  6. john boy 999, Your claim is very very serious as compared to my paltry £361. I sympathise with your dilemma more than my own, but perhaps we can view the position as a matter of principle, and go on, but you've have much much more at stake than me, if you were to fail. let's wish each other good luck, and see if we can both come to a decision that will satisfy our concerns about going on or not.
  7. Hi Bankfodder, What if the data arrives under the DPA by the time the 40 days expires? Is the position still valid that they used the data against me to base an offer, before I had chance to check the charges under my DPA request? Sorry whats a 7 day LBA? What value do you attach for contractual failure? They may not fail in their contract to supply the info by the end of the 40 days. Would this still be valid?
  8. They've offered me around 50% of the charges levvied. This is before they have sent me the statements under the DPA request with 5 days left to comply. Reading around tonight I get ups and downs on whether to accept or not. The story about being offered £1200 when a court case was filed was a spur, but I'm still unsure what is the most cost effective route. Any words of encouragement to go on or advice to accept would be greatly received.
  9. Called up the Customer services team armed with the advice from Bankfodder. They're standing firm on the offer. I' ve asked for the info regardless, and they will comply with the DPA request. I asked them about the formula to calculate the offer. They said there isn't one. It's an arbitary figure given in offer to the highest most recent charges (the last 6 months was the scope). I'm interested to see the last 6 months, because i know for sure the only charges in the last 6 months have been in February, and these totalled £90. They will still refund my £10 for the DPA request, because th
  10. No point going back to '95. Contract law says a maximum of six years. Only ask for the info you really need to make the claim stand up in court. Start at 2005, and concentrate your wrath!!
  11. He's alive and well in Yorkshire. Judging by the number of branches he works from, it's no wonder they charge such ridiculous fees. Must be just to cover his travel expenses. My 7 year old also has a better signature. It needs work......

  13. He's also active in Yorkshire. Just had a letter from him at the start of March. Judging by the area our "Personal banking Services Manager" covers, and the branches in which he works, its no wonder the bank have to levvy the charges they do, just to cover his travel expenses. I suspect he's not on the minimum wage. By the way, my 7 year old has a better signature.
  14. Maybe you could request your statements rather than a Halifax data sheet. It may help you understand where the charges are.
  15. dear richard C Thanks for the advice. I think I'm entitlked to a further explanantion on how they arrived at £178. Overall, it's not a huge amount of money to get back, and I'm dubious about the full charges, as i can't confirm them. This is a matter of principle now. By rejecting, do you believe this would go against me in court, as not accepting an offer made by them? I will call tomorrow and request the full info while i consider my position, as well as put the request in writing, as per bankfodders advice. thanks again.
