i am putting in claim for statements i have received, and as yet have not got any statements. Am a bit confused as to what i send next.

I am very disappointed that you have failed to respond to my letter of the 19/08/06

I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

 

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

 

I calculate that you have taken £9,651.45.

I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 19/08/06.

 

I require repayment in full of this money and. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.

The letter above is the one I sent, have not added interest. It is as far as I know just charges. The odd 45p is probably from the estimated amount. Overdraft interest was sometimes just pence

Have now filled in my N1 form. I understand that I print 3 copies of this 1) To the court, do I send one to abbey?

I have just claimed for the statements I have and will submit a second claim for the estimated amount.

Also what is the next step for me on the Non compliance side of things, Have sent Abbey non compliance letter on the 11/09/06, no response.

Should I have added interest to this?

Have today received a letter from Abbey saying sorry that I feel that Abbey's charges contravene the unfair terms in consumer contracts regulations 1999. They say they have credited my account with £635.00 ans also cancelled a further £330.00 worth of charges due this month.

They say that the regulations say that they must explain the charges in plain language and that they have to act in good faith, which, according to the office of fair trading, means dealing fairly and openly with there customers.

He says that he is confident that Abbey have been fair and open in explaing there charges. And goes on to say that he has noticed that this is not the first time my account has been in arrears. He has also sent me the onbudsmans leaflet.

Is that it now, is that all I can do?

I have filled in N1 form based on just the charges for the statements I have, thought this would keep me below the £5000. I intend to go for the amounts that I have not received statements for after this one is sorted and have sorted out non compliance, is this logical.

Do I write ot phone them to say that I accept the refund as a gesture of goodwill.

Is the GOGW actually sitting in your account? If so, you need do nothing, just file your claim and then ring the court and tell them that they have made a GOGW, they will make a note on your account, and then you continue with your claim

Do I need to send another LBA, giving another 7 days, some people have and some have not. If I have to should I send anothe schedule of charges claimed with just the ones on that I have statements for, or will this let them know that I will be going for more later.

And they have not complied with Data Protection Act, do I go to court on this now or write to them again...............
