    • Paint is a free programme on any Windows PC. But don't worry, the choice here is not either perfection or nothing. As you say, use your scanner, save the file ... and then use the "choose files" option when you post to CAG to add the file. We can do all the redacting and converting to the correct file type at this end.  The important thing is just to get the info to us. Why not do an experiment this afternoon and see if the above works?

    • Asset Link filed for a default CCJ against me, in relation to an old Barclaycard debt which I apparently signed an agreement for back in 2000.   I did not own a Barclaycard in 2000 so I know this is not true.  The CCJ notice was sent to an old address so I did not receive it.  Years later when I found out about the CCJ when I applied for credit, I put an application in to have the CCJ set aside.   As part of the set aside case, I was asked by the judge to provide a draft defence, should the CCJ be set aside.   The defence I provided was that I did not admit to the debt as I had not been provided with any evidence of an original loan agreement.   I won the case and the CCJ was set aside.   Link then filed to court again to make me pay the debt.   We both filed directions questionnaires and the judge allocated the claim to the small claims track.   As part of the directions, additional directions given were as follows ' Additional Directions in a claim for an Assigned Debt - Because the claim is in respect of an assigned debt the Court makes the following directions for the management of claim.  The claim shall be automatically struck out at 4pm on 3 April 2024 unless, before that time, the Claimant delivers to the Court and to the Defendant the following documents'  It then listed various documents such as an original agreement, deed of assignment, notice of default, statement of account setting out how the alleged debt accrued under that agreement etc.     The Claimant failed to provide these documents within the deadline provided and instead I received a copy of a bundle of documents provided by them in preparation for the court date, this was received weeks after the deadline.    I have called the Court to ask if it has been automatically struck out and they advised that it is not automatic and that I should still send my witness statement by the deadline provided, which is Wednesday.  This does not give me much time to prepare my witness statement.   I have never done anything like this before and I am unclear what my witness statement should include.  My thoughts were that I should keep it simple and stick to the facts, like the fact thy have not provided evidence of the original agreement, or the deed of assignment of the debt.   They have provided a copy of a default notice from Baclaycard dated 2015, this states a figure of £550 but the debt they say I owe is £10k.   I am not sure what makes a valid default notice?   I have previously requested proof of the debt from Barclaycard directly and have evidence of emails between us where they have been unable to provide me with the agreement or any documents at all relating to the debt.   Should I include these as an appendix?  Are there any other documents I should include in my bundle?    I have also tried to mediate with the claimants, to save the court costs and time, on a without prejudice basis, but the claimants solicitors refused to mediate.   Should i state this in my witness statement too to show the judge that I have been reasonable and they haven't?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It'll be funny when some cretin from this board has their backside caned in court by CPS

 

My first reaction was to say "Don't hold your breath waiting for that Clifford" but now I am having second thoughts....

 

I am sure the board would relish the oppportunity to take on CPS in court. It won't happen though as a board defense will be a proper defense and CPS will not issue real papers in the face of that prospect. If they were mad enough to do so then once they received the defense papers that would be the end of it and they would not turn up. as per usual with PPCs and a proper defense.

 

I write not for you Clifford but for the general readers here. Which PPC(s) are you ? give us a list of your car parks and we can cause a case to happen if you want... (yeah like thats going to happen).

I have been doing some digging and I came across a thread on here that is from early in year and a member stethomas seemed to have a ticket by CPS and from reading a user called legaladviser looks to have gotten involved.

This looks like it went to court but not been updated for ages, I see legaladviser does not post anymore nor does the poster but I see a legaladviser on pepipoo, anyone know if its the same person ?

I get an email everytime someone replies so hopefully they do as well.

 

Looking at the topic, it was very emotional so I would have thought it would have been updated on a result by either party on success, unless it is still pending.

Looking at a invoice used by Combined Parking Solutions contained within the PDF file on its website.

 

"Unauthorised removal is an offence" what offence is it? Only offence I can think of at the moment is 'Vehicle Interference' and then surely placing the invoice on the vehicle would also constitute vehicle interference also.

Unauthorised removal is an offence.

 

Only thing I can think of is theft of the ticket itself - of which there is absolutely no chance of the cps running for something so trivial.

It is not an offence of anything nor is authorisation relevant.

 

(except the case of offence being used in the sense of causing anger/annoyance - for the PPC !!)

 

The envelope is mimicing official council tickets - especially with the police style chequered border.

There is legislation about that.

 

We really must find a CPS monitored car park....it looks like the rest of the paperwork/papertrail will follow suit. and if he relies on that legal opinion he publishes on his website then much fun can be had.

But he wouldn't turn up despite his bravado and front.

Can't be theft if the person that removes it doesn't have the intention of permantly depriving the owner of it.

 

ie; Removing it from a vehicle, and drops it in the bin next to the vehicle,

 

Also who is the owner of the invoice once it is placed on the vehicle?

 

Another note on this, to place the invoice on the vehicle someone usually lifts the wipper to stick underneath.

 

Section 22A of the Road Traffic Act 1988, inserted by the Road Traffic Act 1991

 

22A(1) A person is guilty of an offence if he intentionally and without lawful authority or reasonable cause -

 

(b) interferes with a motor vehicle, trailer or cycle,

 

Same with wheel clamping, surely this must have been challenged?

I have to say with people digging up months old threads, in some weird attempt to get them back to life, and more PPC trolls than you can shake a stick at I'm not surprised people don't post any more. Is it just me or does the behaviour of "scottish mark" become stranger by the minute? Earlier he said he would leave it at that. If only he would. It's like a bad case of Groundhog Day (set in Oldham).There appears to be some kind of attempt ongoing to discredit members of this site and Pepipoo, which appears to be orchestrated by CPS. Why does a PPC which is sure of its legal position need so badly to discredit its opponents? It is a pity that it has come to this on CAG. With so many trolls about no-one can be sure who is who any more. Or perhaps that is what the PPCs want.

The photo on their site is weird, I have to say but the story behind it is quite amazing.

If you type in the individuals name or his 2 user ids they appear at the top of google, that's also weird !!

 

Is it just me that finds it more than a little distasteful that Perky has gone to the trouble of using Google Adwords to get a sponsored link for anybody searching a forum username? What an odious, vindictive little man.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

Is Combined Parking Solutions registered with the ICO? - Reason I ask is that I have searched at Information Commissioners - Data Protection Public Register but it returned no results, just curious thats all.

Sidewinder, you are far from alone with that view. But then someone who by his own admission goes out of his way to get someone fired from their job(apparently rather then taking the case to court as he so often brags) clearly has some fairly major people issues. Nothing would surprise me about that outfit. And he wonders why people ignore him and his associates when he comes on here. Anything this lot say should be given the total lack of attention it deserves.

You seem to have an issue with my Geronimoman I am not sure why but if this is some childish attempt to hijack threads or engage me in an insult game then it will not work, you can accuse me all you wish of being a spokesperson of a PPC but you are very very much mistaken.

 

As for the posts on the PPC website, I must say that if it is true (and as it has been there for some time without being removed we have to presume it is true) then the inidivual concerned deserved to be fired.

 

I may be old fashioned but any person working for the police should be beyond question and this individual has seemed to have abused his power in a way that is beyond comprehension.

 

This site is all about standing up for what is right and the police force did the right thing by getting rid of this 'loose cannon'. (if the story is true)
