Yes, if the account is with the same banking group they can 'offset' one account against another. It was discussed in this thread on the 9th of January if you look back...

Please don't take this as any attack on you personally, but I'd like to add a note for anybody new who finds this thread and wonders what went wrong.

 

It is very easy to find CAG and take some advice on dealing with a debt, sending letters off to the debt collectors and stopping them in their tracks. Sometimes it can backfire if you've not fully understood the implications. In this case the bank has had the matter referred back to them, realised that there was some money in an associated account, and have taken that to repay the debt.

 

Yes they can do this, it is in the terms of the account, and I have also suffered a similar thing in the past so can speak from experience. The advice given was to open a new account and make darned sure they can't take money from a linked account. Obviously, things happened a bit too quickly here to have done that, with a bad result.

 

Although people on CAG will try their best to help, you must remember it's mainly a self-help group and the helpers expect users to find out some things for themselves too. Once you start taking action, make sure you read LOTS on here and fully understand what you are doing.

 

In the meantime Xeon, make sure you get your charges claimed back fast!

Had a desperate plan but dont think it would work out. Could draw out my money back using the overdraft facility then send them a CCA request for this.
