Hi there, I got a question regarding clamping. Parked my car on my own rented car space underground. New parking company came 1st of this month and clamped my car. Only a tiny little sign shown at the end of the garage regarding clamping. Despite that during the clamping procedure the parking company's van parked outside at the garage door so nobody could get in and out. They did threat of towing away if I do not pay. Now I paid via credit card and need some basics to get the money back via credit card (unfair trading?). How is forcing somebody to pay amounting to the fact that the credit card is liable? Need some infos and arguments.

My qustion related to credit card payment. I can do the rest later but want to take it up with the credit card first as it might be quicker. Any arguments regarding liablity of credit card and "forced" payments?

Some credit card companies play ball and some don't. I'd try the payment made under duress line with them. Also have a read of the clamping guide in the stickies section as it details some remedies including this one. Any breaches of the laws as they stand will add fuel to the fire and may incline the CC company to your way of thinking.

 

It might be worth explaining that you were parked on your own land etc and they trespassed to clamp you.

Attempt to get money from the clampers (which will turn out to be fruitless) and then demonstrate your efforts to the credit card co and demand a refund.

 

Look up 1974 Consumer Credit Act.

 

CC co will fob you off again and again, but should relent if you stand your ground.
