Im wondering if ACS crazy decision to not accept template letters (or modified templates in my case) had anything to do with them picking me.

 

Still,its their decision and I hope they're prepared to reap what they sow.

 

 

Good luck with this. I would get your reply in from your solicitor as soon as you can and not say to much regarding this and till it has been to court. Because everything you say in forums will be looked at by ACS and logged, and the longer you take the more time he has to find new stuff he can through at you.

They are just being aggressive, an LOD is an LOD, don't really matter even if it comes with a pink ribbon.

It seems they are collating information regarding complaints about ACS.

 

In other words - b*ggerall.

Ive had probs with acs,pretty much the same as anybody elses,been to see my mp who HAS BEEN advised not to get involved with this!!!!!!!!!

I suspect others will say the same as its a legal issue not a [problem].

My mp advised my to complain to which?

 

Im waiting for my 3rd reply,not heard anything from crossley since i set him the challenge of taking me to court,i want that big brown envolope crossley.Im getting fed up of waiting,i have a expert witness on hand also waiting to blow these silly cases out of the water.

 

As for going to see a mp,you will get a generic response.Muppets.

I'm sorry to hear that has been your experience, but it is by no means universal. Did you see your MP in person, or did you just write a letter?

 

Many people have been assured by their MPs that they will be looking into their case. Only by more people seeing their MP will this gain any momentum.

 

Furthermore, the more MPs are aware of this, then the more chance, when the digital Britain reforms are passed through, our voices will be heard and this whole racket will be stopped.

Actually, this is a new development - and a welcome one. The SRA have started to compile information on ACS, which they have shown no interest in doing previously.

 

Anyone who has previously contacted the SRA in connection with this matter should do so again and supply their details and fill in their questionaire.

 

It is very easy to be an armchair critic in all of this and sit back letting apathy take over. PEOPLE NEED TO MOBILISE ON THIS!

 

SPEAK TO YOUR MP! ANSWER THE CONSULTATION!

 

If you do not do this, it will just carry on and on. That will be your fault.

I suggest you write to your local opposition to your MP - not only will they be interested in this issue, they will make mincemeat out of your MP's response. This is totally disgusting, IMHO. Legal issue or not, YOU are HIS constituent and HE should be helping YOU! :mad:

other day i had reply from ICO . there reply is no more than b..l sh.t in my opinion these

To be honest, I wouldn't get too hopeful about the SRA. Those of us who frequent this forum regularly have seen certain firms of solicitors (BC, HC) who act unlawfully on a regular basis and get away with every single complaint that is made to the SRA :mad: :mad:

I think at the minute we are stuck with this as he is currently doing nothing legally wrong under the current laws. Its looking like we are going to have to wait and till they decide on what the laws will be on this type of thing, but then they could go either way and take along time to before it actually happens.

 

Maybe hes looking at the changes that could be coming up in the uk laws and thats why hes decided to try his luck with taking people to court before he is forced to stop, if the new laws go againts his bissness plan hes got nothing to lose.

As has been said many times, he is relying on people panicing & just paying up straight away.

Its the job of sites like this to reach out to has many people as possible to inform them that they do not need to just pay up or be frightened etc..

In my view, there is no difference between ACS & your average DCA.

SRA is investigating DL for so many months and they still have not come out with their report on that.

 

 

That the reason why I think even if the SRA find his practices to be wrong by the time this happens the laws will have changed either in his favour as they are currently drafted (thats what I understand they say) or if there changed it will stop there (currently legal) money making buisness venture. But again how long before these changes to the law are made.

 

But still we should be keeping on the backs of the relevent people Like the SRA, Watchdog, Which, MP's and what ever others there are. If we just sit back and do nothing, we can expect nothing will ever be done in return to resolve these matters. I personally plan on getting in contact once a month with these people to see if anything is actuall being done about this.

When they do I suspect it is a legal issue - which it is.

 

In my opinion, where it diverges from that is, ACS are sending threatening letters to thousands upon thousands of people and it is unrealistic to think that they could ever actually take that many bodies to court.

 

A close parallel would be the practice of some debt collectors of issuing Statutary Demands, (a precurser to bankruptcy), as a threat when in reality, they had no intention of carrying though on it.

 

Of late, this practice has been jumped on by the OFT and certain DCA's have now to report their activities to them.

 

One thing I do know, if I sent that number of threatening letters out, I would probably get a visit from the plod.

yes i seen my mp in person,hes been given orders from westminster to not become involved in this what is a legal issue,i feel let down and as somebody suggested i may visit the opposition mp,allthough to be honest im not to bothered,i almost want that big brown envolope,plz crossley take me to court,i have a computer wiz on hand who is more than happy to get my case dismissed,once one is dismissed so will all the others.you dont need your mp or even a soliciter,you are not on trial,you just need a qualified computer wizz to help if it ever does goto court,crossley is a knob,he wont take me on i dont think because ive been as aggressive to him as he to me but ive being polite at the same time,but i wish he would take me to court,all of these problems for everyone will then be over.

I contacted SRA on Friday to complain about ACS, they took all my details and told me not to pay anything to them and certainly to ignore any further correspondence from them (even if the Big Brown envelope arrives through the door!). They also told me that I do not need to waste time or money consulting a solicitor and to use the internet to find out more information. They asked if the accusations related to Music, Games or Pornography. The nice lady also informed me that they are investigating ACS and had received THOUSANDS of other complaints about their threatening and menacing tactics!

This is extremely reckless and plays straight in to ACS's hands. They expect people to ignore them, any claims that they issue and to get Judgment by Default as a result - once they have one claim like this in the UK, they will use it to hammer more unsuspecting people, who will think it's a legally binding precedent.

 

The SRA are putting themselves in a very dubious position by even suggesting this - in effect, they are giving legal advice without any disclaimer (such as those you find on CAG) which could leave them in a very sticky situation should someone actually follow that advice and suffer as a result. I suspect, though, that you won't get this level of advice in writing from them, for exactly that reason.

 

This advice should be ignored completely. You must acknowledge any allegations levied against you, whether in letters before action, in which case you need a letter of denial, or Court claims issued, in which case you need a good defence. Ignoring either is doing exactly what they want you to do - don't fall in to the trap.
