      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Moo,

SC&M requested the one month stay on their AQ but have nad no contact, more than 3 weeks have passed. So following freebirds lead i sent a letter by fax yesterday asking them to enter into meaningful dialogue in order to reach a settlement.

I sent another today, re-itterating yesterdays letter and attached a copy of the schedule of charges in the claim with the interest calculation up to today's date, and again requesting their proposal for settlement (copies to the court of course)

I think i will do the same very couple of days now....the fax machine will be in meltdown by the time we've all finished ha! ha!.

looks like you may get some good news on the farepak front...fingers crossed for you.

well, i got a letter from the court today, saying SC&M have had a stay granted until 6th December. We now have until 18th December to reach a settlement. Im hoping that this means I'm gonna get something before xmas, but not holding my breath.

 

1st phone call to SC&M tomorrow i think.

You requested this stay to be ordered in the Allocation Questionnaire of the defendant, in order that a settlement is reached by way of negotiation. The court has subsequently acceded to your request and I am therefore inviting you to offer your proposal's for the settlement of these matters.

 

I am writing on the assumption that your request to the court was made in utmost good faith and with the genuine intention of resolving the matter in hand, rather than merely an attempt to further delay proceedings in this case. I trust that as the representative of a reputable and esteemed organisation, you would not hold the honourable court's order in such contempt as not to respond to this letter positively and in the manner in which your request for the stay has indicated.

Hi Moos, send a fax of the letter too, as we know that SCM don't get their letters straight away, that way you can follow it up with a phone call the same day or day after..........I'm sending you a PM so watch out for it....

ok, I have sent a letter to SC&M hopefully to speed things up a bit and sent a copy to the court, no response as of yet.

 

I dont have good access to a fax machine (only at work that im not allowed to use for personally use) so has anyone used the email address [email protected] which is on another thread?

 

If so, did it work? would it worth a try to try and email a settlement out of them?

Its marked Without Prejudice, Confidential and Privileged.

 

This letter is marked without prejudice and is confidential and privileged which means it will not be produced in court... blah de blah.

 

Willing to pay you the sum of £1611.51 to your account on the following basis -

well done you, thats brilliant news....hopefully you can get it before christmas which would be great especially in view of the farepak issue.

 

i got exactly the same letter last night when i got home!!! offer of the full refund of £4464!!!, so i'll be sending the same letter michael posted accepting offer and rejecting terms. so maybe i'll get a good christmas too and pays off some debts..heres hoping

No, don't send their letter back, just the one from MB's post will do fine.

 

You should find the money just appears in your account as 'settlement of claim'. Its doubtful that they will write to you again.

Moos they said 7/10 days to me, 3 days later I got a courtesy call from mr.t to say it was in my bank..nearly screamed the shopping centre down....keep checking a couple of times a day......
