I am very new to all of this and wonder if any one can offer advice.

 

I have been trying to get some old debts sorted out.

I requested CCAs from all the DCAs and to date only one has provided a copy of the original agreement but it came some two months after the initial thirty days were up,, they have yet to provide the deed of assignment

 

 

I have a copy of the experian credit report it shows the original debt but no payments since 2002 against the debt and no mention of the DCA who has been collecting money supposedley for 5 years iro of this debt

 

What shall we do next, I am not convinced they have the authority to collect this debt.

 

they were well out of the timescale for providing the CCA

can they enforce this debt.. In December i think this debt will go from the Credit Report

 

Does anyone have a suitable template to send them of a letter or any ideas what we can do next

Now that the DCA has what looks like the original CCA but have not provided a copy of the DOA or I think statement of account and the debt defaulted nearly six years ago

Do you think they will seek court action and what could happen if they do ?

After Posting On Here Last Night I Had A Good Look At The Cca

And Thinks Its A Fake

 

Its From Hillsden

The Writning On The Cca Is Very Heavy In Places But The Signature Is Faint And Hardly Legible And Its Not Dated

 

The Post Code Is Wrong And No Tel Numbers Are Given

There Are A Few Other Discrepancies As Well

 

What Should A Proper Cca Say And How Many Pages Should It Be

I Cant Scan It On Here At The Mo

There Does Seem To Be A Lot Missing From The Cca

 

In The Customers Signature There Is No Provision Fo A Date

Also The First Payment Seems To Be Due The Date The Agreement

Was Signed

 

And The Loan Protection Is Based At The Same Rate As The Loan

this is an excellent site and I have spent hours looking at the threads

my scanner is broken and i will have to wait to the end of the month then I will scan it on

 

I am convinced thinks are not correct on the CCA but would love a proper opinion from the experts

 

but a simple question

If a loan was taken out in 2001 and defaulted Dec o2 and no activity shows on the credit file against that loan even though a DCA has collected against it, should that be

You also need to find out the last payment on this account as it may be nearing or already statute barred.

last payment to the original credit was before Jan 02 as we have old bank stmnts

 

payment to the DCA we stopped Dec 07 as we are not convinced we should have been paying them

Have read on here as the CCA was before 2005 should the terms and conditions be on the same side as the signature

we werent sent any anyway!!

Photobucket is mentioned in the Dummies Guide Scott but not in detail.

 

Basically, you need to upload the document to Image hosting, free photo sharing & video sharing at Photobucket (you can either remove personal details first or remove them once uploaded although I never worked out how!)

 

Then highlight the IMG code (fourth code down), right click, copy and then paste onto your thread and it should come up as clear as a bell. I would give you a demo, but my scanner's not a happy bunny at the mo :grin:

to date I have had the Copy of the CCA and what I have paid DlC

 

they state there is no deed of assignment but enclosed copy of an account from Black Horse

 

I can spot loads of discrepencies and the signature I am sure is not mine and very weak

 

any advice most welcome please
