Could anyone tell me if i have grounds to appeal this parking charge notice given by a local borough council.

The notice was attached to our car which was in a CPZ in a parking bay with restrictions of parking for one hour then no return for at least an hour. Our car was blocked in at both front and back and moving was not possible without damagingi our car and the other persons.

 

My confusion as to the validity of the the ticket is that it clearly states that it is a Parking charge Notice, that an offence has been committed and that the fine of £60 is to be paid in 14 days or action may be taken in the magistrates court. The council website clearly states that the only parking tickets to receive discount for prompt payment are those issued in the pay and display car parks this was verified by a lady in the council office

it says 'fine' and not 'penalty' ??

we need to see pictures of all of the PCN - suitably washed of your personal details.

the discount period variance also sounds very weird.

 

you can and should safely ignore what ANY council person tells you about parking charges, especially when done over the phone.

As indicated on the reverse, PAYMENT must be made within

fourteen days, otherwise proceedings may be commenced

in the magistrates court for the offence. This may lead to a

criminal conviction and an order against you to pay a fine

together with the charge of £60 and the councils costs.

 

Payment may be made by post using the envelope

provided. Cheques or postal orders should be made payable

to East Riding of Yorkshire Council. Please write the Parking

Charge Notice number and your address on the reverse of

the cheque. Cash should not be sent unless by registered post.

 

Payment in person may also be made at any EAst Riding of

Yorkshire Council Customer Service Centre (Monday to

Just a few general comments. This has been issued under the Road Traffic Regulations Act 1984. Any action top enforce this ticket by the council will be in the magistrates court.

 

You should check that the Traffic Regualtion Order is in order. The dates, times it is in effect should be clearly stipulated and the location.

As OH works nights and I am unable to get to the council offices 20 miles away to check out the regulations then I guess we'll just have to pay the fine and put it down to experience as our 14 day limit is almost up.

 

Just one thing how can this council only give you 14 days to pay when other places give you 28 days

No OH didn't think to take photos, butthe car in front of us arrived just after we'parked up and was still there when we were ticketed but there was no ticket on their vehicle or on several others further down the road without residents permits
