Hi recieved a letter today from redstone saying that due to an administrative error information about my mortgage account was sent to a private indivdual by email on the 3 August. I have had a lot of trouble with restone and recieved no help from these people in hard times , is there anything I can do regarding there error ?

My friend has just had the same. She is facing repossession and received a letter yesterday. I smell a rat here - this company seems to be reporting it's own mistakes and it could be to cover their backsides with the authorities. I have a conspiracy thread though given my experience of dealing with these less than caring companies. I wonder if this is because they have sent info of their portfolios to prospective buyers? As in landlords and property dealers? Just a thought. :|

Often the lender will have insurance to cover shortfall's on mortgages and then the insurance co will go after the individual. The lender can sell cheap to a buyer who will buy to let mortgage as long as the figures stack. Some lenders have been bulk selling - remember the tables have turned just now and cashflow is king.

Hi

 

ive got a mortgage with redstone

 

about 3years ago got into some trouble wife was made redundant and fell behind with payments,

 

we spoke to redstone about this and was offered no help

saying we couldnt have a payment break or add the arrears to the mortgage ,

 

we were told if the account went to over 3 months of arrears it would go to court so allways kept it under 3 months .

 

we were getting the £50 arrears fees ,

they sent us a letter saying they were taking us to court so

 

i lodged a complaint as we were under the 3 months arrears and

they put a hold on the court action ,

 

after abit of reading it was suggested dropping the mortgage to interest only then i could pay the arrears off so

 

i did that at a cost of £75 and had it agreed that if i paid £100 per month off the arrears there would be no court ,

 

well we have been out of arrears for over a year now so im looking at claiming all the charges back .

 

theses are the charges i got

  1. returned direct debit £120
  2. monthly arrears fees £850
  3. court fees £100
  4. field agent £100
  5. solicitor costs £553.35
  6. lender insurance fees £60 ,

= i always send them my insurance in plenty of time

but they always find something not right so takes about 3 attempts before they will accept insurance.

 

these fees have been added to my mortgage total

so im paying interest on these fees every month ,

 

can i claim all of these fees back and what interest do i ask for ?

plus if i got the money back do i get the money or do they deduct it from the mortgage ?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

What interest do i ask for as the fees have been added to mortgage , because some are in 2008 so ive been paying interest on the fees since then also would i be able to get the solicitor fees back as they instructed solicitors even though we didnt go over the 3 months arrears ? . Cheers

You would be reclaiming interest at the rate they charged you.

HI ,

I have finally received a response from redstone ,

 

they say they believe the fees are in line with their terms and conditions and are a fair representation of the additional work carried out ,

they are not refunding anything and this is their final response ,

 

ive been looking and have seen a few cases where the fos say its in the terms so dont award againts the fees ,

 

ive looked at small claims court for me

 

i think the fee for court would be £70 ,

 

if i take them to court and loose would i have to pay any more fees other than the £70 ,

 

like do i have to pay there costs ?
