    • Good morning all, No further communication with P2G so now submitting my small claims action. Would be grateful for any feedback on my description of claim before I submit later. The defendant in this case is Parcel2Go Limited The claimant sent a parcel using Parcel2Go Ltd as a broker and Evri as the shipper containing two handmade bespoke wedding trays to a customer with tracking number P2Gxxxxxxxx. The parcel was never delivered although the defendant stated that three attempts had been made to deliver the parcel.  The claimants customer waited in for four days to receive the delivery but no delivery was attempted. There was no communication with the claimants customer.  Despite many web chats and emails the parcel was not delivered and on the Parcel2Go website it stated that the customer had refused delivery. This was not true as no delivery had been attempted.  I was informed that the parcel was being returned to me but after waiting three weeks was informed by Evri that the parcel was lost. I was offered compensation of £20 + shipping fee which I refused and after sending Parcel2Go a Letter of claim this was increased to £75 which I also refused. It is clear that the defendant is responsible for the loss of the parcel as they did not act with reasonable care and skill when handling the claimants parcel, contrary to section 49 of the Consumer Rights Act 2015. The claimant therefore seeks £370 in respect to the value of goods plus court costs. I thought it might be better to use the CRA rather than the Supply of Goods and Services Act as we are sole traders - is this correct?

    • Hi, I am aware there’s been few threads about this already but just wanted to confirm information on my case. I was with Village gym last year(2023) on initial 6 month usual contract they do, I lost my job and due to that I couldn’t afford to pay for gym nor I had any motivation to go to gym at that time so they sent me arc phone message in September 2023 that I owed them £140 so I paid them back on instalments in 2 months time.  Then I started receiving new years deals in December 2023 and I decided to give them a call but they never mentioned anything about 6 month contract or anything, only that it would be monthly rolling contract and I paid them for 2 months and then I realised both months they charged me £59 instead of £38 they offered me on the phone when I mentioned that I am still student, even though before I was paying £43 a month in mid 2023. I spoke to gym entrance lady and she said I should give a call to gym on the phone number so I did and whoever answered said they’ll pass my info to manager and he will give me a call back in 24 hours, of course no one called me back so I called again and they said same thing. And of course once again no one got in touch with me so I got tired of them charging me more than they should and decided to cancel my direct debit and stopped going there as I got new job with rotation shifts which is not good for me as I cannot visit gym after I finish at 10pm every second week.  And now in April I received arc message saying this :  Also they have my old flat address where I used to live. What is the  best thing to do for me please? Thank you!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

My father has two debts which have been sold to HFO Services. When the debts were first passed to HFO they contstantly rang him at all hours of the day and even at work.

 

We sent them the harassment letter that we found on this fourm and the calls stopped.

 

We then requested the CCA for each of the debts. We received these however one of them was photocopy which had been shrunk to less than half of the original size and most of the T&C's are illegible.

 

For the illegible CCA we wrote back to them asking for a copy that was readable. For the other other CCA we wrote back asking them to freeze further interest charges, take accept a monthly payment that my father could afford and for themto send a payment book.

 

We sent these letters by recorded delivery every month from notification of the debt September 2007 and have never had written communication back. (The last letter we sent in February).

 

Then last week the phonecalls started again. The caller was from India and said they would not communicate in writing as it takes too long. They also said the only way they could accept payment was via direct debit. They would not tell my dad what the statement of accounts are so we have no idea how much interest charges they have addded to the original debt.

 

Please can anyone advise what my dad should do next?

They are being unreasonable IMO....it is a very reasonable request for you to ask for everything in writing.....I would send them a LETTER BEFORE ACTION about the harrassment, and either (if you have the resources) take them to court, or report them to the FOS, OFT and TS, and your MP also....

 

Also does the CCA they have sent (not the one that is illegible) have the prescribed terms on it ?

Can you scan your Dad's copies of what they call CCA's and upload them on here so that they can be checked for you.

 

I agree with Havinastella, don't pay them anything and send them the phone harassment letter again.

 

In the meantime, when they do ring, refuse to answer any security questions, or if you know it is them calling, ignore the phone.

 

Your Dad might need to send a S.A.R request to them to get copies of all details on the account.

 

I am sure somebody will be along to advise you further soon. :)

Does your dad need to keep that number?

If only the family & a few friends phone you can get a new number for about 30 quid & have it XD.

 

Your friends in India will soon find a pen then lol.

 

TOP TIP : Try telling the phone company that the last two numbers when reversed are the local taxi company & your father is getting calls at 2am from drunks trying to get a lift home.

 

They might change it for you.:wink:

BT changed my number for free about 6 months ago.

 

I just explained to them that I was getting "marketing" calls all the time.

 

The truth was I was being hounded by crap1, towards the end we were getting 20 + calls a day.

If you have already sent the harassment letter then it's quite simple.

1. Keep a log of all the calls.

2. Pop down to your nearest police station and lodge a formal complaint about harassment by the DCA. Take the log with you as well as a copy of the letter (and proof of posting if you have it).

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

I quite agree with Palomino....if they say it is a 'civil' dispute, then ask for an appointment with the most senior officer at the station, Harrassment is not a civil matter, it is a criminal matter....

Actually the police are fairly hot on harassment because of different circumstances : stalkers. You're unlikely to be brushed off.

 

In saying that of course, all the police are likely to do is ring up the offender and tell them to be good boys and girls in future. The offenders most likely will behave but it's most unlikely that the matter will ever get into court.

Whatever you do DO NOT set up a direct debit as the company can change the amount and date whenever they want.
