Yes it seems there is always something to put the spanner in the works:(

Unbelievable that there are problems giving our own money to help someone fight their case.in court..Dont know what this country is coming to :(I thought this was a free country and if we want to to help a friend or relative or indeed any person we choose to get justice for on an issue that affects us all the courts should not be in position to penalise us:x

Good point Diddydicky! It is ridiculus though that we have to worry about all this ,What a country!:(We should be free to help anyone with our own money wheter an issue affects us or not and if someone wants to give a friend relative or even a complete stranger some fiancial help to fight some sort of case they symphasise with.they should be able to with no worries about contracts or repercussions if they choose to give their money freely! But at least as you say DD wem can argue that as memers of Cag with same issues we can be said to a legitiimate concern!:)

it IS without the 2004 amendments..I can apply this whole Regulation to pre-31/12/2004/5 agreements that are still 'live'

 

Just what I was looking for

not directly, have worked with James Cullen from the same chambers, hes a good guy so i wouldnt have any hesitation in working with them

The goodwill, advice and help given by the participants in this thread is clear for all to see. It's not practical to thank everyone individually - but I've noted the comments. Keep 'em coming.

 

In the meantime, I'm following up a recommendation given above regarding an enquiry for a CFA Barrister. I need to call back tomorrow to speak to the senior clerk. Apparently it's done on a case by case basis.

I only read that today it's about the fact that at Chester County Court recently the decision went our way in regards to an original agreement having to be disclosed for PRE-ACTION DISCLOSURE CPR 31:16

 

if you have already read it I apologise..if you have not you should find it REALLY interesting,

don't get too excited- it is not all it seems- there are important costs implications in this route and it is being appealed

 

if the appeal goes our way then yes it would be a very important landmark- but as usual, expect the other side to withdraw at the last minute if they feel it is not going their way and leave yet another loose end hanging

Never have got exited about these things as many times they can come back and bite your arxx ;)
