Hi am new to this site and unsure if posting in the right place . could really do some advice . Been with littlewoods cat for about 5 - 6 years , never had any problems with them before , was allways able to pay. now all the buy in nows and christmas presents have just creeped up on me , this months statement is nearly £200 , in total i owe 2,800 . At first i was £50 short now i got the council tax on my back so need to pay them . what would be the best way to deal with this , pay what i can and get charged for not paying the minum , and still have the same problem next month or call them and offer them £50 a month till i clear this debt , do you think they would take is offer ? would they charge interest . i dont want debt collectors calling round , would they do that even i offer them £50. please any advice thank you

hiya and welcome to cag,

here is a list of template letters:

http://www.consumeractiongroup.co.uk/forum/general-debt-issues/20758-creditors-dcas-letter-templates.html

using one to offer them what you can afford each month and asking to freeze interest would be best

nope

i would never talk on the phone to them.

even if a dca came around, whichthey wont, there is nothing they can do, they are not bailiffs and have no legal powers.

TELL littlewoods they will only be getting £xx for xx mts as a goodwill gesture, then do it by internet banking without fail.

i would also include a line like 'could you please refrain from adding unlawful charges duringthis period & freeze the interest as a goodwill gesture from their side'.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Make sure all your priority debts are paid first

Rent/Morgage/Fuel/Council Tax/Taxes/VAT/Insurance.

and leave yourself sufficient for food and emergencies before offering Littlewoods anything, if all you have leaft is £1, then thats all they get.

Don't bother telephoning them, they will not be interested in your situation, all they want is your money.

They will probably not accept your offer or freeze the interest and charges, but that is standard practice with Shop Ditect Financial Services.

If you haven't got it. you can't pay them.

There argument will be if you couldn't afford the repayments you shouldn't have ordered the goods.

Do everything in writing, never ever phone them. I f they phone you, refuse to answer their security questions and tell them everything in writing please and put the phone down.

Don't let them bully and intimidate you into paying what you can't afford.

I would also consider sending a CCA request to them to see if they have an actual signed agreement. If they haven't you are in a much better position with regards to a payment plan

Personally I would send your payment with your offer, it is best to make some form of payment at this early stage.

Things might change depending on their response to you offer an also to the documents they provide via the CCA request.

If it even did go to court, it can then be shown you made every effort to come to an amicable arrangement but Littlewoods declined to accept.
