Well, to bring you up to speed, after doing the spreadsheet I worked out that (with 8% interest) they owe me £1518.57, I sent the first letter off on Sunday 25th June and finally received a letter today (Our charges are fair, blah blah blah, yeah, like £192 for a returned DD is fair!!!), so according to MSE it's Moneyclaim time!!! :D

 

However, I'm just a little stuck, I'm at the Particulars of Claim section and I'm not sure what to type in this box (I've added the interest claim bit though, that was easy), so I could do with a bit of help from experienced people (I.E. Who have won against Lloyd's the S**ts Bank)...

P.S. I always knew that these charges were unfair, but until a friend pointed me in the direction of MSE I never thought I'd get my money back, so MSE and this forum have been a great help and one hell of a mood improver!!!

1.You do not add the 8% interest until you submit a claim at court

2.You should send the LBA before you go to moneyclaim

3. That's lucky, now you can do 2

 

4. Please read the FAQs and step by step guide. It won't affect me if you don't know what you're doing, but it sure as hell will affect you.

Well, I'm on Step 3 now, the second letter was printed and sent off today (with a few personal additions & alterations of my own), so lets hope step 4 isn't needed (but I would like the extra money though... ;) )... :D

Sorry - should have said earlier, the LBA should be sent if they don't respond within 14 days, or if they respond negatively. Unfortunately, it's the case every time with Lloyds, it seems. Good luck with the claim though :)

Well, I consider a standard letter with a bundled leaflet as a negative response... :D

 

Let's just hope it doesn't get stretched out for anymore than 14 days though, I have bills to pay and a NatWest account to open...

Just out of curiosity, do they pay up in less than a week or do they wait till the last day?

 

I only ask as there's a 2CV I have my eye on at the moment and they want £900 for it... :D

Unfortunately they normally leave it to the 11th hour to pay up :(

If you allow 3 months from start to finish then you wont be too far off with Lloyds.

You'll get a standard reply to your 2nd letter. Then you'll submit your moneyclaim, then you'll do an allocation questionaire. Lloyds will submit a defence then probably make you an offer with conditions attatched. If you refuse the terms this will take another few days, if you do accept the terms then you'll have to take an account review before they pay up.

I know this isn't the news you want to hear mate but Lloyds will not just pay up 7 days after the 2nd letter.

This may need tweaking to fit.

 

Claimant has account (A/C No) with Defendant from (Date a/c opened)conducted on their standard terms and conditions. Claimant is claiming the return of (£0.00 = amount claimed) taken by Defendant in charges over (X) years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e.

In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount claimed x 0.00022).

Hmm, house sitting tonight...

 

Anyways, got the details in, all submitted, then hit yet another problem, I don't have the required £120 court fee, are there any ways aroung this at all? I'm currently receiving Income Support and Housing Benefit*, and I noticed that people on benefits can claim without the need to pay...

 

*Injured back and severe depression (Lloyds TSB and their overcharging charges being one of the causes) prevented me from working for a year, going back soon though...

You need to get the EX160 exemption form, from your local court. Fill it in and take it back along with some kind of proof of your I.S, like a recent letter (no more than 3 mths old). The court will photocopy the proof and you can hand your completed N1 in at the same time. When I got mine, all the forms I needed came in an envelope all together. You can't claim exemption online.

Sneaky sods, I was waiting for the 8th as nothing had happened so far, then checked MoneyClaim on the 9th (as on the 8th it said that the bank had not done anything yet) and it said the bank has entered a defence!!! They're as bad as me, doing things last minute and all... :rolleyes:

 

Anyways, got the questionaire, need to get it filled out and sent in (with the additional fees (glad I'm working!!!)), so then the bank really knows I mean business... :x

Errm, help!!! I started the questionnaire last night, but got a bit stuck...

 

Witnesses - Do I need any?

 

Experts - Says on the back that I don't need them unless they court specifies to do so, so that's ok...

 

Hearing - I should be fine to be there in the next 4 months

 

Other information - Now this is the really sticky bit, do I need to add anything to here? Something to help me in this case I guess?
