In relation to PCN's issued by a local authority, is the council's enforcement contractor also permitted to consider and determine the outcome of pre & post NTO representations?

 

I think the statutory guidance says they "should not" rather than "must not" however, even so, if a council's enforcement contractor is also responsible for considering representations and in flagrant breach of guidance from the DfT, would that not be considered a little dodgy to say the least?

 

Very interested to hear people's thoughts on this one.

in reality they often do. just as some bailiff firms do a 'complete service' and deny late stat decs on behalf of the council. they wouldn't let lost income cloud their decisions would they ?
