    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hey all...

 

After i sent the last letter to red debt, i got a letter from Lowell, saying "despite trying to contact me i have not been in contact" then demanded i phoned...well i ignored this as their 1st letter said i should address all my letters to red debt and not them, fair enough. but today i have received a from red debt letter dated 10/11/08 demanding that i phone them and arrange something or they will either use a licensed "home visit agent" or start legal procedings. They have also made it out that i have not been in contact what so ever...

 

What the hell are they playing at??? Can someone please help

Fogy - its just the same old nonsense you will get from them in each letter saying that you have not done this,that & the other & how they will do this,that & the other - they will not do anything at all & you will not see any of their "field agents"

Ring them up if you want & either tell them to take you to a county court or get lost, they wont coz it will cost them money to do so.

They are full of hot air & have no power/authority over you whatsoever.

It is similar to a "speak the answer" machine which can only say the word "six".

 

Ask it what 2+2 equals, it will say "six". Ask it what the square root of 100 is, and it will say "six". Ask it what the capital city of Austria is, and it will still say "six".

 

Very occasionally, someone will ask what 3+3 equals, or what the square root of 36 is, and the machine will appear to be intelligent!

 

So it is with the threatagram machine. It spews forth its meaningless drivel unencumbered by human intelligence, and the words printed on the paper have only a casual relevance, if any, to any events which may be happening in the real world.

 

Should the machine reference anything which does actually exist in the real world, that is, as in the above example, coincidental.

back once more..and i gotta say, i love lowells persistance.

 

Just got in from work and i had a card thru my door saying that they were trying to contact me. Looks like they sending these "field agents" out to my house now....Anything that can be done about that?

In the meantime..just bin the card or use it for whatever you see fit?

The card wasnt from a Mr J White or P Brown by any chance? :cool:

With due respect Fogy you've been told what is what by all the replies on here & it doesnt seem to be sinking in (apologies if im mistaken there) - so i advise you to hide all your household furniture right now coz they will around any minute now to remove everything :p

These "field agents" are spies which operate on farmyards. If you are quick, you can see them diving into the cowpats to hide their surveillance equipment.

 

Did this card have a postmark on it? Anything to suggest that it had been through the postal system? If it has, then it probably breaches this -

 

OFT guidance 2.6 (j)

acting in a way likely to be publicly embarrassing to the debtor either deliberately or through lack of care, for example, by not putting correspondence in a sealed envelope and putting it through a letterbox, thereby running the risk that it could be read by third parties.

 

Anything which can be used in future complaints is useful, so keep hold of this.

 

If you feel like wasting a stamp, you could send them this -

 

"Should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you or anyone representing you.

 

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance."

 

Alternatively, you could use the stamp to send yourself a Christmas card, and email the message to the Leeds Losers.

Lowells Licensed Field Agents are imaginary. They only exist in Andrew Bartle's vivid imagination. Their is no such a thing as a ''Licensed Field Agent''. Its a silly little ploy of The Leeds Losers to get you to telephone their Telephone Threat Monkeys at the Leeds Threat Centre. Keep the card which IOm sure was similar to this one

As for the bit in Scabhunters letter above all you need do is remove the word English and just refer to Common Law.

Well after another letter 2 weeks ago that i ignored i now have a letter from a law firm named "Hamptons Legal" saying that i have 7 days to contact them to set up a payments plan or to settle or they will take court action against me. Also saying that if the latter happens then they will add on charges for this action...

 

Please help once more, i really cant afford more money on top of this bill

I'm assuming you already know that Hampton (Il)Legal is just another desk in the Clownell office?

 

All they are doing is moving a piece of paper from one desk to another, trying to make out that they have "escalated" the account to a more fearsome outfit.

 

There is no greater chance of court now than there was before.

 

I would ignore all meaningless threats - you have asked for proof and they haven't provided any. Until they do, what makes them think you should pay them money?
