  1. Missus got speed camera nip through with a section that allows yo to tick speed awareness course (if suitable) fixed penalty or court. My concern is it doesn't state the penalty or points you will get, is that legal? It also has warning that if you fail to reply to the s172 notice the penalty WILL be higher than the speeding fine, I thought both were max £1000 and 6 points?

It would be impossible to take any action for going 'on holiday' in itself as you are unfit to work not on a prison sentence and what would define a holiday rather than a trip to be cared for by a relative for example. The only problem would be if the content of the 'holiday' contradicted your sick note. For example if you were off with a bad back and you went rock climbing in the Alps and plasted the photos all over Facebook then they may have a reason to investigate but if you are lets say off with depression and decide to stay in a Villa in Spain for a week there is little they can do. If you have a sick certificate from your doctor you should be able to cancel the leave you booked and just remain sick.
  3. You can pay up 'til midnight the following day, its not hard to find the info on the TFL cc page to be honest. I'd suggest paying the PCN at the earliest opportunity as you haven't really got a leg to stand on.
  4. There is also a sign on the left that says 'congestion zone 220yds ahead to avoid charge follow other routes', its also a bit obvious you entered it so you could have then paid the charge to avoid a penalty.
  5. There is clear signage before you meet the Euston road telling you its the zone ahead and to turn off to avoid it.
  6. If I were dealing with your appeal I would reject it just for tone of the letter after all its not going to cost the person who reads the letter anything is it? Councils deal with hundreds of letters a week and follow a protocol for dealing with appeals based on the contravention, grounds for appeal and exemptions. Making threats about going to the adjudicator never comes into it, you either have supplied grounds to cancel or you don't.
  7. If the original was still on the car I would complain as its ridiculous to just say you should have moved if the car was causing such a problem they should have towed it.
  8. Had you removed the PCN? If nothing has changed since the first ticket they cannot enforce further PCNs. Technically they can issue as many PCNs as they like its enforcing them that becomes unlawful.
  9. If you broke down just appeal on those grounds. Why would you want to view the footage you broke down you know that, what really is the point of making FOI requests about ccrv etc it just makes you look stupid?
  10. I would have thought that the adjudicators letter posted by MB above would indicate why it was allowed! However its best if you start your own thread and post all the details trying to use someone elses appeal for a different ticket sometime after the first is a bit pointless they may have changed the signs or even changed the restriction by now.

I appreciate that but some of us on here have years of experience of these things so if we suggest something its usually for a reason for example in this case anyone can get a blue badge number by looking at a badge on display in a car. However in this case it was only the informal reps so no harm done, just get the badge sent off and you are more than likely going to get it cancelled.

  13. Why do you want a description if it wasn't you? Surely the only thing you need to bother about is getting off the alledged offence. As far as I'm aware the driver is liable not the keeper so all you have to do is opt to go to Court and plead not guilty.
  14. I'm slightly confused? You say you got a rejection but at the same time they asked for the badge details which you were advised to send in your reps, why didn't you follow the advice given?
  15. You will need to show you got to where you parked without passing a permit sign, the fact that is not one in the street you passed is less important.
  16. I think its a bit hasty to start claiming this is a slam dunk win we have seen neither the PCN nor the location. The fact that there was a sign nearby saying 'permit area ends' would suggest that at some point a sign saying 'permits only beyond here' was passed before parking.
  17. So in this case the OP did not cause the use of the vehicle?? It doesn't mention anything about 'mates' you haven't explained a thing you have just given your interpretation of the law.

  19. You are not insured if your policy has been cancelled, you still do not understand the law! S151 requires the company that issued the insurance to pay out on any claim HOWEVER subsection 8 clearly states if they have to pay out they can reclaim the money from you. All section 151 does is remove the liability to pay a claim from the insured to the insurer.
  20. What you say and what you are doing are two completely different things, you are insured for what you are actually doing not what you later claim you were doing. If you ran a child over at 9am on a monday morning and they needed a few hundred thousand £'s of care do you really think the insurer isn't going to make enquiries? I do not think the purpose of this board is to advise people to lie to avoid getting the correct insurance.

  23. If its in a CPZ they are meant to put a seperate time plate on the syl to avoid confusion such as this.
  24. I think you need to read sect 151 again! Section 151 deals with the certificate NOT the policy, the act states that if you have a certificate of insurance that has not expired the company that issued the certificate is liable for 3rd party claims. That is why most sensible companies that cancel will ask for the certificate back. That is why the section does not satify the need for insurance as you must have a valid policy not an unexpired certificate.
