Right an update on this.... I have received from the court an AQ and a transfer of proceedings to my local court... Postggj or anyone I will need help filling this in... It has to be in by the 7th Aug.... dont want to leave it to the last minute this time....can anyone tell me is this just an acknowledgement of my defence or has the claimant said he is definately going to persue???

no panic on this

after the defence goes in, everybody gets an aq

the only difference is, they have to pay, not you

 

if they dont pay this fee, the claim will be struck out

 

they are still pondering on the defence, prob did not like it very much

 

shame

 

there is a thread on guidence on filling out an aq

 

ill ask to get it posted or we will deal with it over the weekend

 

no wories, its just going through the motions this

I must ask I have searched for this company on the OFT's register of licence holders, and I can't find anything on them...I would drop the OFT a line about this company, I also think you should you should call the Illegal Money Lending team at Birmingham TS - 0121-693 1122 just get them to verify this company

I havent looked through your thread.. so not really up on it. Have you made an attempt to negotiate with this company prior to the court case. Have added some comments in blue below.

fast track - I think you are looking at Fast track as this claim is for over £5,000

I will go and have a look at your thread proper to see if anything needs to be amended.

 

You should also have a section "for any other information".

 

You should include here a request to the court to order the other side to provide documents you dont have.

 

It looks to me as though you should be asking for a complete breakdown of how the company has arrived at the figure they are claiming.

 

Have made some amendments to my original post, having read the thread.

I can't see any references to Finance U having had a licence though....

Hi Bill,The garage I bought the car from was called Corner Park Garage (CPG) and Finance U Ltd is their 'In House' guaranteed finance company, well known in our area, I think they are one of the same , dont know if they would need a separate licence though:idea: Graham Humphries is the owner of both, and the person who is taking us to court......

 

 

CB its an N150... as for trying to settle out of court, TBH I wouldnt feel comfortable contacting these people after all the lies and threats they bombarded me with when we had the car. I know you prob havent had time to read through all my post but they took the car without a valid default notice and without a termination notice, I dont see why I should negotiating with them??

Hi couple of questions,

 

 

What can I put for the reasons why I consider it inappropriate to try to settle the claim at this stage - Reasons ??????

 

I would like to mention their unreasonable behavior and taking the car without a valid default and termination notice, but dont know if this is where to put it... I have to put something though???

 

How long do I estimate the trial or final hearing will take???

What do I put here??

 

Should I attach anything to the AQ ???
