I do acknowledge that you have mentioned in your letter that the value was higher, however, you did not take out any protection to that amount. The protection for this shipment was £20 and we will not be increasing our goodwill offer any further.    Please log into your account online in order to accept our offer. Once accepted, our accounts department will process the claim accordingly. The claim payment will be processed and received within 7 working days.                                  In addition, a refund of the carriage fee will be processed as a separate payment and will be received within 3 working days.  If I can further assist, please feel free to contact me.   I have also just noticed that yesterday afternoon they sent me an email stating that "after my request" they have refunded the cost of shipping. I did not request the refund so will mention that in my letter as well.
    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy?     • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've changed my email address in the past 3 years :p

 

Nowdays I use that email address to harvest spam to feed directly into my spam filter which I sell commercially as a service. More spam is welcome as it only makes my filter more accurate :p

 

Edit- Actually your post was a good reminder that I've used that address as a honey-pot for a while now. I've just deleted it now in favour of another.

I am the original poster of this thread. Due to the inordinate delays and ignoring the promises that the initial investigator (so called!) made to me during their selling, I finally lost my money altogether. They gave me back only a portion of the fee but that did not become the answer on my case.

 

I made my decision to chose them only because they were projecting to me that they will do all investigation and whatever they told me about the debtor company was NOT true. These details were never passed to the account manger who totally did not bother about my case at all. DON'T BE FOOLED BY THEIR OF CLAIM OF DOING THE INVESTIGATION. IT WILL MISLEAD YOU COMPLETELY.

 

If anyone from Daniel Silverman wants to refute my message, they can contact me and I can provide the details of the investigator/account manger, etc.

I can understand that a DCA will shaft the people they are chasing given half a chance but to shaft it's own paying customers beggars belief. Has to be a recipe for disaster, but how have they kept going for fifteen years, they must be very good at what they do, shafting everyone!

I am having a very similar experience with zero response from telephone calls, emails etc. When I call I am told they are "very busy"!! The reception staff are very rude and unprofessional.

I would like to share my experience of dealing with this company called 'Daniel Silverman'. One of my debtor defaulted me for a debt over £10k and I approached this company (as a customer giving them 15% on the debt they recover for me) for debt recovery which is a worst decision I made.

 

They took the case, charged me £800 for their services, did some investigation about the debtor but never passed any info to me. Infact, I did a lot of investigation on the debtor (including phone numbers, address) and pass which they ignored straight away. They just don’t hear to what the creditor says because their only aim is get as much money as possible from the customer who gives the case to them.

The account manager just did not bother to answer any email, phone calls. Etc regardless of the number of times I called. Their website puts attractive information about the company’s policies and the complaint procedures. That is a big laughing stock as I made a complaint copying everyone in Daniel Silverman (including the account manager) company but my complaint has just been ignored and put in their bin. I am taking up the case with the Financial Ombudsman regarding the service provided by Daniel Silverman.

The only reason I am writing here is that I did a lot of research on the debt recovery companies in the UK and decided finally on Daniel silverman to chase up my debtor. The only thing I have ended up with is the wasted time and being treated unfairly & ignored by Daniel Silverman as their customer. The only thing they are interested from their customers is money.

If any one from Daniel Silverman objects to this post, I can give them my case reference number and they can check their company records about my case & my complaint.

 

I would agree Daniel silvermans are a complete waste of time and give false information just to get an initial sum of £900.00 they promise everything but deliver nothing, please don't waste your time and money on these car park ticket chasers. Invest in a solicitor.

It seems the leopard does not change its spots.Anyone who has invested some time reading CAG's forums will see that the debt collection industry talks the talk, but doesn't walk the walk. We don't often hear about small businesses using DCAs to pursue debts, perhaps because it seems to be a waste of time - and likely to mangle a business's reputation as well. Small businesses are far better off using the Small Claims Court.

There is no such thing.

 

If you have already taken court action, and bailiffs have got nowhere, there is nothing that a debt collector can do for you. All they can do in any case, when they don't own the debt, is make phone calls and send letters. Anyone as good at debt avoidance as your former tenant seems to be won't be worried by them at all.

 

As for hard-hitting, in the UK debt industry this means using red ink and capital letters in their computerised threatograms. There is not one DCA in the UK that I can think of to whom the term professional could be even loosely applied.

 

Hard as it may seem, you may have to write this off. I would certainly counsel against wasting any money at all on debt collection with Daniel Silvermans or any other firm.

I today received a letter from Daniel Silverman threatening to to send bailiffs to my house to recover a debt that does not exist! This has caused extreme stress to myself my partner and her elderly parents.

I recently attempted to start my very own business and within just two days of setting up a website for my business I was called by a mysterious company claiming to have an in-house magazine for the forces offering to create an advert for my business. I said yes it sounds all very good and could you forward me some details so I could have a think on it and get back to them. Within a couple of days i received a letter demanding 195.00 pounds +vat I emailed the company straight away saying I have not authorised this and would like to cancel any kind of advert or verbal agreement that they had THOUGHT I had made. Now I am receiving threats after only receiving 1 letter from Daniel Silverman ltd headed "FINAL DEMAND" trying to force me to pay 600 pounds for something I simply did not want or ask for in the first place!!!!

 

This is causing extreme upset, emotional strain , as well as physical and mental stress for me and my partners parents who are now panicking that they are going to have bailiffs turning up on their doorstep. Let alone damaging any sort of chance of me getting my very small independent business off the ground.

 

Can anybody give me any advice as to what it can do to resolve this as I am certainly not in a position or willing to pay a debt for something I have never asked for in the first place!

This is common type of racket, involving, prospective magazines, maps diaries and such like.

The companies try to argue that there was a verbal agreement and copy was produced etc.

 

 

Send the following to DS by recorded signed for post, check delivery.

 

 

Ref: use theirs.

 

 

Sir/Madam,

 

 

I refer to your letter dated xx.xx.xxxx in reference to any alleged debt for £xxx.xx you claim I owe to xxxxxxxx for an advertisement entry in a magazine.

 

 

Please take note I do not acknowledge and debt to your client.

 

 

For clarity I have not at any time entered in to any agreement verbal or written with your client nor have I agreed to or authorised any copy or proofs to be produced.

 

 

I am fully aware of this type of practice and the issuing of speculative invoices for non existent advertising.

 

 

I suggest the Daniels Silverman closes the file on this matter and returns it to its client, no payment will be forthcoming and any further attempts to pursue the alleged debt will be considered harassment ( I refer you to Robertson -V-BOS and the judgement regarding harassment).

 

 

Any court claim will be robustly defended.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

I am currently doing a bit of research on the company Daniels Silvermans (A little late) however, I would just like to share my current experience with them as I have noticed this thread dates back a few years.

 

For anyone wondering if the company has improved at all THEY ARE STILL [causing problems] CUSTOMERS TO DATE!

 

I handed them over a case of a client not paying for a total sum of £840 of which they charges me £120 for their services. This case has been continuing for over 4 months & I am constantly emailing and calling for updates. I have now given up chasing the debt collectors. I can not believe how money grabbing, [problematic] and unprofessional a company could be.

 

Foolishly I did not do my research on the company prior handing over my case as I was referred to them by the Gym I am currently based at (which has also turned out to be greedy money grabbers, with suspicions they may have something to do with Daniel Silverman not handling my case with professionalism.)

 

A pre-warning to any individual thinking of using Daniel Silvermans DO NOT DO IT! Save yourself the hassle as ironically - you will be chasing them more than them doing any chasing.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
