Hi

I was travelling along shaftesbury avenue london and wanted to turn left, there was not a no left turn sign but just a blue straight ahead arrow the car in front of me turned left so i asumed that it was ok to do so. Unfortunately i was filmed on cctv and was obviously in the wrong. I am a single parent student nurse and am struggling financially as it is does anyone have any ideas to help or do i just have to pay up???

It was truly a genuine mistake.

Indeed - and ALL of it please. Host on 'tinypic'.

 

As I have a Westminster MTC one in front of me right now i can tell you that there are flaws.

 

On this type of PCN there is no facility for informal challenge. It's a one shot ;formal representations' situation - so important to know what you are doing.

 

Pics of location and all signage would help.

I also only have 14 days to appeal and the date of the PCN is 22nd october even though i didnt get it till 29th

i have just checked the road maps etc.. I was driving down a one way street called BLOOMSBURY STREET there was a blue arrow on the traffic lights pointing forward and i followed a car in front that turned left into SHAFTESBURY AVE.

 

My PCN states.

The council believes that a penalty charge is payable with respect to the vehicle with the registration number shown above following an alleged traffic contravention:

FAILING TO DRIVE IN THE DIRECTION SHOWN BY THE ARROW ON A BLUE SIGN (PROCEEDING IN THE WRONG DIRECTION) IN SHAFTESBURY AVE???

 

Do i have a case seeing as they said that i was in SHAFTESBURY AVE???

It's hard to tell from google earth if that turn looks legal. I presume you were heading North on Bloomsbury St with a contraflow bus lane coming against you. The left turn into Shaftsbury Ave at the yellow box junction is more than a 90 degree turn and it isn't unusual for such turns to be banned.

 

Shaftsbury Ave clearly appears to be a 2 way street though, so your best defense may be to check the signage on Bloomsbury to see if the left turn is clearly signposted as not been allowed, then possibly to claim "the contravention did not occur" as I fail to see how there can be blue direction signs in Shaftsbury Ave as it is a 2 way street.

From what has been posted so far, there isn't a "no left turn" sign, only a blue arrow pointing upwards. These can be posted at any junction - they are not limited to one-way streets.

 

The meaning of this is "straight ahead only".

 

Ting is on the right lines - contest the validity of the PCN, rather than the validity of the reason it was given.

I can't answer your questions without seeing the PCN. I cannot advise you based on the version in front of me which was issued back in July.

 

You've asked again how to post it up. As has been said - host it on tinypic, it really isn't difficult.

 

On failing to follow the sign - i agree with others, probably nothing in it but again without pics can't really say.

On the location, possibly some mileage but what the PCN actually says and pics to show where you actually were are crucial. Hace you checked the video?

On this one perhaps you'd like to consider how odd your comment is considering what i've just done - i just clearly explained the same to the person who PMd me uninvited and i repeated the PM back to the entire forum. the OPs response confirms this! - How can you fault me when i've not just obeyed the rules but gone out of my way to help someone else understand? You've actually just explained to me exactly what i explained ^above^ to the OP???

If you have some doubt then perhaps you could confirm the facts with 'corcoran1' because you clearly haven't done so far.

 

i have only dealt with one case from here in private. There was a simple reason. The thread had degenerated into a slanging match with which i certainly wasn't initially involved. I PMd her out of concern and she said she had been disappointed in that state of affairs. For the record i slam dunked the case for her at formal reps stage. The only reason the result has not yet been publicised to other members with details is because she isn't currently available - i do not feel it my place to announce or describe that.

Actually i'm quite incensed with that! It is so inaccurate it's insulting.

I have now checked what a naughty boy i've been - NOT.

 

There are only 25 PMs if I include both in and out. 22 are discussing the weather or close to it! Just 2 refer to the case i mentioned above and one more refers to the same case where i confess to offering to assist with a case at the same location as the one already mentioned but this turned out to be unnecessary. i thought it reasonable to kill two birds with one stone and the circumstances of the 'deteriorated thread' case would have been the same.

 

If someone is referring to a post I made yesterday then clearly they and you either can't read or just don't trust - an element of both is needed on forums IMO.

 

I said to a member that i would PM them later yesterday evening. I made a post that indicated i could not discuss this because it was so serious.

I did not PM them but clarified something further, on the forum, which indicated my situation was only vaguely relevant.

As i said the matter is serious. Now, would your curtain twitcher like me to blurt out the details of such a serious issue that it will possibly be reported to the Police as a matter of deliberate fraud in public office or would they like to mind their own business and exercise that funny old thing i mentioned earlier - trust - or better still, concentrate on helping people.

 

If anyone would like me to post the entire contents of my PM in and out boxes please do ask!!!!

I too received a PM from the OP and I responded much as Ting did by inviting the OP to post on the open forum so that the collected wisdom of all can be collated and used.

 

I think it is a bit off for a Mod to have a go at someone helping via PM.

 

BTW although I recommend using the open forum there are times that I will respond to a PM with advice - usually if there is a PPC involved - given the trawling that goes on. I'm not going to stop that practice - although I may use an alternate medium such as a public webmail account.

 

I heartily endorse Ting's actions and suggest that an apology from Martin3030 is in order.

As I said, there is a flaw on the PCN (potentially enough to win) but I could do with seeing the back as I said.
