      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

reminds me of the joke about the two lazy son's

 

two friends were talking in a bar and they both said that their son was the laziest so to prove the point both the friends went to each others homes to check out who was the laziest.

It was 3.30pm and the man called out to his son to find out where he was and the son called back to say he was still in bed so upstairs both men went and into the boys bedroom and the dad said to his son that there was a £10,00 note on the floor and the boy said ohh ok cheers dad I'll pick it up when I decide to get up and so to that the second man said .............paaaaaaaaahhhh thats nothing you wait till you meet my son

They arrived at the second mans home and walked in and he heard a sodding comming from the from room and so they rushed into the front room to see who was sobbing and crying............it was the secon mans son sat by a flaizing fire in the grate.

His dad said hey son why are you crying why are you so upset .....................his son replied.....................I'm burning

glad to see social network sites are NOT havens for the **** and bog dweller types........Tom and his mate were just that little bit adrift of the points and didn't get on the podium to get a medal and thats too bad BUT he can shine later on so I hope they throw the book at the twonk who did what they did " oops had to edit that.............sorry nana" on twitter

Seconded. Tom and his diving partner did the best they could. Tom is from the same city as I am. The way the local paper goes on, (nothing against this - I agree) makes him sound like a hero whatever happens.

 

Unlike many, he's only 18. His diving partner is in his 30s.

 

We have 2 more taking part from down here at least. Unfortunately, one is representing Latvia and not GB.

To say he's not long lost his Dad I'd say he's done amazingly, what a mature, articulated young man he is! As for the Twitter troll? Jealous much perhaps of him?

 

And yes, ALL social networking sites are legally obliged now to take internet trolls/bullies to task - even identifying who owns the page then naming and shaming them! It's about time!!

Internet Sc*** that lock the computer and tell you if you dont pay the Police have your details and will come and take the computer away,it makes me mad because some people still fall for these and b) it mucks up the computer and I have to try and do clever things to get rid of it and c) the blasted thing will probably still come back in another form arrrrrgh (I would have used a smily here but they have stopped working again arrrrgh

Huh? Is this some sort of a virus or something? Or is it your internet provider?

 

I've never heard of anything like this before Blondie!!!

Must be a virus, message came up on screen saying Lincoln Police (I dont live in lincolnshire) you have been trying to acess an illegal website etc etc, you r computer has been locked pay 100.00 within 24hr or the police would confiscate.

Comp screen then freezes and then whatever you try and do message keeps coming back up, I seem to have removed it for now by doing a system restore from safe mode but I think the whole thing needs debuging

This is the 2nd time this year I have had a virus no idea where they are coming from.

It is a virus that tells you your computer will only be 'freed' if you pay up - a friend got it on their PC whilst watching some porn, I simply reformated their computer back to the day it was purchased which got rid of the virus and then put on some security software for therm.

 

There are several variants going around, the other one is

 

"Your computer data will be circulated on the internet if you don't pay up - I am sure all and sundry do not want to know what you look like, where you shop online, who your frriends and enemies are, and what you like reading/watching.... don't forget we also have your bank details and can pass this onto your creditors. "

 

That one was on another friends PC after they googled debt collectors and went onto a site that offered them a 'get out of debt free' service.

What you need to do is boot the computer in safe mode (Press F8 whilst booting up and select safe mode) then go

and do a system restore - should allow you to regain access to your computer.

 

That is a simple way. You also need to check your system start up options to make sure there isn't a stray programme there and also in the MSCONFIG file.

 

I am pretty good on getting rid of viruses, have only ever had one myself and that was quickly eliminated.

Wait until these sc@m artists realise that there are viruses which reside in system restore. So they can do whatever they like, and system restore wont do anything.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

True, but some viruses around actually turn off system restore or hide the files so you can't get to them, that is why you need to do a backup every so often.

 

I do a fair bit of downloading these days and do a monthly backup, just in case, only had to use it once but that was proof enough I needed it.

Hi Sillygirl, can you tell me if this is ok I did a system restore (got into safe mode) but only took it back a week, do you think it would be safwer doing another one and taking back a bit further. i think the virus got in when my hubby was looking at a football website, the official one was ok but there was another coming up on Google that seemed to cause the problem.

See what happens, if you do a system back up now then you should be safe enough.

 

I sometimes think these virus writers are cowardly bullies who don't want to be seen in a visible way so they use their so-called 'brains' to disrupt peoples already chaotic lives. They really need to get a life of their own rather than hide behind a computer screen.

 

Take all the technology away from them and what is left?

PDSA.......What a bunch of ungrateful to$$pots. Dissasembled a metal framed bunk bed with a desk and a fouton for them.

Carried it all downstairs on my own (and trust me, it's not light). When they turned up, they refused to take it because there was a couple of drink stains (or something like that) on the fouton mattress. What did they expect, it is a childs bed. Have they never heard of Vanish magic spray. I thought these charities wre struggling. Last time I try and help them.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

Omg! I have never seen or heard of a virus that does this :!: so thanks for highlighting it!

 

Saying that I'm pretty boring with what sites I visit, and rarely watch anything online - just perhaps youtube now and again! This is the only forum I use that has anything to do with debt collection on it, I use a health forum too - ebay, animal planet, discovery, rspb, the odd paranormal/sci fi site and recipes - and I never bank online.

 

But what gives them the right?!?!?! What could anybody get out of locking someones computer?

 

I tell you, if/when all the satelites eventually crash and we're unable to use things such as the internet anymore - I for one won't miss it!

Oh I know Sod'em!

 

Charity shops were once grateful for anything they were given - they won't even take clothes now if there's a button missing or something! I had a two TV's up for grabs, one was a 32", okay it wasn't new - but it worked, and could have done someone who was just starting off in their own home, so I contacted a few charities, the smaller one was a flat screen with free view, they didn't want either of them!

 

They said they weren't allowed to take electrical items :???:

 

Do what I do - advertise them "free to whoever wants".

They have NO RIGHT AT ALL which is why they like to 'play God ' with information, it is the same mentality whereby people hack bank accounts and publish them on the net 'because they can because it is freedom of information or free speech'/ MORONS.

 

I've now restored a third laptop with this virus on, in return my friend is going to steam clean my carpets! I wonder what the MP who said 'cash in hand jobs harm the economy' would make of that transaction - we are both unemployed and a 'skills trade' seemed the ideal solution.

 

Without her laptop my friend has no other means of communication as she uses a dongle and only has a pay as you go mobile phone which gets topped up when she can afford it.

 

If you follow through the hackers/virus writer thought processes you could actually end up calling them terrorists.

Try your local freecycle, I've just got rid of a small Bush Freeview box, doesn't record but you connect it to an aerial and then your tv via a Scart and you can watch freeview. Lady who took it is using it for her mother in law who is in temporary accommodation whilst her house is being rebuilt after a fire.

 

A lot of the Charity shops round my area will not display knitting needles as they can be used as 'dangerous weapons'.... and also will not accept 'animal like printed items' due the pressure from animal rights groups. Wonder if they will end up not accepting things with human faces on as it would be against 'data protection' or something!

Where I am, if you send us dirty, ripped, etc clothing, we can get cash for it. I'm not sure exactly what happens; but I believe it gets turned into rag and then given to foreign countries or something. If there's a button missing, we can still sell it. We just write on the ticket "missing button".

I think that's related to not being able to test stuff. We can take some electrical stuff; but can't sell it. We send it to another shop and they can test and sell it.

Electrical items are a problem even auction houses have to either cut the plug off second hand items or sell them as decorative but as long as other items are clean then I just cannot see the problem. I just think some charity shops and the people running them have forgotton why they were set up in the first place, which was to raise funds for the charity.

The by product of that is that they have things availible at a low price which helps people with not a lot of disposable income, although to be honest even the prices in Charity shops seem to have gone up.
