  5. Points to note when writing to MPs: - You have to go through your own constituency MP (find out who yours is at TheyWorkForYou.com: Are your MPs and Peers working for you in the UK's Parliament?). If you write to others, you will just get a polite reply asking you to contact your MP. - Have a look at your MP's website; it will give you a feel for their areas of interest (apart from expenses), and they usually provide a guide to what they can and cannot deal with. - The best way to get a meaningful response is to ask your MP to get the relevant Minister to provide an answer e.g. "Could you ask the Minister for Consumer Affairs

  7. Hi Jemn [/lecture mode on] Crude oil doesn't live in holes but rather in porous rock deep underground in which it accumulates. It is then prevented from escaping by a non-porous rock on top, or cap rock. So unless we come along and drill for it then that is where it stays. With carrier bags we first have come along, drilled for oil, extracted the oil, refined the oil, taken various components of the refined oil and added various chemicals and additives to it before polymerising and setting into the shape of the plastic bag. The bag is then transported from the manufacturing facility to a warehouse and from the warehous

  8. Oh we were about 3 months away in this case which I suspect is quite a long time. This was resolved before the pre-trial checklist was submitted. My case was extremely strong & clear cut though and I think it was obvious to them that I wasn't going to back down. A nail in the coffin for the Rankine offensive. D

  10. Have a read Hobbie and aj and then quote this act: Sale of Goods Act Quick Facts - BERR This will only apply to Hobbie as he has detailed the faults and timetable. You should adapt to suit your problem aj. Your rejection will be - Non conformation of contract, Inherently faulty at time of sale, Not of satisfactory quality and Not fit for purpose. Quote the acts in your rejection letter. There is a template here courtesy of Bournemouth trading Standards. Sale of Goods

  11. Here's my reply to IQOR: IQOR 33/34 Winckley Square Preston PR1 3EL 22nd August 2008 Dear Sirs, Your Reference: xxxxxxxxxxxxxxxxxxxxxxxxx Thank you for your threatening letter dated 15th August 2008 which arrived here on 21st August. I note that you gave me until 10am this morning to find £xxxx. You know this of course, as well as realising that I would not read it until I came home from work last night, so your letter was deliberately timed to try and induce the sort of panic that would force people to ring you and speak to the brainless, power-crazy control freaks who man your telephones.

  14. Application Hearing, Today, 14:00 Lambeth CC Bit of a Curate's Egg, really (good in parts!): Judge started off by asking Defendant's Barrister whether they were sure they wished to proceed with the Defence they had submitted. The Barrister said they did. Judge recognised immediately that they had played the Halliday card (see para. 5 in their defence). He said that it is clear that the Claimant has put forward a much more sophisticated argument than the one they appeared to have responded to. He said that in his opinion the matter of whether or not I was awarded at CI levels and not S69 levels was the only outstandin

  16. This company is awful. they use dirty tactics. They are currently harassing me. I am ignoring them as, if they do take me to court, the way they have tried to collect the debt will come into question. If you look on the internet there is only bad stuff about this company. They tried to tell me my husband was responsible for my debt, he is not. They are a nasty company. Go to trading standards about them. they have broken the law going to your neighbours. Read the info on debt collection. They break every rule in the book. Let them try and take me to court!!!!!! keep me posted. But do not get stressed about this tin pot compa

  17. I can only advise on the basis of what was said and done but please ask away. I'm no legal expert. I stood up to these 's because I can't stand bullies. The good people here propped me up and, without their help, I'd probably have given up well before this point. This has given me tremendous confidence in my ability to deal with the other 2 cases and be less hassle for Paul et al from now on. I know what to expect now and how to put the various required documents together. Sure, I'll still need some advice (mostly in checking what I've done) but none of it is new. I can probably help with the basics so ask away. The most

Hopefully the visit up to Sunderland with the clan Charlton (and the CAG night out tomorrow) will invoke further fighting spirit and I'll be back to help others soon. Love to you all! BIG KISS!!!!!

I'm sure there's others, like me, who don't really know you but have posted because our hearts have gone out to you. I'm sure a little bit of insanity now and then goes a long way

  23. Hi cfc Sorry I didn't get back to you , but you're in good hands with pete:). If it were me I would carry on with the claim - send an LBA referring to your first letter and their (inadequate) reply. Stick to the timetable and open court action asap. Your claim will be stayed along with the rest, but you'll be in the system and the 8% interest will be in force........ Also then, if they threaten you with court action, your counterclaim will come into play............ and they won't go down that road. Furthermore ,your claim is then officially in dispute ,so they can't pass it on to a DCA - nor can they default you .

  24. Then it's my system problem then - cos they do! and Sequenci I like to think I'd only congratulate people for contributing something useful, it encourages people like it did me when I first started here. Bookie put me in no doubt once about getting rep points for the right reasons ( never forgave her for it! ) god bless her cotton socks!

  26. Without a CCA they are unable to enforce an alleged debt and you are legally entitled to withold payment. As regards Complaints just right to Lowells Group requesting a copy of their complaints procedure. They are obliged to have one and supply you with details. The basis of your complaint will be that they are harrassing you for money by failing to supply proof that a debt exists

  27. Quite the understatement, my modest babe. Actually she drove me around Blackpool all day helping me do my bits and bobs, and then waited in A&E with me with DD. After that she delivered my hobbling ass home, and set off. She made it 5 mins and broke down at the traffic lights, again at the hospital - backing up traffic. Her mobile battery was dying and the RAC guy nowhere near!. She got home OK in the end, thank god. Cheers hun, you are a legend...... mwah. Can't wait for this meet, I got introduced to my sobriety after the Liverpool meet and quite frankly, he's boring!.

  36. Hiya Tommy and welcome back . If you used the CAG LBA Template it actually says you will take action without further notice to them, all you have done is allowed them "a bit" of extra time to sort themselves out... although 18 months is quite a big bit . You quite possibly do fall into the hardship category but you will have to fill in an income and expenditure form to prove it to the bank. pete

  37. Hiya CFC, your claim under hardship circumstances wont affect your credit rating, the only facts the reference agencies take account of is whether you have defaulted on any payments. pete
