  2. Yes it was on table 1, it looks like they know the are dealing with SB's but try and put a bad mark on your file.
  3. Any news on this? I have had the same done to me, had a vodafone account d/f 2005 it was with Lowells but I had already paid it off before they got it and have the receipt from Allied International, so told them to take me to court everytime Lowells wrote to me as I would not provide them with the receipt, got a letter from Muck Hall last month acting for Lowells told them the same "go to court, already paid etc" they said ok send it back to lowells, it is now gone 6 years and the D/F has fell off leaving my report clean except for a brnad new "outstanding debt" search from Muck Hall, why would they need to search for me I already told Lowells that it is me so never any need to try and find me. Awaiting response from Equicrap but know what they will say.
  4. If you have all the costs showing I wouldnt really worry about the non compliance, if it ever got to court you could raise the point then but I would personally concentrate on the charges claim rather than getting bogged down in court procedures.
  5. Hi, You will have to wait for the FOS to reply, if it is PPI then they cannot really argue against it although I have no personal experience of PPI I dont know of any claims being refused.

Hi Loops, You could just ignore them as your agreement is from 93 wont come under the online agreements dates, but they will reflect this on your credit file, alternatively get a letter before action sent out for the charges from the template in the library on this site but be prepared for the long run as they will force you into legal action before they settle. Let us know how you are ggetting on

I don't know the situation with court fees and benefits but the court fees should only be around £25 + £25 hearing fee , I would not get to involved in the court processes yet as you have to wait for them to (inevitably) turn you down, all court fees and hearing fees will be claimed back from the so not a worry, let me know when you have your SAR because they are quite often non-compliant

  10. The only real argument you could put up was that the goods were not "fit for purpose" or under section 35, a link is attached but I don't expect Shop Direct to be helpful in the matter.http://www.legislation.gov.uk/ukpga/1979/54 Good luck click on star below if this was helpful.

Don't forget all their charges are open to assessment and unenforceable, I have in the last 10 days acted on behalf of a relative got back well over £500 for her on 3 accounts, so this is something to keep in mind if any agreement is finally reached and also if you wanted to dispute the D/N.   12. The strangest part of all this thread to me is where interest is coming from as Kays don't charge interest! Would be an idea to check they did not make your account into a loan as I have heard of this happening a few years back, which would make sense with the dates they seem to be quoting, not an issue for you but may be where they are getting their info. This would show up on your SAR. Hope it works out for you as I despise S/D as much as anybody on here. cheers

I use http://www.bllaw.co.uk/services_for_businesses/insolvency_and_recovery/simple_interest_calculator.aspx to calculate interest,when they finally settle he will give some nonsense that your Very acc should have been calculated at a flat rate of 33.87% although your APR is 39.7% this is more rubbish as you pay at 39.7 not 33.87. Yo have to be prepared for the long haul as they are a very arrogant and dismissive group of people who will continually ignore you. The current claims of my relative were due for hearing on 8th June and only settled in full on 20th May so don't expect any fast resolution. Remember to keep your correspondence at a professional level and to the minimum requirement as these people more than any others caused me to react in an unprofessional manner. Let me know when you have your SAR and we can get started on them.
  14. Yes, its £10 per request, but you will add this to your total. Should be interesting as I think additions is about 44% interest! you can go back through the statements online but not sure how far back you can go. Keep us informed of where you are up to cheers

  17. I think Tower investigations have been foolish enough to purchase this from Cabot in a last ditch attempt before it becomes S/B, some of these DCA's are quite laughable in their vain attempts, "contact us to assist in our enquiries" hahahaha

In that case there's nothing you can do, you have to accept the D/N as what their letter states is correct, it also means along with the D/N your available credit will also be reduced by the £2500 as this sum stays on with the D/N for the 6 years - what this means is everybody has an available credit limit linked to their credit score based on the amount of credit you have open and the amount available, this will be considered as open credit.
