    • Have we seen your court bundle?   If we haven't then it's probably an idea to post it up here especially the index page and the witness statement so we can see if there is anything which might need adding or changing

You open the google maps app > click your profile picture > Click Timeline from the list > click today > choose the date you want to see the timeline from. Then you'll see your timeline for that day. Often, places you have visited will have a question mark beside them where google wants you confirm you have actually visited. You either click 'yes' if you have, or you click 'edit' to enter the actual place you visited. Sometimes, you'll see 'Missing visit' This probably happens if your internet connection has dropped out at that time. You simply click 'Add visit' and enter the place. The internet on my crappy phone often loses connection so I have to do that alot.   OK dx, understood mate. 
    • I have now been given a court date vs Evri, 4th Sept 2024. I have completed my court bundle, when am I expected to send copies to the court and Evri and should it be in hard copy or electronic? The Notice of Allocation states that no later than 7 days before the directions hearing both parties must send to the other party their final offers to settle. Does this mean I will have to tell Evri what I'm willing to settle? Rgds, J

I know it sounds super desperate but lets call a spade a spade here, I am super desperate: Dear Sir, On 29th November 2023 I took out a loan of £5000 with you. Unfortunately very early into 2024 I found myself in financial difficulty (unexpected bills and two episodes of sickness and the tax office getting my tax code wrong resulting in less pay for two months) and I contacted you (MCB) on 13th February 2024 asking if there was any way I could extend the length of my loan to 36 months. I fully explained why I was requesting this and asked for your help. I did not receive a reply to that email so I again contacted you on 7th March 2024 to advise you of a change in my circumstances which resulted in me having to take out a DMP and asking you to confirm that the direct debit had been cancelled. You would have also received confirmation of this DMP from StepChange but you did not acknowledge receipt of my email. I have only managed to make one payment from my loan but did try and contact MCB to discuss extending my loan, help etc.  I have now therefore fallen behind on several of my debts, yours included, and as a result you have lodged a Cifas marker against my name for "evasion of payment", which has resulted in me having to change banks, which has been an extremely difficult process because of the Cifas marker. I do not feel you have been fair or given me the opportunity to fully explain my situation to you before you lodged the marker against my name. I appreciate it is a business and you have acted accordingly, but I did try to make contact to arrange alternative arrangements and at no point, not even to this day, did I ever intend to not repay my loan. I cannot stress to you enough how much this has affected my mental health. I am having trouble sleeping and my existing health condition has been exacerbated by all of this. What I would like you to do is to please, please remove the Cifas marker and let me make arrangements to pay the loan back through a DMP.  Please sir, I am begging for your help here. I am not a dishonest person and I have never been in a situation like this before. I am desperately trying to make things right but this marker is killing me. Please can you help me?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My credit is poor, and I have just applied for a Citibank account just in case I need it. I did not apply for the overdraft though, just in case I was refused.

 

I shall wait with baited breath for the paperwork, and also to see if it comes with a Visa Debit card (very handy!)

In attempting to set up a parachute account with the Coventry Building Society for my daughter who is currently contending excessive overdraft charges from her current bank (Lloyds) the she has been rejected on the basis of her credit reference.

I can only assume this is down to Lloyds information passing back to the credit reference company (Equifax plc) due to her overdraft. As a consequence this affects her ability to switch accounts.

I am going to request the information that the credit reference company holds on my daughters behalf, but this will take time, is there anything she can do in the interim?

 

postnote - having read this link there appear to be other options (citibank etc). I'll encourage her to try there.

Just tried to open a parachute account with the Co-op - just a basic account: electron no overdraft chequebook etc... I got the Spanish inquisition: they wanted a complete income / expenditure ruck of data. 'Why?' - 'its just standard' - I walked away.

 

NOOoooobody expects the Spanish inquisition. Our chief weapon is surprise... and fear :razz:

I currently have an overdraft for £2100 which I use every month. I need a parachute account in case my account gets closed by the my present bank (Barclays). Does anyone know if the banks named above allow you to transfer your overdraft? Or could anyone tell me where to gt this information from?

It depends on you credit rating. If it's ok most banks will offer you a facility but they will expect (if they know about it) you to settle any existing OD

 

My advice is open a basic current account & then calculate your claim to see how much you will have available to repay the overdraft. As when you do start your claim Barclays will almost certainly call in your overdraft & close the account

I take from your last comment that Barclays close your account as a matter of principal after a claim has been made? :mad: Would be typical Barclays style!

 

I have applied to view my credit online and it is best with CallCredit 764 (four stars), Experian 730 (three stars) and worst with Equifax 649. :eek: Felt terrible when I viewed the file as now all my direct debits have been set up I haven't missed a single payment for at least two years! Still you live and learn!

 

Do you have any idea what the 'average person's ' score would consist of?

 

Suppose having an account closed would also have an impact on your credit rating too?

Closing the account should not appear on your file.......why should it........but the account ending allows you to use your DPA right's & demand they stop processing your data. That usually pees them off

Thanks for the advice! I am totally at a loss with all this info - I need time to get my head round it but by then all the banks will have gone bankrupt and I wont have claimed a thing!

 

Good job there's a forum like this where you can ask loads of thick questions and people will be kind and answer! I shall be donating to the group if I win my bank charges back!

I paid my £4.99, can log on no probs, but keep getting a report temporarily unavailable message whever I try to check. I have emailed them (a week ago) but got a wait 8 days and we'll get back to you reply.

I got my credit report from www.creditmyfile.com I paid for £16 to view all three of my credit records. They send you an letter through the post to verify address and it took around about two days to receive the passcode. I can now access all three as and when I require.

Would you believe it, got my Visa Debit card in the post today from Citibank, my god I have not had one of these since 1998 when I got in the sh*t with my finances!

 

Never thought I would see one of these again in my name.

Just a quickie, what constitutes bad enough credit to not be able to open a normal account. I am considering opening a parachute business account to enable me to pursue current bank without worrying about the consequences of them closing.

Currently trying to open a Royal Bank of Scotland "Key Account". I applied online and had to answer a few irrelevant questions about income, etc.

 

The form they sent through the post to sign had references to credit scoring and suchlike, even though no credit/lending is being applied for. I sent that back along with my driving licence and December's gas bill. Now they have returned my licence and gas bill along with a letter saying "the documentation provided is not acceptable for identification purposes".

 

They now require either

"a personal cheque drawn on another UK bank in your name, made payable to you for the minimum of £1.00"

or

"an original HM Revenue and Customs tax notification(P45 and P60 not acceptable). Must have been issued within the last 12 months and be valid for the current or next financial year"

 

I rang to check that a PAYE Coding Notice (it is) and asked what was wrong with the driving licence and gas bill. They say the gas bill is fine but they can only accept a driving licence for a face-to-face application in a branch. I asked why - they said that if my licence had been one with a photo the person in the branch would be able to verify it looked like me!

mfpa If your licence is a photo licence then call their bluff.........suggest that you will go to their nearest branch to have your licence confirmed!

 

The ICO & the FSA are now saying banks should NOT encourage customers to send original documents through the post.........& should accept verified copies

I don't mean to dampen anyone's spirits but I incurred ccj's and defaults on joint accounts when my husband was made bankrupt. He has been discharged for two years now but none of the banks listed at the beginning of this thread will open basic accounts for either of us.

Just thought I'd let you know that its very frustrating when these banks advertise accounts for people with adverse credit, then refuse to open even a basic account.

Sorry seahorse, I forgot to mention I have a Nationwide Flex account.

I have had this for about 15 years but only ever used it for the odd bit of savings.

When hubby went bust we used this account for all our personal banking.

The problem is this is the account I want to claim charges back from (about 3,000) but it seems,by reading other threads, that they will close account.
