It seems that DVLA think that S.88 does apply for applications disclosing a new medical condition after all. Why might this be so, and what of “qualifying application" and "relevant disability"? S. 92(1) imposes on the driver a requirement to disclose a relevant disability. S.92(3) requires the Secretary of State to refuse such an application disclosing a relevant disability ….. EXCEPT S.92(4) requires the Secretary of State to grant such an application if the relevant disability is “adequately controlled”. Hence my belief S.88 can apply for medical conditions (if the driver meets the medical standard of fitness to drive) as the application remains a qualifying application IF the driver meets the medical standard of fitness to drive, until DVLA (on behalf of the Secretary of State) say it doesn’t, provided the driver believes they meet the (medical) standard. Additionally, at (or before) June 2013 (as noted in my previous post) the medical standard for fitness to drive for conditions involving excessive daytime sleepiness was changed from “completely controlled” to "adequately controlled".

    • I see that at the start of your thread you said they hadn't sent a Letter of Claim.  And in fact in all the uploaded material there is no LoC.  This is great news.  Even were you to lose - you won't - the judge would chop off a chunk of the money for their non-respect of PAPLOC. However, I'm a bit confused as you've named the file name as a SAR.  Are you sure about this?  Did you send any other letters apart from the one dx advised which was a CPR request (not a SAR) to DCBL (not Group Nexus).  I'm not being pernickety, this will be important for your Witness Statement further down the line.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

For example, if you go to the top of this page, you will see that this thread is in the MBNA forum, if you click on MBNA it will take you to the forum and you will see the icon at there.

I believe that I truly excelled this morning, either that or I’ve proven I really am a total nutter. Anyway here is the dialogue.

 

Me: hello

DCA: Is that Mr X

Me: No this is Mrs X

DCA: Are you sure that is not Mr X you sound like Mr X

Me: Are you saying that just because I have a deep voice that I’m not feminine

DCA: Of course not

Me: I think my friend Kirsty Wark might want to do a programme about the likes of you

DCA: Is Mr X available

Me: hold on and I’ll check

(put phone down and walked out of room then screamed OH NO NOT AGAIN before returning to the phone)

Me: Sorry I’ll need to go, Mr X has slashed his wrists again, I thought he had been in the bathroom rather a long time.

(Hung up phone, then broke into a convulsive fit of laughter. Then I thought, what if that was not a DCA? It could have been Readers Digest telling me I had just won their £250K prize!)

Does anyone get a call from this number? 08456029441? I got a call at about 8.00am from this number! unreasonably early! as i dont think anyone should ring this early before 9am and it awful as i do get worried being that early it may be an urgent call from family with awful news or something:mad: i did a 1471 and googled it and found out it was most proably a bank of scotland number.Apparently a lot of people were saying they get calls from this number at very early times,Makes me wonder if they trying to scare people into answering phone if they ring that early hioping to put them into a panic that it may be an urgernt call from family or something:mad:

Yes, sunflower99 it is indeed HBOS. They used to do that to me. In fact there was a time when I did not need an alarm clock because you could guarantee they would call at 8am. I've actually had calls as early as 7:45 which I'm sure must be breaking some code of conduct.

 

Fortunately that has stopped. What I did was lift the phone and say nothing. If it was a genuine caller they would speak. If a call centre their system would hang up. I understand that call centres are penalised for making silent calls and so this method helped clock up their silent call ratio. It seemed to work because they have now stopped this practice.

 

Mind you I have kind of won a case against Halifax and am giving BOS a run for their money at the moment also. In the Halifax case we are at taxation of accounts phase (they are paying my legal costs) and the BOS is with a DCA.

I have 0845 6029441 programmed into my mobile, when I was on speaking terms with Halifax however I answered a call this morning from the same number and it was Blair Oliver & Scott! So I guess they share numbers? Although the Blair Oli and wotsit previously called my landline from 08456 029748.

 

Now B.O. & S claim to be a 'professional debt collection agency' and their address is in Rosyth but aren't they just an inhouse dept for Bank of Scotland?

Yes Blair Oliver & Scott anre indeed Bank of Scotland under another name. Better still when they commenced legal action against me the solicitors address was... you guessed in Bank of Scotland in Rosyth. It was not until I lodged a defence that a proper legal firm got involved and I'd guess told they they were on a hiding to nothing and the abandoned their action.

They stopped calling you and started on me!

 

I've got CapQuest, Apex and Credit Resource Solutions all calling me at least once each per day. Calls range from morning to evening with some as early as 8 am but usually are restricted to one or two attempts per company per day which is nothing compared to MBNA at their peak

 

I've stopped trying to wind them up and either simply hang up the moment I sense that momentary silence before the call routes to one of their staff or simply decline to go through their security check phase.

It would be a problem changing numbers because I work from home and get business calls, anyway I can live with a wee bit of bother from these folks. I don't let it get me down and every so often I'll wind them up which gives me no end of satisfaction.

OK I put my hands up to being the sickest person on the other end of a phone. I’ve been getting a deluge of calls lately mainly from CapQuest. Anyway a friend had just tried to wind me up with a link to a Youtube type video only it actually led to a naughty film clip site. The site had a similar name but was clearly dedicated to porn. So, as I was in the middle of trying to close down this obscene material before my wife or children saw the phone rings. I shut off the volume on my PC only to find that a DCA is on the other end. In a moment of madness I raised the volume on the PC and said in a strained voice “sorry I’m a bit busy right now”. She said “oh” and I replied “you have no idea what I need to do these days to earn a living....dam does he really need to put that there.. groan... must dash”

Call from local company (I am not in the UK) today which caught me off guard. She confirmed that they have no ability to use the legal system in my resident country for these UK debts and I made it clear to her that I do not recognise the debts and would not be paying anything to MBNA. I will now wirite to MBNA to confirm that all contact must be in wirting and telephone calls will not be answered.

I think these things come in waves Exchange. I too received a letter today from HL Legal advising that unless I paid up the matter would be passed to their Scottish Agents to raise proceedings. However, it goes on to say don’t contact us just pay directly to Experto credite who bought my MBNA debt. I decided just to wait for the communication from the local solicitors.

Not directly related to MBNA, but a letter arrived today advising me that Bank of Scotland are increasing my credit limit by £1500!!! I have not disputed this credit card agreements validity and I am up to date with payments, but still find it unbelievable that 2 years into disputing 5 different credit card agreements and a loan, on top of which I am not UK resident, that anyone would offer me more credit.

Just shows you how crazy things still are!
