Hi folks, having yet more "fun" with Natwest credit card, due to one thing and another I have not been able to make my payments for the last two months, I contacted Natwest and explained the situation and gave them outgoing and income figures over the phone, was then told they would send out an income and expenditure form for me to fill out and return which I have done with the same figures and also a covering letter as requested explaining my situation and making a repayment offer I think I could afford, which I did, today got a letter back from them saying the figures are incomplete and the offer is not satisfactory and asking me to ring them again with figures! So yet again it seems Natwest are acting as a law unto themselves, they are still charging defaults and interest whilst having been told I cannot service the existing debt, is there anything else I can do they seem to ignore anything that doesnt suit them! Just to show the difference my wife rang Barclaycard with the same problem and they agreed to freeze the interest for a year and accept £50 per month and review again in a year and that was all over the phone with no hassle!
  17. Although I have been a member for a while I have not posted on here before but I wanted to tell you about my experience with MKDP aka ****. In Oct 2013 I received a court summons from MKDP for a debt of £2400 which they claimed they purchased from Barclaycard. After reading different forums on here I sent my defence form back to the court. A few weeks later I received a letter from the court recommending that this matter could go to mediation and an appointment time and date was set. In the meantime I sent of a first letter to MKDP saying that the debt was disputed and requesting a true copy of the assignment, a full and detailed statement of the alleged debt and a copy of the signed credit agreement, but got no response. Sent a second letter requesting the same information but still no response. At the day of mediation I was contacted by a mediator who explained that after speaking to MKDP they had told her that this case would definitely be going to court and that I would loose the case. They also told the mediator that they had not received my letters but the information I requested would be available in time for the court case and I should consider settling. I thanked the mediator but said I would not be settling as the claimant had not complied with the guidelines set by the FSA and had not followed the pre action protocol set my H.M. Justice dept. MKDP responded by saying they would see me in court. I then sent a third letter to MKDP once again requesting the information and highlighted their breaches of the FSA guidelines and of the pre action protocal..still no response. Copies of all the letters, postage receipts and signed for deliveries were sent to the court for the evidence deadline. Despite MKDPs bravado they did not supply me or the court with any evidence of the debt or a copy of their witness statement. The day of the hearing arrived and at the allotted time nobody from MKDP had arrived. I had prepared two defences one for if they did attend and one for if they did not attend so I was ready for any eventuality. On being called into the hearing the Judge quickly made it clear that he was not a happy bunny and with very clever wording was berating the likes of MKDP. The judge then told me that he was going to strike the claim out and awarded me cost of £96.00 giving MKDP 14 days to pay up. RESULT. What a laugh despite all their bravado and claims about the evidence they had and would produce at court all they can produce is a NO SHOW. I don't think for one second think they will pay the £96 but hey. So although you guys did not realise it you have helped me a lot the information you post on these threads is invaluable and without it I probably would not have got the right result. THANKS GUYS
  18. Hi Guys, So I'll make it simple if I can. - Advantis sent a letter to me about a month ago requesting payment of £107 for an outstanding bill with Virgin Media that I had a couple of years ago. I ignored it. I thought I'd see what happens. - When they thought it was appropriate to call me at work in the middle of the day stating who they were to a colleague I thought enough is enough (like Barbra did). They told me via this phone call that they would send another letter. They did, this time with the threat: NOTICE OF INTENT TO COMMENCE DEBT COLLECTION ACTION. Scurry stuff I think you'll agree. - I thought I'd give Virgin Media a call to confirm this amount. The gentleman I spoke to was extremely helpful and indeed confirmed the amount I owe. - I asked Virgin Media if I could pay them. They said no because they had sold it on to Advantis who I now have to pay. Groan. - I have no issue with paying this money. The issue I do have is with this company, Advantis who I picture as working from a trailer parked at the side of a road somewhere. After reading all of your posts and threads on them I really do not want to have to hand over any money to them because I don't trust them to be quite honest. Also the outstanding amount of £107 is still listed with Virgin Media on my credit report. I am concerned that if I did pay Advantis then it would still show on my credit report as defaulted. Like, I just get the feeling nothing would happen. I've worked in a cold calling sales company before and I know exactly what happens in all of these types of companies. So that's where I am at the moment. Can you guys suggest anything or do you think I should just pay Advantis and be done with it? If so, after paying Advantis should I contact Virgin Media to get the credit file default removed or changed to settled or will this automatically happen. Any advice would by much appreciated. Or if you have had the same experience then I'd be glad to hear about it. Thanks guys
  19. MDK have issued court proceedings against me over an old all edged barclaycard debt . This was bought by them from barclaycard at the beginning of this year . I have responded to defend this as I am almost certain that there is no signed credit agreement . However most of the debt is made up of charges the claim is for £2,500 . There is also PPI to claim back on the account too . I was wondering of I should just defend on the no signed bpcredit agreement? Or counterclaim.
  20. It's a very long story but in short, my neighbour's property was gutted by fire in January (unfortunately, the lady lost her life). My house was extensively damaged by smoke and Liverpool Victoria had a loss adjuster round very quickly to establish that all the contents of my cellar and loft area need to be removed for chemical cleaning/disposal, all insulation needs to be replaced, my carpets and furniture require professional cleaning and the house needs fully redecorated. I have pursued this vigorously as I have 2 young children and our belongings (as advised) are all in cardboard boxes. So far (under duress) they have removed all insulation from the house (which is now very cold!) and striped half the wallpaper (chunks are hanging down off walls and have been for weeks). All the items we had stored in the cellar and loft (which amounted to a substantial sum due to their specialist nature) have been removed almost from day 1 with no list, update or knowledge of where they are or who has them. Every time I call I get fobbed off. Last Wednesday I was promised a call, same again on Friday, Tuesday of this week and still no-one has called. I have formally complained but I might as well not have bothered. What can I do to force LV to take ownership of this claim?

Hi all, I've researched well into this and think i know the answer but a very brief overview; The girlfriend has received 2 letters at her parents' address (formal demand and notice of impending action) from Past Due. They're standard letter formats. The debt amount is fairly small but in three figures with a service provider (TV/broadband etc) whom she cancelled the contract with around 3 / 4 years ago. At the time she cancelled informing them that she was leaving a relationship and also that address. They advised that the account was settled and that she could cancel the DD (verbally, we have no written evidence) - which she did. We are assuming the debt is for the previous address but can't be 100% certain without further evidence. She doesn't know how they found her and is obviously very concerned by the whole thing. As are her parents. I see a few options; 1) standard 'prove it' letter 2) ring Sky to get further info 3) ignore the whole thing for now (ideally not this option as her folks will go mental). Thoughts on the best way to proceed? We're going to check her credit report tomorrow. As another note they have spelled her first name incorrectly. I'm not sure if this has any bearing though. Thanks

Hi all, There is a portion of land at the rear of my property that belongs to the local council…it is a 'dead' piece of land as it is accessed wither from my garden or from a conservation parkland area at the rear…there is no public access onto this land. I moved in in 2001 and at that time a lease had been in operation for 25 years and I took this over from the previous owner…at the end of this lease the council have variously tried to sell the portion of land at an exorbitant cost which I refused and after involvement from my then MP the matter was dropped…they then tried to set a new and very expensive lease in place which I have been resisting for some years and last year they said that they would commence legal action to recover the land - I disputed this and that was the last I heard of it until Friday last when I received this email from the council…. The Council obtained a Possession Order in XXXXX County Court on 12 February 2014 in respect of the allotment land which was previously leased to your predecessors in title at XXXX. District Judge XXX ordered possession forthwith and ordered you to pay XXX in respect of costs and use and occupation charges. We will be reclaiming possession on site shortly and will be dismantling the shed and placing it and any of your belongings in your garden. If you wish to have a representative attend on site when we are reclaiming possession please let me know. In addition if there is any substantial further expense to the Council regarding removal of fencing or reinstatement of the boundary we will be claiming same in addition to the XXXyou have been ordered to pay by the Court. I have received no notice of court action or anything from the court…they have my email so I think they may have just sneaked this through…. I really need to know what my rights are if any and whether they have acted illegally in taking this stealth action. Any advice gratefully received… GIB

Hi All, I am new to the site but have been looking around the various forums to try and gather some info. back in 2007 we bought a new house then around 2008/2009 I had to take a reduce salary in order to keep my current position. With the increase in mortgage payments and reduced salary this meant that I was unable to keep up with my credit agreements. Originally I owed around £35k however after a round 4-5 years I am down to £13k. I have agreements with all my creditors and have met the payments every month since the problem occurred. I will list the details below: Lloyds Load £4569 Pay Lloyds direct Defaulted 15/06/10 Pay £185 per month Lloyds Credit Card £880 Pay Lloyds direct Defaulted 29/11/2010 Pay £80 per month HBOS Credit Card £3324 DCA Blair, Oliver Scott Defaulted 14/04/2009 Pay £65 per month Esure Loan £2150 DCA Blair, Oliver Scott Defaulted 30/01/2009 Pay £45 per month MBNA Card £1000 DCA Idem Servicing No Default Pay £50 per month MBNA Card £1000 DCA Idem Servicing No Default Pay £50 per month I am currently paying £500 per month to try and clear my debts and should be clear in around 26 months. my first question is would it be worth sending a CCA request to any of these companies? Secondly some of the defaults are due to be removed early 2015. Will this remove the payment history along with the default account or will it still remain an open account (minus the default) as debt will still be owed. Thanks in advance DJ

Hello All, I am a Toastmaster, and tomorrow I am going to give a speech about these bogus parking charges etc. Is there anybody out there that can provide me with a copy of one of those lovely bright red letters "Pending Court Action" that they usually send 3 of before giving up. redacted of course. I really need a copy of a letter to help my presentation. Many thanks.
