Can the bank refuse to give me a new debit card?

Currently trying to get myself out of a hole with 2 payday loan companies.

 

One was straightforward and have managed to make sure they have no access to my bank account and am trying to sort out a repayment plan.

 

Ther other however is with the money shop...who are holding 3 cheques (no guarantee card) and have my debit card details. I have been in contact with them to try and arrange a manageable repayment plan but no avail. They insist I either pay the extension/rollover fee or they will bank the cheques. If the cheques bounce.....(which they will) I will get bank charges for the pleasure....as well as a £25 charge per cheque from the money shop itself.

 

I have managed to put a stop on the cheques through my bank (i had to stop the whole chequebook) so at least I will no longer incur charges from the bank for these. However i know from bitter past experience with the money shop that they will keep trying to obtain as much money as they can using my debit card details. I have wages and tax credits being paid into this account which I can't afford them to get to before I do. I do have another account and have informed my employer and tax credits to change my payments over but this is unlikely to happen before this weeks payments go in.

 

I explained all this to the bank (barclays) and they refuse to send me a new debit card...with a new number etc unless mine is stolen, lost, or damaged. I know with hindsight I should have just reported it lost in the first place but I thought I would try sort it out whilst on the phone about the cheques.

 

I've now spoken to 3 different advisers and the complaints department and they are refusing to budge. I asked if i could report my card as lost if thats what it takes for them to issue me a new one and was informed that they record all their calls and would know that I hadn't really lost the card and would still refuse to issue a new one.

 

Everyone I have spoken to has basically said 'you gave the company (money shop) your card details so you need to sort it out with them'

 

I don't know where else to go with this and if anyone has any advice it would be very much appreciated

I have no idea if this would work, but it might be worth a try.

 

Write a letter to the bank instructing them that in no circumstances are they to pay any money from your account to money shop since they are using your card details when you have withdrawn your permission for them to do so. Hand deliver the letter to your bank, insist that it is read immediately and insist that you are given a receipt. It might help (to get the receipt at least) if you chose your moment - i.e. when there's an awful lot of people in the queue.

thanks for the reply madwoman.

 

I will certainly give it a go although I am not optomistic. I did ask the 4 people I've already spoken to if there is any way of stopping payments that I have not authorised and was informed that giving my card details to someone is giving them authorisation to use those details.

 

Does that mean that every company i've ever used the card to pay for anything for has the authority to take a payment whenever they like?????

Hi Fairclair

 

You could try going in to a branch and cancel at the customer service desk and hope they don't cross refer. If questioned (about prev calls) say that your details have been compromised via the internet as well as the moneyshop, if they don't cancel you will hold them responsible for any payments made.

 

Failing that you may need to switch banks. Good luck

thanks for all the advice everyone.

 

I've managed to move all my wages and other payments to my other bank account now so there is no money being paid into this one at all anymore. so anyone that tries to take a payment by whatever means will be disappointed!!

 

All I have to do now is try and deal with the money shop which isn't proving easy. They have called my home and mobile and even work repeatedly over the last 2 days despite a very understanding colleague telling them that no-one called fairclaire works there.

 

Harassment/contact in writing only letter and offer of reduced payment is now on the way to them

well done.

 

you could have charged back the payment however i did this and i was sent a copy of the T&C's i signed with 1monthloan and it stated that they can collect payments upto the total amount due from any card details i supply them... not sure what else i can do to ge tthe £450++ back that they took for a £100 loan

Have sadly realised there is no way round this....and it's left me in a mess.

 

Barclays, who wouldn't give me a new debit card......had a £750 O/D on that account but kept them off my back by having my tax credits and ch benifit paid in there....wages go into other account.

 

To stop any payments from payday company coming out I had to change tax credits and ch benefit to my other account now I expect barclays will start chasing me for the £750 overdraft!

 

If they would have given me a new debit card then I would have done as I have been doing....leaving £50 month in to slowly pay off the O/D. everyone would have been happy and got paid in the end

 

...but no. in true banking fashion they were awkward and stubborn and now will spend more in sending me letters than I earn and my think they will make my life a misery. only consolation is.....someone else got there before them!:confused:
