  7. That's utterly disgusting. Please keep us posted on how you get on. I feel for you and your wife, I really do. Try to remain positive. As one door closes, almost always another door opens. Use this as an opportunity to look at your horizons. If she is a talented hairdresser and some of your neighbours are boycotting the shop, then hey, mobile hairdressing opportunity!! There's always a silver lining. Best of luck and big hugs x
  8. This thread has gone a little off the point. From qualifying as a paramedic, which took blood, sweat and tears as a single mother, to asking for advice regarding the legalities of a civil law suit, to being advised to "ditch" my career and look for something else. I refuse to let this idiot win. I've instructed a solicitor. I have enough to go to a civil court. Thanks for all your input guys x
  9. I'm a paramedic. There is only one ambulance service. I would have to ditch a job I love. And why should I? I've done nothing wrong.
  10. My aim is justice. I don't want cash. Why would I want cash when there is a direct threat to my life? I did grievance it and also requested a dignity at work investigation. Both were denied due to lack of evidence. The police found the previous malicious calls were coming from a mobile phone registered to my employer. As phones are not booked out to individuals, it didn't prove beyond reasonable doubt. It was handed back to my employer for an internal investigation and was closed. I have no other problems with any other colleagues. Plus, I recognised the voice as his. But it's still my word against his. These latest messages are from a mobile not registered to my employer. The police are doing a subscriber check which will tell us where the sim card was bought and how it was topped up etc. The content of the text messages say that I am going to be killed whilst on duty, with a knife. They also mention my other colleague is also going to be killed and that the police can't help us. They used words that were used in the calls from last year. (You cowards etc.) Everything points to him. My employer is doing absolutely nothing. Not even asking him about it. I'm so frustrated at their lack of urgency and lack of care it's astounding.
  11. Yes, I can do that, but I need advice on taking out a civil law suit can I use "balance of probability" in a civil case?
  12. The police completed an investigation last year. He was issued a harassment warning on the other member of staff and was arrested for making threatening phone calls to me. He used a mobile phone from work to make the calls and because that didn't prove beyond reasonable doubt it was him (only my word that it was his voice) it was passed back to my employer to deal with it internally. They took no fuirther action. I do believe these latest messages are from him as they use the same wording as his calls, and refer to both myself and the other member of staff involved. I need to ask the police to trace the sim card used, as it was not a work phone. That will take a little time I know, but I wondered, if the police still can't prove for sure, is there enough for a civil case against him? I'd also take my employer for failing to protect me from violence at work.
  13. The harasser. If I can't prove beyond reasonable doubt, but the balance of probability finds him guilty I mean.
  14. A civil case working on the "balance of probability" I mean.
  15. Hi, this matter has been ongoing for some time, and I really need to sort it out now. Myself and a colleague made a report on somebody at work for gross negligence. Now I'm really not one for telling tales, but this person was responsible for the death of somebody in their care and was about to do it again, so I think we were justified. The person in question was suspended but reinstated after the management identified a "training need". Since this person returned to work, both myself and my colleague were threatened both in person and by malicious telephone calls. The police were involved and issued a warning. My employer did nothing. Some time has passed, and I have now received death threats by way of text message. I have gone back to the police who are investigating, and I strongly suspect it is this person. They have said it will happen at work with a knife. My employer is doing nothing. My question is this. If the police investigation cannot prove "beyond reasonable doubt" who is responsible, will I have enough for a civil case with a diary of incidents and a file full of emails to my manager that went unanswered? This harassment started since the report was made. Nobody else has an axe to grind with me. Many thanks for your help
  16. Hi, I successfully used this site some 5 years ago to reclaim bank charges, (THANKS ) I was just wondering, does the six year rule apply to PPI? I took out a loan for just £800 with Lombard Direct at least 8 years ago (Could be more than 10 years ago). They automatically sent me a credit card (which I didn't ask for) and I used it up until a couple of years ago, until Lombard passed over to Bank of Scotland and they cancelled my card, as it had a zero balance. My account is closed, and I have no paperwork for it. I've looked on this site for details as to whether I am eligible to claim, as they included ppi without my asking for it and when I tried to cancel it, they kept referring me to another department, which never answered the telephone, so I was never able to cancel it. I don't know exactly when I took out the loan. I don't remember when they cancelled my card (although I believe it was perhaps about 2 or 3 yrs ago) and I don't have any account numbers or anything. Am I a lost cause? Thanks for any help you can offer x
  17. yes I know. that's what makes this mess all the more unreal. We just could't believe it when this demand arrived.
  18. Yes I thought that too, but after talking to Wescot, [ which I thought were very intimidating and threatening ] they asked for £50 per week from us, after telling them we were pensioners with only a state pension, it still made no difference, so feeling forced into a corner, i offered to pay £10pm still they were'nt happpy, they wanted more, i just don't know what to do next. Any ideas?
  19. That's not strictly the case. The account appears to have been overdrawn when we thought we had closed it. There were no attempts made at DDs after we moved account, and we had no correspondence from Natwest for 3 years until now. There were no statements or anything. The balance now is due to "interest" on the overdrawn amount, not bank charges. They have not made any charges for unpaid DD or standing orders as they are all transferred to my new bank account.
  20. My husband and I had an account with Nat West over a few years. In 2006 it became overdrawn, although we were not fully aware of how much. Soon after, we transferred our banking to Abbey National, not realising that the NatWest account was still overdrawn. We thought we had closed the NatWest account. This month, we received a letter from Wescot Debt Collection agency demanding the overdraft be paid in full within 10 days. It is now seriously overdrawn (over £2000) due to interest and we don't know what to do. My husband is 76 and in poor health and this situation is not making matters any better. Any help you can give would be greatly appreciated. The bank have provisionally agreed we can pay it off gradually, but I don't know what we can afford. Many thanks
  21. If it comes to it, we'll all meet you outside the courthouse and kick them in the shins 'till they give in!!! You can't lose, mate. Keep going, they REALLY ARE trying to wear you down!!!! XXX
  22. Well, for those of you who were kind enough to follow my thread........ I need to update you. All money was refunded. I drew it out. A week later, they slapped the usual £28 charge at end of May for being over in April. I wrote and they ignored me. Just as I was about to send my LBA, a letter popped through my letterbox. It said (roughly) that because the charge was incurred during the time the court claim was running, they will refund it. HOWEVER, there is a further charge due to come out at the end of June - which they will NOT refund and "because my account has not been managed satisfactorily" they are taking steps to close my account. That charge was incurred because I was overdrawn in May, BEFORE they refunded my charges. I HAVE NOT exceeded my agreed overdraft limit again! (I may have gone a few quid o/d when a small bill was paid, but other than that - my CHB still goes in every 4 weeks! I know I can report them for this. As far as I am concerned, just because I withdrew all the funds - doesn't mean I'm not managing the account satisfactorily. Anyway, it's MY ACCOUNT! I'll manage it any way I pretty well damn like!!!!! I'M NOT BOTHERED IF THEY CLOSE THE A/C NOW, BUT I DO WANT TO TAKE MY COMPLAINT FURTHER. Please help........ xxx
  23. Rooting for ya mate. You've really had to go to hell and back with your case, and I just can't wait for it to be all over for you. Good luck. x
  24. Well, to be honest, I have written a DPA request to Creation, but haven't posted it yet. I don't have my account details - and have written it with my name and address details hoping they would be able to track it from there. The account number changed when GE money took over the card. I seem to be doing the work for everyone lately, and I'm losing all heart!! Since retrieving my charges from Halifax, I've had my brother coming round / phoning me asking me to do all his letters for him, although he got himself in a right state. Left a bank account dormant for MONTHS with an overdraft of £700 (£200 over the limit) an then decided to go after them for refund! I'm having to deal with his solicitors letters and everything now. Then my husband decides to "write" to the Nat West - although I am doing all the writing and sums.... Then mum comes in wanting to reclaim HER charges.... guess who's doing all the leg work???? I feel a bit bogged down, don't know where I'm up to with it all. Rant over. I will post the DPA to Creation, but it's all DOING MY HEAD IN NOW!! Thanks for your support guys. x
  25. Well, he's filed his court action. He received an initial offer of £95, then a second offer to refund £200. Court action was initiated on Sunday 4th June. He had no further letters from Blair Oliver Scott since telling them the amount was in dispute and that he is prepared to pay it off once the matter is resolved. Wish him luck guys! x
