Can someone please help us?

My husband bought a car from a dealer approx 6mths ago which we paid by cheque (no finance). We have now sold the car through an auction and when my husband went to collect the cheque (7 days after the auction) he has been told that the car had outstanding finance on it and that he needs to speak to a girl in accounts tomorrow to find out all the details but we never had any finance out on this car and its the first time the auction have made us aware of any finance on the car. The auction have already gave the car to the new purchaser. Have we any rights as this is the first time we have been made aware of any outstanding finance on the car?

Getting very worried as we really needed the money.

Someone please help us?

Until you know what the problem is, there's little to be done. It my be something simple like an incorrect flag of the vehicle. Where do you live...? As Scottish purchasers have good title in the situation you describe, but if E&W you may have to take it up with the dealer to see what the issue is.

If the car had outstanding finance then the auction should not of sold it and by doing so become as responsible as yourselves. Obviously the dealer you bought it from will be the key in all this but as it stands the car wasn't yours to sell in the first place even though you paid cash for it. The same applies with the auction house and the new buyer. You need to get in touch with the dealer who sold it to you and see what they have to say. I assume you have a sales invoice from the seller? I hope so, because you may need it as evidence.
