NO Even if they showed you a copy of the PCN they sent, can you still wear that they actually sent the first PCN to you? NO Why are still quibbling  when the real argument is why they have broken the Act by telling you that you hadn't paid when in reality they shouldn't have sent that letter out probably until Monday which  would have been deemed received  on Wednesday? If you are that bothered about it, just leave out the start about the windscreen ticket since it isn't why you are complaining.
    • I am sorry that you have come across excel -possibly the most inhumane of all the rogues that ruin parking in private car parks. i am more sorry that I have missed your thread until now. As I understand it, their artic. was parked in front of their parking sign and the Blue badge places forcing you to stop somewhere else in the car park to observe the rules. On realising that even the Blue badge places were paid places and that you did not have the correct coinage you quite rightly decided to leave. Thus you had read their terms and until you have read them and signified your acceptance by either paying or staying, you are not classed as being parked.  You have a MINiMUM of five minutes  leave. Sadly Excel do not understand any words greater than two syllables which is where their problems start. Their greed, ignorance, inhumanity, etc etc all carry on from there. However they do know that Judges do understand what minimum means and are well aware of the Equality Act  so I wouldn't be too worried about what excel  will do. Plus we still have to see their PCN and when it comes to producing a Notice that complies with the Act relating to private car parks they do not excel at that. I hope that the Iceland MD will cancel the ticket. You still have a couple of other routes you could try. The first one is your Member of Parliament will probably be happy to help as they will need all the votes they can get with an election looming. Plus your local newspaper may also pitch in after hearing your story to go after Iceland and excel. [You may notice I have not merite them with a capital E as it is definitely undeserved.]

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Catching my son out, I knew it was him and not sure if her was winding me up. But turned the telly on the other morning for a bit of bbc morning shows and found the naughty chanel on. I didnt realise sky had these channels with a woman just covered waving a mobile to encourage premium rate calls.

 

Anyhow nearly spat out my tea grabbing controller to change channel and later on when I was going to bed my son was going to watch some tv and asked him had he any idea how a almost nudey had appeard on my screen to which he said no. However he gave himself away when he said are you refering to these channels and new the bleeding chanel number of by heart:lol:

 

Told him to behave as he sniggered and then reminded him if I found that number on my bill I would not be happy.:x

 

At least change the channel back son I demanded:lol: Did any of you know of these channels, I was shocked as Ive forgotton the pin you need for films over a certain age, violence or nudity and the like and thought you would need the pin to access these but NOPE:!:

Don't ask me how I know, but you need a pin for those type of movies and the likes. What you can watch for free is chat lines/telly, whereas you dial a premium number (usually about £1.50 per minute), and chat to the peeps on the telly. Used to get a lot of complaints though, as it was very rare you speak to the person in front of you. They never go full nude so it is allowed. I know this because my son done the same and phoned the number (£20 extra on the bill). He paid it back and there has been none since.

 

And before the jokes start, I am not interested in that sort of thing now (even though I am not too old for it).:-)

 

 

If all else fails, kick them where it hurts and SOD'EM;)

Better check my next phone bill, if he has I will get my revenge when he opens his xmas card usually containing money, I will deduct it:lol:

 

He wouldnt do it again then when comparing it to an xbox game:madgrin:

 

Update, hes just come in and I warned him. Told me he hasnt rung them up, thank goodness:-)

hmm isnt there some way you can alter the channel order??

 

accidently switch the "naughty ladies" channel with the "rather naughty men" channel for example :p

Wow after a miserable morning a knock at the door to be handed a book I had won on ebay for just over one pound, brand new and in the shops for twenty. Turns out seller was nearby visiting the hospital and said he would refund the five pounds delivery (quite a heavy book) I said no keep it for your trouble and he insited no he will refund it tonight. Only takes a knitting book to chear me up :whoo:

 

Now when will I get round to finishing my first jumper, hmmmm, one day.........

Won quite a few bargains on ebay of second hand evans clothes for just over a quid most items starting to look a little smarter, next handbag 99p, coat 3.998)

Just as well as my xmas sales clothes money was eaten by my rats escaping today, they got a new dwelling, but I still got my new outfit :)
