simillar points. Should be interesting!! See you there.
  7. Does seem strange maybe it's just the volume of Abbey claims either that or Abbey have requested them all to be dealt with together.

Yeah, I started this claim way back in March and Southend court has apparently been getting case after case, I had mine put in 'Boxwork' for ages so I spoke to the clerk who said they would be having a mass hearing which I guess is Wednesday. Why it's only an allocation hearing puzzles me, unless the judge is waiting to see if Abbey bother to turn up for that?
  9. Hi Tiggs, I guess your Allocation Hearing is 10am the same as mine, I see from your post you're taking the whole of your case prep. is this necessary or are you doing it just to be safe? Petch
  10. Ok I have a Court Allocation/Case Management Conference in 2 days time!! Do I need to take my whole case preperation or is this just another cog in the really slow judicial process? It also says in the footnote, this case may be released to another judge, possibly at a different court. Does this mean they are likely to request to move the case to somewhere really inconvenient, if they do can I challenge it?
  11. Sorry I haven't posted for a while been busy earning the £2500 to cover my overdraft the Abbey refused to renew!! Only things that have happened so for is the claim that was stayed in boxwork didn't get looked at by the judge so was stayed for another month. Also as I'm sure you Know Abbey have now decided to stop wasting money and are defending their own claims. As and when Judge Dudley @ Southend County Court decides to bother to look at my claim I'll let you Know the outcome. I suspect Abbey are just waiting until he sets a court date, still the interest is growing!!
  12. Thanks for that, I guess I'll wait and see what happens. Any news on the split claims front, has anyone gone down this path and was the second claim dealt with the same as the first?
  13. So does this mean I do not have to attend court or does it mean I have to attend and sit around all day to see if the judge can fit me in??? Sorry just found my pc is playing up if I dont refresh every page I visit it doesn't refresh.
