Tifo,

With the FOS referral does that include late payment notifications entered on my credit file in complete error ??

£300 would be nice as they have not removed them despite stating they have!

There is no such thing as impossible; only the degree of difficulty required to achieve the desired outcome.

You are unlikely to get as the case states, especially for 2 weeks. It is also very hard to find the original judgement, but the appeal judgement which upheld the decision is available.

Best thing is to pass it to the Financial Ombudsman who should award £300 for a wrongful default. I have had a few of these and mine were over 3 years.

Depends if you want to do the work to possibly get more or get a quiet easy £300 out of it.

Thank you for the reply Tifo, not sure what you mean about the 2 weeks, Capital One defaulted me in 2006!

I have given up with the FOS, as made a complaint about another bank, and they did nothing, when i contacted them, they say they didnt recieve my documents!

Where would i find a copy of the appeal judgement? Thanks.

Markers sent in error should be included. Depends how they see it.

I'm not saying they'll award £300 as their levels are £0 - £300, £300 - £1000 and above £1000. Mine were defaults maintained when they should have been deleted, so i got £300 from one complaint and £200 from another which i asked them to make £300 to keep consistent.

Sorry, i thought they defaulted you and removed them 2 weeks later.

I have the appeal document and will upload it for you if you want to download, or can email it. Let me know.

Me and many others have tried to look for the original judgement but cannot find it. I've even asked mates who are barristers and they can't find it as well.

The original Judgment isn't necessary, as the Appeal Judgment outlines the original Judgment.
