    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband phoned BG and spoke to someone who wasn't really very helpful at first because he suggested we call PDCS and tell them I've never had an account with BG.

However eventually he said he would send out a letter to PDCS from British Gas himself. He gave us his full name so we can refer back to him if neccessary.

So I'm just going to wait and see what happens next.

As it has been said on this forum, it is up to them to prove the debt exists not for me to prove it doesn't.

Hi keep that letter safe as these ***** have been known to just sell on the account if they are getting no where they wont bother to pass on that the debt is not yours, they will just sell it for as much as they can to cover some of their loss.

Oooops, this totally slipped my mind and I haven't got round to sending the prove it letter yet. So today I got the letter from them threatening potential court action (my fiance is still in Afghanistan by the way so if he lived on his own, he still wouldn't know about any of this)...

Dear Mr xxxxx

 

NOTICE OF IMPENDING COURT ACTION

 

Pursuer: BSKYB LTD

Principle Sum: £54.75

 

You have still not paid off the above debt. Unfortunately, this means we may recommend to our client that they should issue a claim against you in court.

* You will owe more as the amount will then include legal costs and interest

* You may have difficulty obtaining credit, a loan or a mortgage in the future

 

If you still don't pay..." blah blah blah

 

So is it too late for me to send the prove it letter? And if so, should I send something else?

These guys have now passed this on to their 'recovery agents'. I also sent the recovery agents the prove it letter. And today I get a letter from them (Philips - specialist bailiff & debt recovery agents) addressed to my fiance but not addressing him in anyway (i.e. no Dear Mr xxxx or anything) saying:

 

"22 June 2010

 

You have failed to make suitable repayment arrangements concerning the above arrears which remain outstanding.

 

Our Recovery Agents may now attend your premises without any further warning to commence recovery procedures.

 

You must make the IMMEDIATE FULL PAYMENT of all outstanding amounts (as shown above) to prevent this action commencing.

 

YOU HAVE 7 DAYS FROM THE DATE STATED IN THIS NOTICE TO PAY ALL OUTSTANDING AMOUNTS IN FULL.

They can't just turn up can they? I have to say I feel bullied and harassed. My fiance is still in Afghanistan and I don't want these guys just rocking up at my door trying to intimidate me into letting them into my house. Is there a standard letter of complaint anywhere that I can copy and send? Is there anything else I can do to stop these heavy handed bully tactics?

also section 1.9 of the OFT guidence on debt collection states they are responsible for the actions of everyone who acts on there behalf.

I sent these rogues a letter telling them they had breached many of the OFT gudelines and told them if they continued their harassment then action wouldbe taken against them. That was 3 months ago and I have heard nothging since.

Thank you! And sorry for being so clueless! What type of complaint am I meant to file under? It's giving me the choices of under Data Protection, Privacy and Electronic Communications, Freedom of Information or Environmental Information Regulations. I'm guessing it's Data Protection but just wanted to check first...

I had trouble with these people and sent them a registered letter stating that as they were probably aware they had breached a number of OFT guidelines and if they continued their harassment I would take legal action against them. I heard no more because they move on to an easier target. fitzyg

we have recentl made payment of this account to phillips collection services and we to advise u that PCS are no longer authorised to collect payments on this account.

story goes basically, my boyfriend lives with me and a few months ago now we recived a letter from this PCS phillips collection services on behalf of bskyb ltd, we straight away thought it was his familys account as i have sky installed in my name not his , and we knew his mum ect hadnt payed there bill so we immediately called them to get to the bottom of where they got MY address from and his name for this address. we also rang sky to see if my bf had outstanding debt in his name with sky and they had no trace of it. so we left it. we then recieved another letter from PCS formal demand of like £240 summit , and because it was in bfs name n my address we felt we had no choice but to pay montly we then paid £20 a month for the last 3months in total £60 or possibly £70. we havent paid for 2months due to forggetting to ring them and pay, but now recived this PDCS letter saying the above?

 

i typed past due credit soulutions in google to see wot its about and this fourum came up so i started reading threads and dnt quiet understand what the course of action is as me and my boyfriend dnt understand it as he paid off his debt to sky years ago(3/4years) n thought maybe it hadnt all cleared but as this is so out of the blue its geting a bit weird???

 

please help on what to do? do i take it to a solicitors ect??

Welcome, but it's a shame you didn't find yourself to this forum before making payments to them as it sounds, the way you describe it, to be yet another case of a company chasing someone for a debt they don't owe. Just going on what you've said.

Because you had every choice in the matter, given Sky couldn't verify your boyfriend doesn't owe money so what should that have told you about this debt? I am just speaking plainly BTW.

What exactly does that mean? Because it's an attrociously worded letter if nothing else. I think you need to post the whole letter, not just a part of it so everyone here can gain a better grasp of your situation.

 

Anyway ... you are NOT going to get your payments back so I will say that now. You will be extremely lucky if you did.

 

However, just going on what you say but I think this letter here will do:

 

General debt letter - if you know nothing of the debt...

A letter used when a debt collection agency contacts you about an unknown debt.

 

 

Name/Address:

 

Date:

 

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

 

I/we look forward to your reply.

 

Send the above by recorded delivery, have no further contact with them until they have responded with EXACTLY what it says in the letter above. Don't sign the letter, print name. So, quite a bit cheaper than engaging a solicitor who will tell you more or less to ask them to prove you owe the money or one would think.

 

Come back here when they've replied with something.

Again, just going what you've posted. Is this your debt? His debt? If the answer - as per the highlighted part in red - is no why are you paying it? Next step, send that letter that I have kindly provided in order to try and help.

Deniss, you can get a free credit report at annualcreditreport.co.uk. It is only an annual report though, otherwise you can pay online for experian (£6.99 per month), but I believe that you can also pay for a mailed copy for a couple of quid. Hopefully, somebody will come along and confirm this.

yeah i just one of these BS letters in today and i have never had any business with BSKYB anyways i was wondering what i should do as i have scowered through this forum thread and there are broken links and such so i am confused as to what i need to do to stop these pests

Hmmmmmmmm, something odd going on here just one of those

in the post.

Point is it refers to a date 5 years ago, at my present address, we have only

lived here for four years this month,tried to contact Sky as usual all

our advisors are busy and your call is in a queue,and I,am not spending a sunny Saturday listen

to scratchy musac and adverts, current Sky account is in''credit''.

I've been pestered by these idiots, all my correspondence have been by letter, I work in an Army HQ, all letters have been been headed and professional. You think these idiots would know better than to keep trying.

 

09 May 11: letter from S.R.J Debt Recoveries, fishing letter with my name on, so letter was ignored.

 

06 June 11 from S.R.J Debt Recoveries stating that I owed £135.56. I wrote back explaining that I do not owe the debt and that I wasn't even using their clients services (BT) especially as there were no details of dates or services.

 

02 Nov 11: I received my first letter from PDCS in the form of a FORMAL DEMAND, dated 28 Oct 11 demanding that I had to pay by the 4th Nov 11. I wrote back informing them that I was disputing the debt and that I would not be paying anyone when there was no proof of a debt and that I found it ridiculous that they demand monies from anyone at such short notice.

 

17 Nov 11: next letter received, no date, no name, no signatory, badly worded, stating that they required evidence that I had paid their client and my account was on hold for 28 days. I wrote back stating that I did not have an account, that it was up to them to prove that I owed the debt. I explained to them the grammatical errors in their letter writing and that it would be inexcusable in any 'professional' company. I informed them that continued letters would put them in breach of Section 40 of the Administration of Justice Act 1970 and the protection from harassment Act 1997. I informed them that I would not be calling them and that any call from them put them in breach of the Communications Act (2003) S.127 and that I would report them to OFCOM.

 

21 Dec 11: letter claiming that I had to prove payment, account would be held for 28 days. No reply from me as I had been in Hospital undergoing an emergency operation.

 

Today: letter dated 30 Jan 12: Notice of Impending Action: I will be sending them the CPR letter from this site.

 

I will keep you informed as to their next move if there is one, great site and advice, keep it going, thanks
