  1. Excellent LD Make sure anyone who is or about to enter litigation has a copy of this info In fact I suggest it is added to the forum as a well placed sticky
  2. If their uniform &/or their behaviour can be mistaken (by anyone) as being that of a police officer they are committing a serious offence. If I were you I would complain to a senior police officer, super or above
  3. Are they making it sounds as if failure to pay will result in your data being made available to others & if you do it won't? As for the claim that interest is accruing you can treat that with the contempt it deserves ..... it isn't as only a court can award such interest
  4. It will become statute barred UNLESS you have accepted liability within the 6 years AND your recent correspondence could be interpenetrated by the court as an admission, it very much depends on the wording. You will only find out (as will they) once the matter comes before a court
  5. Offer, acceptance, consideration (payment) BEFORE dispatch means the contract has been entered into. If payment was to be upon receipt of goods then the seller would have the right to change their mind AND the price
  6. Quite & aren't you Tracy the poster who admonishes others for not being morally sound because they 'won't' (in your mind at least) pay their debts
  7. It is NOT lawful for the police to 'introduce' the bailiff., in the same way that its unlawful for the data to be linked to the ANPR and remember we aren't necessarily talking CCJ's just unpaid parking charges which 'they' still think of as 'fines'
  8. We know from experience that whilst the opposition are supposed to volunteer even adverse info they seldom do & regrettably the courts don't often punish them for it as they should
  9. If you can convince a court that you have been misled into accepting full & final when their whole agreement was unenforceable then yes you can claim. However I suspect the lender will argue you agreed to full & final therefore you will have to look to the courts for permission to proceed to a declaration of unenforceability
  10. Then precisely why are you here do you have financial problems or do you simply want to express your 'high' morals AND I like the others don't believe your who you claim to be. Your probably connected to 'some' DCA PS I don't normally comment on another's spelling/grammar but in your case I'll make an exception ...........its appalling
  11. Their excuse is to claim that those with outstanding fines (which of course they aren't) are more likely to be involved in crime. As for advising debt collectors when they stop someone & forcing them to remain in situ until they arrive is strictly a no no
  12. The Standpoint post 'assumes' mistakenly that those accused are actually guilty of a crime when we now know that not to be true by any means
  13. Are you a minor if so RLP are talking nonsense they MUST communicate directly with your parent or guardian not you AND despite what they claim, by demanding unsolicited payments they are pseudo debt collectors
  14. There is NO debt for them to pass to debt collectors There is only their 'demand' which if they do pass to debt collectors they will probably guilty of demanding money with menaces
  15. Are you of ethnic origin? if so their actions are discriminatory & NO ONE can force you to pay over £80 for a passport its simply NOT reasonable particularly if your presently unemployed. If the Job Center sent you report them
  16. They cannot place a default on your file long after you defaulted. IMHO you should contact them & tell them that as a result of their unlawful actions you have been denied a mortgage & that you intend to seek legal recourse against them & yes start your own thread & put a link here
  17. The police acted unlawfully. They should not have just taken the word of LBL further straightforward enquiries would have revealed the truth Also whatever you do DO NOT attend the police station without legal representation If you get stopped ask them why they are involving themselves in a civil matter & are they aware of this firms reputation If not tell them to check the web that should dispel any illusions they might have
  18. NEVER EVER tell them in advance that they will be recorded However its perfectly OK to tell them after & 'after' elicits a much more satisfying response:D
  19. As what you state is accurate theres really nothing to add other than posting on youtube would mean you could not identify the individual the firm yes the individual no ............. unless its with their consent .......... personally I find Skype & Pamela suits me
  20. Quite its simply a matter of law & to suggest it needs to be multitrack is nonsense. I should warn THEM about costs if they persist in this rubbish
  21. I think you'll find they are allowed to transfer funds between linked (by name) accounts irrespective of their status. Its known as 'setting off'. Also they can argue 'change of position'
  22. Does the total sum offered exceed any arrears? If so they must pay the balance direct to you & not set it against the loans
