    • If that was the reason then that is good news. The whole reason that being able to charge £100 for breaching private car park rules is because the law Lords decided in a celebrated case that the rogues had a legitimate interest in keeping their car park spaces available for all motorists . {parking Eye v Beavis]. However when the business is closed then there is no legitimate interest in keeping spaces free so to charge £100 is a penalty. As such any Court would automatically throw out the case when the penalty charge is accepted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear All,

 

Need some advice on this issue as I don’t know what to do next...Here's the situation.

 

I parked in a EuroCar park next to a Co-op and I'm sure you can guess what is coming..... I’m very used to seeing EuroCar park signs at supermarkets and they all tend to apply to non shoppers so when I saw EuroCar park next to supermarket I didn’t really research whether it was applicable to me. It was a mistake I know but I was only popping into supermarket and the signage was pretty poor.

 

After less than ten minutes I return to the car to find a ticket on there for £50!!! (£30 if you pay within 2 weeks). The car park costs 20p for 2 hours so i’m sure you can understand this mammoth fine came as a bit of a shock!

 

I don’t have the issue with a fine as I was clearly in the wrong, but my issue is the amount of the fine in proportion to the fee in the car park. Would I be right in thinking that as with the bank charges that penalties have to cover the "costs" incurred by policing and administering parking fines and that a company cannot profit from penalty charges?? Can a car parking charge be deemed unfair?

 

I have written to EuroCar parks saying basically the same things and have had no response after 30 days. I really believe that this fine is unfair and any advice would be greatly appreciated.

 

My primary aim is not a refund but really to stop car parking companies from charging whatever they feel like and profiting greatly from it.

As it is a private company and you have entered a contract by entering the car park, then the same regulations as the bank charges apply.

 

You should expect to pay the 20p plus any costs fro the PCN and the guy placing the ticket. I estimate 38 at most.

Dear Mike,

 

I too have had problems with Euro carparks. In that I work for the railway and parked on rail property at my local station displaying my staff pass I was fined £80 reduced to £50 after contacting Euro carparks themselves, carpark appeal bodies, CAB (Citizens Advice Bureau) & my local MP. As soon as the latter was on the case things started being resolved asap. I must say I found the whole longwinded process very stressful but at least it's now resolved. I'd be interested to know if you can claim them back.
