    • Thank goodness it's not your roof and you get to foot the bill! How big are these bits of mortar? How often are they falling into your garden? Hourly, daily? Just go ahead with your plans, of course, they're not going to be worried by your time pressures and the urgency of the situation, so simply carry on as you would have done and I'm sure everything will go fine. Unless there is a danger to life and serious structural issues which mean you cannot venture into your garden, then IMHO there is little more you can do less for what you have done so already and made them aware of the issue.
    • Hi all!   Thank you in advance for any help you can give me!!    I parked up (at 18:08) in a rush, entered my Reg and paid for an hour of parking. At 18:20 I got a ticket for not paying for parking.    I've just looked at my receipt and noticed why ... I put "22" instead of "21"  when i put in my Reg. yes... what a stupid mistake.    I seem to remember there being a court case or a rule change about entering the wrong reg but the company wasn't at a loss because i had paid for the parking just technically for the wrong car. Am i making that up?    Any advice would be gratefully received, even some key points i have to hit when doing the appeal      
    • You haven't returned to the thread to give us your views, but a couple of other things strike me which you should consider: 1. You say that at no time was your father's licence revoked by the DVLA. It didn't have to be revoked. It expired in September and his "entitlement to drive" (of which the licence provides proof) expired along with it. He could only continue driving whilst his application was being processed by virtue of s88, and it seems clear to me (based on what you have said) that he was not able to take advantage of the benefits provided by that section. 2. The letter he received threatening to revoke his licence was probably a template letter sent when any medical issues are brought to the attention of the DVLA. But it is clear that beyond September until it was eventually renewed, your father had no valid licence to be revoked. I believe a "not guilty" plea in court will fail. The basic facts are that your father's licence expired in September, it was not renewed until February because the DVLA were looking into his medical declaration and he could not take advantage of s88. So in December he had no licence and no entitlement to drive under s88. The facts that he believed he was fit to drive and that his licence was eventually renewed may mitigate the offence but they do not provide a defence. I also asked whether he had received a summons (very unusual these days) or whether he had received a "Single Justice Procedure Notice". The way to proceed from here differs slightly depending on what he has received so if you let me know, I'll advise further.  
    • Well, what I've read from various sources suggest if a CCJ is 6 years old that if becomes pretty much ineffective for enforcement purposes in its original form.  And that if it's about to expire then the claimant needs to apply to the court to extend the original CCJ within the final year.  Even if they do apply for an extension within the 6 years they have to have a very strong argument for doing so such as the person being out of the country or could not be traced, basically show they were actively still perusing the debt I guess. Now if a claimant ever does apply within the 6 years to extend the CCJ, would the person named on if be notified by the court that such an application has been made?.  In my case I've heard nothing from the court so assume no such application has been made.  The original CCJ in my own case is now a year beyond the 6 years of issue so must now make things even less likely again. So whilst the CCJ exists that they have not enforced it in that time must surely make it unlikely they can now take it back to court because as said it would be very rare for a judge to agree to such action now. That said, I guess they now can't use the CCJ to continue with any action for an attachment order to our mortgage either?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Take your claim amount, excluding interest, multiply it by 0.00022 - that is your daily rate of interest. That means you charge that amount for each day between issuing your claim and receiving settlement.

Sorry to butt in, but this may also help me and others (that are thick as two short planks like me)...

barracad...what your saying is that:

If a claim was for £2000 (excluding interest) and you claimed 0.00022 per day interest, would the charges for interest be 0.44 (44 pence per day)? As i said im thick :lol:

now have a claim number,

Yes have just called and cancelled claim, am re submitting today.

Paid my £10 for S.A.R

sent a prelim letter 22nd july, 1st fob off received 25th july.

sent letter before action 11 Th August.

Received 2nd Fob off 14th August stating:

That's the exact same letter I received after I sent a second letter to him, one in which I specificaly asked if they were just sending generic letters and if 'Stuart Higley' was actually reading them.

 

I wonder, when submitting documents to the court, if you had one or two copies of Stuart Higleys letters from other customers (if they'd be willing), could it be used to show the bank isn't even considering a customers complaints? They say their charges are transparent and fair, etc, but how do they know charges a customer has received are 'fair' if they aren't even bothering to check and just send everyone the same letter?

Okay Leftyles - that all sounds fine... I was checking cause there have been a couple of people put in claims based on a rejection of the LBA only to realise it was actually a second reply to the prelim.

 

Not sure about submitting other peoples letters in the court info .... I think the complaint is the same for others and as such everyone would be replied to in the same manner on the back of one investigation regarding the general lawfullness of the charges.

 

If there were specific issues mentioned in the letter you sent to Mr Higley which was not responded then it would prove more that it was a generic letter and no actual investigation had been carried out.

 

(ie. if you ask for specific details of a particular charge etc)

 

I would say specific issues were raised. After the initial bog off letter I received I sent a more formal letter, basically saying I was disappointed I'd received a standard generic reply, I asked if the letters were all generic responses and automated much like their charges, I asked if he (stuart Higley) actually read any of the letters or if there was admin that dealt with them and just left them for him to sign, I asked how the charges were calculated, asked why if they stood by their decision other people were receiving refunds, how they justified the charges eg, when I went overdrawn £8 I'm charged £28, etc, etc.

 

The response to that letter was the one seen above.

 

Now, I'm sure that when the question of why some people are receiving refunds whilst the bank argue their charges are fair was raised, the bank said that it all depends on the circumstances surrounding individuals and each case is taken into consideration on an individual basis? Surely here we have evidence that they aren't looking at each case individually, they're just sending out the same response for anything that says "I want my charges refunded".

Just a quick Question,

On the Money claim online Particulars of claim should I put the Claimant claims court Costs of *£120

I read somewere that the fee maybe higher later on to do with allocation Questionaire, so how do I up my Court Cost Claim at a later date, as It seems once I claim I cant alter the Form. I can only cancel & reclaim?

Ok have submitted mcol correctly, Thanks all so far that have helped & RESPONDED to my post`s,

Now i have a claims number, I beleive I need to send my spread sheet with the 8% as of todays date,

I have been told 2 copies someone else said 3 copies. should be sent, can anyone verify the amount of copies that need to be sent ?

Should I send a cover letter or just write the claim number on the top of each sheet ? if so any templates or advice on how I should word cover letter ?

could I also confirm it goes to the court address on my claim that I can now view in a pdf format ?

Originally when I sent off for my subject access request paid £10 postal order,

Had to use the Data Protection Act Non-Compliancetemplate in the library for the missing 2nd lot of statements reminding them that the clock was ticking and they only sent 2000 - 2002. It did the trick & I had a letter saying that they had been reordered no mention off any additional fee/s, anyway got my normal monthlyt bank statement today & they have charged me £5 for Historic Stmnt fee 1st August.

Should i ring the retail regulatory risk dept Joyce Tudor Edinburgh who reordered or my local branch ?

This isnt on at all, it was there cock up not mine another penalty at my expense, anyone have the joyce tudor number ?

Hi, My Personal Account letter before action that I sent Natwest over 2 weeks ago. Well Today its 14 days since they received it have checked on Royal mails web site, I had a reply to my prelim letter within 4 days, But nothing on this lba at all,

Should I push on & get the court thing going ?

Or leave it a day or so ?

send them a reminder maybe ?

any thoughts...

Hi Quick update, Natwest Defending, Have had my corbitts letter Beginning of this week, & used the standard reply regarding cpr part 18, full break down of my charges claimed Sent back to cobbets only

(Should I have sent the court a copy Or is it not important ?)

Have received notice of transfer of proceedings & Court Allocation questionnaire, All filled out & ready to go to my local court with the extra £100 as over £1500 claim. Deadline they need it back by is the 9TH of October,

 

Would it speed things up IE: settlement if I was to enter it Early or would it pay to hold off incase cobbetts reply with an offer ?

 

I read somewere that Cobbets have to fill out a Allocation questionaire as well so probably will be a while yet before Any offers are on the table.

 

Any advice should I Put in now Or Hold off.

Yes, you should send a copy of Cobbetts request + your reply to the court.

 

AQ put in early:

 

For: Cobbetts are unlikely to make a full offer before AQ due. It will cost the bank another £100 to settle.

 

Against: You have to shell out another £100 earlier rather than later

 

 

When you return it enclose schedule of charges and send copy of each to Cobbetts
