That is really helpful.

Just one thing,whats your opinion on the ppi thats been charged for.

It was sold to my wife when she was a housewife as it says on the agreement.

Am I pushing it do you think.

Is it being a bit silly,trying to reclaim ppi if I am disputing the account?

Everything is filled in on the agreement,but my other half has not signed it.

hmmm, a difficult one I would think.

 

I am not sure how you would go about this. Especially if you are disputing the account. However, if the policy was mis sold then it could throw even more doubt on the agreement should it turn up !

 

I would say that the PPI was not of any benefit to your wife, if she was a home maker. This type of insurance covers you if you are unable to work !!

 

I will flag your query up for the site team and see if they can offer any advice.

We do have the agreement but it's not signed by my other half.

It is signed by someone,but not my wife.

Everything else is my wifes details except the signature.

It even threw the judge,she thought my wife had signed it,untill I pointed it out.

Think I may mention the ppi to the judge in the skeleton argument.

Hi everyone.

Been to court today.

Got in with the judge and she asked if we were surprised that no one was there to represent Cohens?

I said no and asked why?

The judge said she had recieved fax from them 10 minutes ago,informing her that they were discontinuing with the case..........

The judge said so that is the end of the case as far as she and us were concerned.

As for costs she said she could not allow the litigant in person costs or the costs for postage or other sundries.

The only thing she would allow was the cost of transport £11.40!

Ah well.

They have fourteen days to pay up............

Kim, this is great news. Sorry nobody has been along earlier to congratulate you - I'm guessing the site was quiet and people were suffering football withdrawal.

 

I'm amazed the judge didn't award costs - a travesty. Did you ask for them beforehand? Can't understand that bit.

 

Well done. Proud of you. Another CAG success!

Not been receiving my subscribed updates to this thread... strange.

 

Anyway, you can submit a costs schedule to Cohens and they will pay it within 21 days (they've paid two of my friend's ones in the past month or so).

 

If you need help with that let me know.

I'll go in more detail tomorrow but needless to say you can get around £250 out of them without them batting an eyelid ;-)

Here we go then...

 

I have attached a letter for you to send them which you need to adapt for your own circumstances.

 

I have also attached an example costs schedule which I produced on Excel but of course your own personal costs may be different.

 

You also need to fill out an N252 form to attach with the letter and your costs schedule. I have attached a copy of the one I sent to HC which matches the details in the letter and the costs schedule.

 

So that's three documents to forward to HC... if you send today the deadline for reply is the 23rd July (21 days).

Just need to convince my other half to do this.

She is reluctant to do things that may stir them up on another case,that is stayed at the moment........

I am quite happy to give them all the s**t I can.
