If you have not yet issued the court papers, then they are trying to scare you off. Their position is indefensible.

Don't worry. Scan the defence over when you get it and we'll deal with it. We will see if we can supply you with any useful documents as well. Also we will help you fill in the allocation questionnaire. We shall try to ask for stanbdard disclosure which means that they will have to reveal a lot of information.

We will ask for this on the basis that they have a fiduciary replationship with you and that they are obliged to make strict dislcosures.

Well, if they defend, you will receive a copy of their defence and also a copy of an allocation questionnaire which is a ofrm which the court send you and which you complete and which allows the court to make decisions about hos to deal with the case - length of trial, which track and so forth.

Got a letter from the court today.

 

Halifax acknowledged 23.03.2006 state they intend to defend.

 

I am very scared, and may need some help to, if thats ok with you bankfodder?

It's standard stuff - of course they intend to put in a defence. It buys them a further 14 days.

 

I wouldn't worry - Abbey defended both our claims against them (my partner and I) - the second time I thought they might actually mean it - sadly they did not, and they paid up in full.

Held my breath for minute there...... I was panicking too in case they did the same to me, but am ready for them..... Haven't got that far yet, but - truth be known - I am probably expecting it. They're not going to go down without a fight, are they?

They will keep to going to almost the last minute in the hope that you will be scared off.

 

However you must be prepared to go to court.

On black from their side of it, but obviously i havbe items in the red because of this, going after tehse to reduce them first and take off default and resort my once perfect credit history.

Just had my letter from Halifax, i knew what it would say as soon as i saw trinity road, i won my claim as on the litigation in progress thread.

I see your claim got served on 18th and acknowledged, mine's a few days after, so can I ask you if when they acknowledged, they were "intending to defend in full"? Or something else?
